DENYING A VARIANCE OF THE SECONDARY MASS RESIDENTIAL DESIGN
STANDARD FOR A PARCEL LOCATED AT 981 KING STREET, LOT 4, ASTOR
SUBDIVISION, CITY OF ASPEN, COLORADO.

WHEREAS the applicant, John Fullerton and Jeffrey Shoaf, represented by Mazk
Hesselshwerdt, has requested a vaziance from the secondary mass Residential Design
Standard, Land Use Code Section 26.410.040, for the property located at 981 King Street,
Lot 4, Astor Subdivision; and,
WHEREAS all applications for appeal from the Residential Design Standazds of
Section 26.410.040 must meet one of the following criteria in order for the Design Review
Appeal Committee or other decision making administrative body to grant an exception,
namely the proposal must:
a) yield greater compliance with the goals of the Aspen Area Community Plan;
b) more effectively address the issue or problem a given standard or provision
responds to; or
c) be cleazly necessary for reasons of fairness related to unusual site specific
constraints, and
WHEREAS The Planning Staff, in a report dated July 13, 2000, recommended denial
of the variance for secondary mass Residential Design standazd finding that none of the
criteria for granting the vaziances are met; and,
WHEREAS a public heazing, which was legally noticed, was held at a regular
meeting of the Design Review Appeal Committee on July 13, 2000, at which the Committee
considered and approved the variance from the secondary mass standazd, by a vote of three to
two (3-2).
NOW, THEREFORE, BE IT RESOLVED by the Design Review Appeal Committee:
That the Residential Design standazd variance for secondary mass, Section 26.410.040, is
denied for a duplex at 981 King Street, Lot 4, Astor Subdivision, Aspen, Colorado.
DENIED BY THE COMMITTEE at its regular meeting on the 13`h day of July, 2000.
