Re: Subdivision - Donald F. Newbury
and Patsy Newbury
Dear Commission Members:
The undersigned are all owners of lots within the Castle
Creek Subdivision of which Lot 3 owned by Donald F. and
Patsy Newbury is a part. The purpose of this letter is to
express our opposition to their proposed subdivision, which
is to come before the Commission on Tuesday, August 6, 1974.
The reasons for our opposition are simple:
1. The protective covenants for Castle Creek Sub-
division which were recorded in Book 180 at Page
399 of the records of Pitkin County, provide in
paragraph 11 "the sale of a portion of any lot
is prohibited except and by the written consent
of the parties to this agreement, their heirs or
assigns." This of course creates a private right
of action against a party attempting to divide
their lot, and we don't intend to imply that the
Planning and Zoning Commission ought to put it-
self in the position of enforcing private pro-
tective covenants. We do however feel that the
Commission ought to be aware of the covenants,
particularly when they are more restrictive than
the zoning applicable to the particular area and
when the requested resubdivision alters substantially

the character of the existing subdivision that
has been in effect for a substantial length of
time. Incidentally, and by way of information
only, it is the intention of the undersigned
parties to proceed by private action filed
in court to prevent any resubdivision of this
particular, or any lot in Castle Creek Subdivision.
2. We believe that the intent and spirit of the sub-
division regulations of the City of Aspen are to
aid in preventing crowding, congestion of traffic,
and the unnecessary division of property. It is
with that intent and spirit that each of the under-
signed landowners purchased property in Castle
Creek Subdivision and relies upon thee protective
covenants and the general nature of the area. The
precedent that would be established by allowing a
resubdivision of a lot in a subdivision of this
nature could be disasterous to the future of sub-
divisions which contain larger than normal lots.
