APPROVING AN APPLICATION
FOR NON-ORTHOGONAL WINDOWS IN THE 9-12' NO WINDOW ZONE
LOCATED AT 341-351 PARK AVE. (COLAS CONDOMINIUMS),
ASPEN, COLORADO
Resolution No. 98-
WHEREAS the applicant, Colas Investments, LLC represented by Chazles Cunniffe
Architects has requested a vaziance from the Residential Design Standazds related to non-
orthogonal windows in the "no window" zone for the property located at 341 and 351
Park Ave.; and
WHEREAS all applications for appeal from the Residential Design Standards of Section
26.58.040 must meet one of the following statements in order for the Design Review
Appeal Committee or other decision making administrative body to grant an exception,
namely the proposal must:
a) yield greater compliance with the goals of the Aspen Area Community Plan;
b) more effectively address the issue or problem a given standard or provision
responds to; or
c) be clearly necessary for reasons of fairness related to unusual site specific
constraints, and
WHEREAS Julie Ann Woods, in her staff report dated July 9, 1998 and September 10,
1998, recommended denial; and
WHEREAS a public hearing, which was legally noticed, was held at a regular meeting
of the Design Review Appeal Committee on October 8, 1998, at which the Committee
considered and approved the application with one condition by a vote of 3 to 0 finding
that criteria c above would apply.
NOW, THEREFORE, BE IT RESOLVED:
That the vaziance from the Residential Design Standards related to non-orthogonal
windows in the "no window" zone for the property located at 341 and 351 Park Ave.
Aspen, Colorado, is approved with the following condition:
1. That the windows be in conformance with the drawings submitted with this
applicafion and shown as an attachment to the staff memo.
APPROVED BY THE COMMITTEE at its regular meeting on the 8th day of
October, 1998.
