The amendment will allow for converting a window to a sliding glass door, the installation oftwo (2) skylights, and interior renovations. The renovations do not increase floor area or height, and do not significantly alter the design of the unit. STAFF EVALUATION: In 2013, City Council passed Ordinance 34, series of 2013 which memorialized the existing conditions of the Aspen Alps. The intent of the PD was to eliminate non-conformities, inconsistencies of previous approvals, and prevent individual units from making alterations that were inconsistent with the design of the building as a whole. The proposed skylights on the roof do not count toward the building height measurement, and do not infringe on any dimensional limitations of the building. The conversion of the window in the bedroom to a sliding glass door is a minimal alteration to the exterior ofthe building. The increased glazing size is shielded by the deck railing which further reduces the visual impact ofthe alteration as viewed from grade. The remaining scope of work includes interior alterations that do not increase floor area. DECISION: The Community Development Director finds the Administrative Application for an Insubstantial PD Amendment as noted above to be consistent with the review criteria (Exhibit A) and thereby, APPROVES the request. An insubstantial amendment to an approved development order for a final development plan may be authorized by the Community Development Director. The following shall not be considered an insubstantial amendment: 1. The request does not change the use or character of the development. Staff Finding: The use and character will not change due to the proposed alterations. Stafffinds this criterion met. 2. The request is consistent with the conditions and representations in the project's original approval, or otherwise represents an insubstantial change. Staff Finding: The proposed alterations to the exterior of the building are minimal and do not represent a substantial change. The unit will still be consistent with previous approvals. Statffinds this criterion to be met. 3. The request does not require granting a variation from the project's allowed use(s) and does not request an increase in the allowed height or floor area. Staff Finding: In Ordinance #34, Series of 2013 City Council approved a PUD Amendment to memorialize existing conditions on site which eliminated any existing non-conformities. The height of building 200 was recorded in a Plat, Reception 4619229. Theproposed skylights on the roofdo notincrease the height of the structure. No increase in floor area is proposed. Any proposed changes to the approved dimensional requirements are limited to a technical nature, respond to a design parameter that would not have been foreseen during the Project Review approval, are within dimensional tolerances stated in the Project Review, or otherwise represents an insubstantial change. Staff Finding: The proposed skylights do not count toward the overall building height measurement. The interior alterations do not increase the floor area of the unit. DEVELOPMENT ORDER ofthe City of Aspen Community Development Department This Development Order, hereinafter "Order", is hereby issued pursuant to Section 26.304.080, "Development Orders", and Section 26.308.010, "Vested Property Rights", of the City of Aspen Municipal Code. There is no proposed change in use, or increase in height as a result of any of these modifications. Fenestration increases are depicted on elevation sheets A300, A301 while skylight additions are shown in roof plan A202. Demolition drawings Z-009 and Z-010 along with the demo calculation indicates a total demolition of less than 3%. This meets the provisions in 26.575.020.H. Mechanical equipment is compliant with section 26.575.020.F.e of the land use code regarding its overall height - nowhere greater than 6', and is recessed 15' from the leading edge of the building. The condensing unit is screened and co-located behind existing chimneys and is located with respect to the desire of the HOA and is a new precedent for all upper level condos in building 200. All units have large masonry clad chimneys which form a perfect screen for future mechanical equipment. The intent is that these locations are the least visible from the public, north-side courtyard space. Skylights are pulled back from the ridge of the roof peak making them non-contributing to overall height, which at a 2.75/12 pitch represents the total height of the unit. Section 26.575.020.F.m, however, acknowledges exceptions for skylights and light tubes as non-contributing to the overall maximum height of the building.
