SUMMARY: The subject property received a building permit for the rernodel and addition to the single-family home in October 2016. A driveway turnaround that was wider than the standard twelve (12) foot driveway width that's allowed outside a building envelope was approved as part of the building permit. The 12' standard width of a driveway is established by the Moore Family / Five Trees Design Guidelines, and the City is not a party to these guidelines. The PUD Guide, which are County adopted standards that the City now enforces, states that all development, except for the driveway and grading or p retainage needed to accommodate the driveway, must be contained within the building envelope. The portions of the driveway and turnaround that are larger than the standard twelve (12) foot driveway width, and outside the building envelope, as approved by building permit 0036.2016.ARBK, measure approximately 1828 square feet, see Exhibit B. Page 1 of 2 130 South Galena Street Aspen, CO 81611-1975 I P: 970.920.5000 l F. 970.920.5197 I cityofaspen.com The applicant is requesting a building envelope adjustment to redraw the building envelope in order to accommodate a remodel of the structure and required fire truck turnaround. The International Fire Code requires access roads, which are roads longer than 150 feet, must meet width requirement of 20 feet. The Fire Department and design team negotiated a sixteen (16) foot minimum width for the access road to the structure. A fire truck turnaround is also required at the end of the access road. In order to accommodate the development on site and the required fire truck turnaround, approximately 901 square feet of the driveway that contains a portion of the required fire truck turnaround, and exceeds the sixteen (16) foot maximum width, will fall outside the building envelope. The 1828 square feet of driveway that exists and falls outside the building envelope is being reduced to 901 square feet. The driveway fans out from the required sixteen (16) foot width of the driveway, to meet the primary area of the fire truck turnaround, only a portion of the turnaround falls outside the building envelope. STAFF EVALUATION: Since the applicant is proposing to reduce the amount of development that was legally established and falls outside an approved building envelope, staff supports the approval of the building envelope adjustment and memorializes the 901 square feet for the fire truck turnaround. This represents a reduction in the legally established non-conformity. Future development will not be allowed to increase the size or impact of the non- conformity. DECISION: In accordance with the procedures, standards, and limitations of Title 26, this Administrative Determination, acknowledges and accepts the amended driveway approved in association with the Recorded Plat, Reception # 647798. This Chapter sets out common procedures for review of all development, unless specifically stated. Generally, all proposed development shall be subject to the...six (6) step process. Applicant's Response: The / pplicant will comply with any requirements regarding lhe City's six (6) step process. 26.304.020 Pre-application conference. Prior to the formal filing of a development application...the applicant shall confer with a member o f staff of the Community Development Department to obtain information and guidance regarding the format and processing of the development application.
