APPROVING AN APPLICATION FOR VARIANCES FROM THE
RESIDENTIAL DESIGN STANDARDS RELATING TO BUILDING
ORIENTATION AND VOLUME FOR NEVIN, LOT 2, SILVERLODE
SUBDIVISION, ASPEN, COLORADO
WHEREAS, the applicant, Joe Nevin, represented by Charles Cunniffe Architects, has
requested variances from the "Residential Design Standards" for the property located at
Lot 2, Silverlode Subdivision; and
WHEREAS, all applications for appeal from the Residential Design Standards of Section
26.58.040 must meet one of the following statements in order for the Design Review
Appeal Committee or other decision making administrative body to grant an exception,
namely the proposal must:
a) yield greater compliance with the goals of the Aspen Area Community Plan;
b) more effectively address the issue or problem a given standard or provision
responds to; or
c) be cleazly necessary for reasons of fairness related to unusual site specific
constraints, and
WHEREAS, Amy Guthrie, in her staff report dated September 10, 1998, recommended
approval of the requested vaziances; and
WHEREAS, a public hearing, which was legally noticed, was held at a regular meeting
of the Design Review Appeal Committee on October 8, 1998, at which the Conunittee
considered and approved the application without conditions by a vote of 3-0.
NOW, THEREFORE, BE IT RESOLVED:
That variances have been granted from the building orientation standazd based on criteria
c and for the volume standard based on criteria b, for the building at Lot 2,, Silverlode
Subdivision, Aspen, Colorado, as presented to the Design Review Appeal Committee on
October 8, 1998, without conditions.
