HomeMy WebLinkAboutresolution.drac.003-97RESOLUTION OF THE DESIGN REVIEW APPEAL COMMITTEE APPROVING AN APPLICATION FOR THE BRIEN RESIDENCE LOCATED AT 377 SILVERLODE DRIVE, ASPEN, COLORADO Resolution No. ~, Series of 1997 WHEREAS the applicant, Alice Brien, represented by David Panico, has requested a variance from the Residential Design Standard found in Section 26.58.040 (F) (4) (c) of the Aspen Municipal Land Use Code, which states that all portions of a garage, carport or storage area parallel to the street shall be recessed behind the front facade a minimum often (10) feet, for the property located at 377 Silverlode Drive; and WHEREAS all applications for appeal from the Residential Design Standards of Section 26.58.040 must meet one of the following statements in order for the Design Review Appeal Committee or other decision making administrative body to grant an exception, namely the proposal must: a) yield greater compliance with the goals of the Aspen Area Community Plan; b) more effectively address the issue or problem a given standard or provision responds to; or c) be clearly necessary for reasons of fairness related to unusual site specific constraints; and WHEREAS the Community Development Staff in a report dated February 19, 1997, recommended approval of the applicants request; and WHEREAS a public hearing, which was legally noticed, was held at a regular meeting of the Design Review Appeal Committee on February 27, 1997, at which the Committee considered and approved the application, without conditions, citing criteria "c" above, by a vote of 3 to 1. NOW, THEREFORE, BE IT RESOLVED: That approval for waiving the garage setback standard for the single family residence at 377 Silverlode Drive be approved without conditions.
