Agreement for Payment of Citv of Asp en Develop ment Ap plication Fees
CITY OF ASPEN (hereinafrerCITY)and The Citv of Aspen Parks and Recreation Dept.
(hereinafter APPLICANT) AGREE AS FOLLOWS:
APPLICANT has submitted to CITY an application for
(hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that City of Aspen Ordinance No. 57 (Series of
2000) establishes a fee structure for Land Use applications and the payment of all-processing fees is a
condition precedent to a determination of application completeness.
3• APPLICANT and CITY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent ofttte costs involved in processing the
application. APPLICANT and CITY further agree that it is in the interest of the patties that APPLICANT
make payment of an initial deposit and to thereafrer permit additional costs to be billed to APPLICANT on
a monthly basis. APPLICANT agrees additional costs may accrue following their hearings and/or
approvals. APPLICANT agrees he will be benefited by retaining greater cash liquidity and will make
additional payments upon notification by the CITY when they aze necessary as costs aze incurred. CITY
agrees it will be benefited through the greater certainty of recovering its full costs to process
APPLICANT'S application.
4. CITY and APPLICANT further agree that it is impracticable for CfTY staff to complete
processing or present sufficient information to the Plaruting Commission and/or City Council to enable the
Planning Cormmission and/or. City Council to make legally required fmdings for project consideration,
unless current billings are paid in full prior to decision.
5. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to
collect full fees prior to a determination of application completeness, APPLICANT shall pay an initial
deposit in the amount of $ which is for _
time, and if actual recorded costs exceed the initial deposit, APPLICANT shall pay additionalemonthl~
billings to CITY to reimburse the CITY for the processing of the application mentioned above, including
post approval review at a rate of $205.00 per planner hour over the initial deposit. Such periodic payments
shall be made within 30 days of the billing date. APPLICANT further agrees that failure to pay such
accrued costs shall be grounds for suspension of processing, and in no case will building perrtritr be issued
until all costs associated with case processing have been paid.

The City of Aspen is the applicant for the public improvement project known as the Maroon
Creek Bike Trail, which is to be constructed between the Aspen Recreation Center and Aspen
Highlands Village within and outside of the City of Aspen, Colorado.
The City has been given permission to pursue land use approvals for this project by the
underlying property owner, Pitkin County. Attached is a letter from Pitkin County
acknowledging this permission. The State Pazcel Identification Numbers for the property is
2735-142-]8-003.
Please accept this letter as formal permission for Newland Project Resources, Inc. to represent the
City of Aspen in pursuing a Stream Margin Review Exemption for the Maroon Creek Bike Path
Project.

Parks and Recreation Department to pursue 1041 Hazard Review approval for
the Maroon Creek Bike Path project. The project site is located on portions of
the Maroon Creek Road right-of-way and the Aspen Highlands Village Parcel A
Open Space tract, both of which are-owned by Pitkin County. The County
understands that the proposed trail will utilize a portion of the west side of the
Cemetery Lane right-of-way and will not significantly impact the vehicular use of
the' road. _

SPECIFIC SUBMISSION CONTENTS
EXEMPTION FROM ESA REVIEW
Description of Proposal
The applicant is proposing placement of a 10-foot wide pedestrian/bike trail that will
connect the Highlands Base Village to the Aspen Recreation Center and School
Campus. The site is located along the west side of Maroon Creek Road north of the
Highlands Ski area. The alignment crosses over road right-of-way and open space
owned by Pitkin County. The completed trail will create a safe pedestrian trail corridor
where one does not curcently exist. This trail will contribute to a connection for the
"seamless" trail system the City of Aspen is striving to accomplish by connecting the
residents and visitors of Aspen Highlands Village to the High School/Community
Campus area and further on into town. A key link for the community trail system will
result from the creation of this trail.
The Maroon Creek Bike Path will bring users to the trail system connecting to the High
School/Community Campus area, Tiehack Ski area and to the Marolt and Moore open
space areas. A further connection is created between the Owl Creek/Highway 82
AABC trail and the Cemetery lane Trail to the Rio Grande Trail Regional Trail.
Increased public recreation opportunities and an alternative transportation option for
commuters traveling up and down the Maroon Creek corridor will result. When
completed, this trail will be managed and maintained as part of the City of Aspen trail
system.
The Maroon Creek Bike Path is the result of citizens petitioning the Aspen City Council
and Pitkin County Open Space and Trails Board for a trail connection between
Highlands and High School/Community Campus area. The applicant has already
initiated the public review process and has experienced a high level of support for this
proposed trail project.
Because of existing environmental factors present along the alignment of the Maroon
Creek Bike Path, the City has committed to taking innovative measures to ensure that
the environment is minimally impacted. Included to this description are photographs of
the existing conditions along the alignment. The alignment of the trail must cross three
steep slopes/escarpments on the west side of Maroon Creek Road. In order to maintain
a safe trail environment and to minimize impact on the slopes, pedestrian bridges are
proposed to cross the steep sections. The pedestrian bridge spans and abutments will
be designed to minimize impact to the steep slopes. Much of the remaining proposed
trail alignment will be located on the natural benches along Maroon Creek Road.
The trail alignment was placed on the west side of Maroon Creek Road primarily
because of the several side-road crossings required if the trail were to be placed on the
east side. In addition, the west side alignment offers the opportunity to meander the trail
in and out of small stands of aspen and scrub oaks, greatly adding to the trail experience
without compromising safety.
The trail will provide a safe, quality experience to the trail user. The existing route is a
stressful experience that is potentially detrimental to the pedestrian or biker, as it
requires the co-mingling of vehicular and non-vehicular traffic on a single roadway. The
current situation is not safe to use by school-age children. The new, separate trail
alignment will permit the user to avoid this unappealing experience and be able to focus
on the spectacular scenic vistas of Maroon Creek and native vegetation this route has to
offer.
2. Site Plan Drawings
Drawings of the trail alignment are included within ATTACHMENT 3 -MINIMUM
SUBMISSION REQUIREMENTS.
3. Development Approvals for Property
Although the open space parcel was granted to Pitkin County as a part of the Aspen
Highlands Village PUD, no specific development approvals have been granted for the
open space parcel or the Maroon Creek Road right-of-way.
4. Recorded Documentation
No recorded documentation, such as recorded plats, agreements or deed restrictions,
affects the proposed development.

The design proposed for the bike path locates the grade on the top of the Maroon Creek
canyon, well above the floodplain for the creek. The following is a response to the
review standards required for ESA Exemptions by the Planning Director:
1. The development does not add more than ten (10) percent to the floor area
of the existing structure or increase the amount of building area by more
than twenty-five (25) percent.
The development proposed is a public bike trail and floor area calculations are therefore
not applicable.
2. The development does not require removal of any tree for which a permit
would be required pursuant to Chapter 13.20 of this Code.
The trail will cross areas of land that are vegetated with trees and shrubs. However, the
trail alignment is such that no tree requiring a Tree Removal Permit will be impacted by
the construction of the trail.
3. The development is located such that no portion of the expansion,
remodeling or reconstruction will be any closer to the high water line than
the existing development.
No existing development is present on the project site.
4. The development does not fall outside an approved building envelope if
one has been designated through prior review.
No building envelope for the property has been designated.
5. The development is located outside of the special flood area and more than
one-hundred (100) feet measured horizontally from the mean high water
line of the Roaring Fork River and it's tributary streams, or the expansion,
remodeling or reconstruction will cause no increase to the amount of
ground coverage of structures within the special flood hazard area.
The entire bike path is located outside of the 100-year floodplain of Maroon Creek as
defined by applicable studies (see attached floodplain mapping for the project site). The
mean high water mark is located more than 100-feet below the bike path at the bottom of
a steep canyon. Further attached is topographic mapping for the project area showing
the elevation of the creek and the elevations of the top of the canyon, which ranges from
104-feet to 122-feet in the project area.
