This is an application for subdivis.ion exemption by Jeff Costley for
Sunny Park Apartments located at 105 Park Cil'cl e. The project is
currently under constructi on and has recently appl i ed for an occupancy
permit from the Building Departl';ent, when it was discovered that the
building permit vias issued -in elTor (see the attached m2111ofrom
Cl ayton ll:eyri ng) .
Since the project consists of only fOUl' (if) apartment units, it is
exempt from open'space dedication requirements of the subdivision
regulations.
The Planning and Zoning COll'mission on October' 21, 1975, recommended
granting the subdivision exemption Vlith tho condition that a subdivision
plat be recorded for the property.
The Pl ann.i IJ9 Offi ce feels that no si gnifi cant. public purpose Vloul d
be accompl ished by processing this project through full subdivision
procedures and recomm2ncls granting the subdivision exemption. We
sincerely regret that r,jr. Costley through no fault of his o\~n has
experienced this unexpected delay.in finishing his project.

Schiffer said that he liked the Kravatsky plan the best since 't
had the best circulation pattern. Stanford reminded them that
these were justi.nterim plans. Schiffer thought that the shut
wouldn't work unless they have more stops and make it convenie
for people on all. ends of the area to get on a bus as soon as
arrive at the parking lot. Hunt thought that if they were goi
to lock into a plan, he thought plan C was the best since no
earthmoving would be needed therefore less expensive. Otte wa
in favor of plan A. Collins.asked if the Planning Office had. ny
cost figures and Stanford noted that he didn't have any figure
but thaI: it~would probably be. based on use of city crews. Jen ins
questioned why they needed so much land for the Post Office an
Cole explained that they required 25 ~mployee stalls, plus are s
for trucks and delivery areas. Mahoney noted that the P.O. wa
paying the City a good price for the land and that the Ci~y
would be losing water rights uniess they use the G~ury Hole wa er.
Dunaway questioned whether they have the right to change the r ad
aI1dStanford thought .that since it.s a city street, all it woul
take'is some help from the Engineering Department.
Schiffer questioned members on whether anyone was prepared to ake
action at this meeting. Jenkins thought that they should sett e
the P.O. purchase question first then consider interim plans.
stanford asked if they could recommend just having the optimum
use of ..the parking on the property. Otte questioned vlhether i
they didn't state how they felt today, would they lose the opt_on
on the road being changed? Stanford thought that since the pr p-
erty came under SPA, both the City and p.o.:property would hav
to. come to them for consideration of the entire project so the
would have the option at a later time. Jenkins questioned wha
the next move would be and Stanford thought that it would be t ru
City CdUncil. Jenkins also asked who would make the decision
about the Rio Grande and Schiffer thought it would be the P &
.Schiffer suggested that they move to have Council and the plan ing
office take into consideration the maximum use of the property
and try and use. every possible use of the road.

Jenkins moved to recommend to City Council that in their negoti-
ations with the Post Office, they take into consideration' the
optimum use of the entire Rio Grande propertv, with any possible
realignment of Spring Stre.et and to consider the Kravatsky pIa,
as well as the plan recommended by. the Planning Office and fur her
moved that Council, confer with the P & Z before entering into
final plans. Otte seconded. All in favor, motion carried.

Mojo explained that this was a duplex with two lots at the ea tern
end of Hopkins. .It is an exist:i:ng duplex on platted lots and
blocks. Mojo said that the. Planning Office recommended appro al

He also noted that applicant had agreed to covenant to long t rm
leasing restrictions. The City Engineer had noted that the
building does meet the. designing elements under section 20-10 c.

Hunt moved to grant an exemption.from subdivision for the But er~
baugh/Rgers duplex under section 20-10-c of the code conditi nal
upon.the.applicant agreeing to join sidewalk, streets (curb a d
gutter) and drainage districts and that they restrict rentals to
long term only or until Council decides about thatrestrictio
in the code. Collins seconded. All in favor, motion .carried

Otte noted that he had seen buses parking on Bleeker Street tol
service theladges in that area and questiened whether they weke

Eve Henuneyer asked if anyone was using the Ria Grande propert
since she had a guest use the parking lot and it laaked pretty
bad. She suggested at least sending the city grader down to. th
