~a° m WHEREAS, the Community Development Department received an application

-gy from the Westend Partnershi owner and a hcant, for a waiver of the volume standard

~ ~ z relating the location of exterior fenestration and for the one story element standazd
~'; m requirement for the "east residence" located at 234 West Hallam Street, Lots K, L, and M,
m
~m Block 49, City and Townsite of Aspen; and,

~~ m WHEREAS all applications for appeal from the Residential Design Standards must meet
~ ~ m one of the following criteria in order for the Design Review Appeal Committee or other
~-~ ~ decision making administrative body to grant an exception, namely the proposal must:

~ a) yield greater compliance with the goals of the Aspen Area Community Plan;
-~ " b) more effectively address the issue or problem a given standazd or provision
responds to; or
c) be clearly necessary for reasons of fairness related to unusual site specific
constraints, and
WHEREAS The Planning Staff in a report dated August 5, 1999, recommended granting
a variance of the Volume (Window) standard, with conditions, and denying a variance to
the One-Story Element standazd; and,
WHEREAS a public hearing, which was legally noticed, was held at a regular meeting of
the Design Review Appeal Committee on August 5, 1999, and continued to August 12,
1999, at which the Committee considered and approved, by a three to one (3-1) vote, the
vaziance of the Volume standard, with the conditions recommended by the Community
Development Department, finding the vaziance meeting criteria B -more effective
method of addressing the standard, and approved, by a three to one (3-1) vote, the
variance of the One Story Element standazd, with the conditions recommended by the
Community Development Department, finding the variance meeting criteria B -more
effective method of addressing the standard.
NOW, THEREFORE BE IT RESOLVED by the Design Review Appeal Committee:
That the waiver of the Volume (Window) and One Story Element requirements of the
Residential Design Standazds is hereby waived for the "east residence" located at 234
West Hallam Street, with the following conditions:
1. This Volume and One Story Element variance shall be limited to the
development proposed on the "east house" as represented in the application
drawing submitted to the Community Development Department on August

10, 1999. All other aspects of the "Residential Design Standards," as

Z amended, shall apply.
~~ F 2. The applicant shall apply, and receive approval, for a change order to the

~ building permit reflecting the built and proposed amendments to the original
o
~ a m building permit.

~N = 3. The applicant shall record this Design Review Appeal Committee Resolution
~'°! m with the Pitkin County Clerk and Recorder located in the Courthouse Plaza
-~ ~ Building. There is a per page recordation fee. In the alternative, the applicant
W n may pay this fee to the City Clerk who will record the Resolution.

4. All material representations made by the applicant in the application and during

~ public meetings with the Design Review Appeal Committee shall be adhered to
