HomeMy WebLinkAboutresolution.drac.012-98RESOLUTION OF THE DESIGN REVIEW APPEAL COMMITTEE GRANTING A VARIANCE OF THE GARAGE STANDARD FOR THE LIPSEY/GIRVIN DUPLEX RESIDENCE, 955 I{ING STREET, ASPEN, COLORADO. Parcel ID # 2737-074-53-001 Resolution #98 - 12 WHEREAS the applicants, William Lipsey and Linda Girvin, owners, have requested a vaziance of "Residential Design Standazd" 26.58.040(F)(4), garages, for a duplex residence located at 955 King Street, Lot #1 Astor Subdivision, City of Aspen; and, WHEREAS all applications for appeal from the Residential Design Standazds must meet one of the following criteria in order for the Design Review Appeal Committee to grant an exception, namely the proposal must: a) yield greater compliance with the goals of the Aspen Area Community Plan; b) more effectively address the issue or problem a given standard or provision responds to; or c) be cleazly necessary for reasons of fairness related to unusual site specific constraints, and WHEREAS The Planning Staff in a report dated December 3, 1998, recommended granting the vaziance, with conditions; and, WHEREAS a public hearing, which was legally noticed, was held at a regular meeting of the Design Review Appeal Committee on December 3, 1998, at which the Committee considered and approved, by a Five to Zero (5-0) vote, the variance of the garage standard, with conditions as recommended by the Community Development Department, finding the vaziance meeting criteria B --amore effective method of addressing the issue in question. NOW, THEREFORE, BE IT RESOLVED by the Design Review Appeal Committee: That the variance of standards 26.58.040(F)(4), garages, for the Lipsey/Girvin Duplex Residence, 955 King Street, is approved with the following conditions: 1. The garage shall be developed as proposed in this application. Any significant amendment to the submitted plans requiring a different or greater variance may require further review by the DRAC. All other aspects of the "Residential Design Standards," as amended, shall apply at the time of building permit application. This approval does not represent approval for any other required land use action. Before issuance of a building permit, the applicant shall record this Resolution with the Pitkin County Clerk and Recorder located in the Courthouse Plaza Building. There is a per page recordation fee. In the alternative, the applicant may pay this fee to the City Clerk who will record the resolution. 3. All material representations made by the applicant in the application and during public meetings with the Design Review Appeal Committee shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions.
