HomeMy WebLinkAboutresolution.council.117-18 RESOLUTION # 117 (Series of 2018) A RESOLUTION DECLARING THAT A STAGE TWO WATER SHORTAGE CONDITION EXISTS IN ASPEN, COLORADO, AND AUTHORIZING THE CITY MANAGER TO IMPLEMENT ADMINSTRATIVE ORDERS SETTING FORTH MANDATORY WATER USE CONTROLS TO REMAIN IN EFFECT DURING THIS CONDITION. WHEREAS, for the 2018 water year, low snowpack and early snowmelt resulted in much lower than normal water supply in the Roaring Fork Watershed this runoff season; and WHEREAS, drought conditions in Pitkin County have worsened through the summer; and WHEREAS,Pitkin County is currently experiencing "severe" and "extreme" drought conditions as determined by the U.S. Drought Monitor; and WHEREAS, the City of Aspen has established procedures to guard against potential shortages in its water supplies pursuant to Municipal Code Section 25.28.020; and WHEREAS, the City of Aspen wishes to encourage its residents and water customers to conserve available water supplies through temporary adjustment in water rates. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, Section 1: That the City Council of the City of Aspen hereby declares that a Stage Two water shortage condition exists in the City of Aspen, Colorado. It is further resolved by the City Council that the temporary water rates contained in Section 25.28.40 of the Municipal Code will be in effect for the duration of the water shortage declaration. Section 2: The Water Shortage Ordinance provides for escalating restrictions based on the Stage of drought observed. A Stage Two Water Shortage is designed to incur a 15-20% reduction in water use. Staff recommends the following mandatory restrictions be implemented immediately: 1. Prohibition from watering lawns more than 3 days per week; 2. Prohibition from watering lawns more than 30 minutes per sprinkler zone per watering day; 3. Prohibition from watering native areas more than 2 days per week; 4. Prohibition of lawn watering between 10:00 am and 6:00 pm, and at any time while it is raining; 5. Prohibition of watering lawns, landscaping, or amenity resulting in ponding or the flowing of water onto paved surfaces; 6. Prohibition of washing of sidewalks, driveways, patios, tennis courts, parking areas, or other similar surfaces with a hose, pressure washer, or power washer 7. Water Users required to repair leaking irrigation systems. Exemptions to the above restrictions are available for the following conditions: 1. Trees planted within the last 2 years, or any vulnerable trees exhibiting drought stress; 2. New landscapes installed within the last 2 years; 3. Watering as-needed to maintain health of flower beds and vegetable gardens; 4. Evapo-transpiration based irrigation systems that are regularly monitored and maintained, and adjusted to provide 80% of Et are exempt from the day and time per zone restrictions. Linda Manning, City Cle k Administrative Order — Staff Response to Adoption of Resolution #75 (Series of 2018) Date Effective: 5/22/2018 SECTION 1. PURPOSE This Administrative Order provides information and guidance on the actions to be taken by the City of Aspen staff in response to City Council's adoption of Resolution#75 (Series of 2018) declaring that a Stage One Water Shortage condition exists in Aspen, Colorado. Specifically,this Order directs that certain actions be taken for a Stage One Water Shortage as described in Section 25.28.020 and adoption of temporary surcharges as described in Section 25.28.040. SECTION 2. POLICY In furthering its water management programs, the City of Aspen provides a three-staged water shortage policy to be implemented during times that the City Council finds that the City is facing a water shortage. After such a finding, the City Council will declare, by resolution, that a water shortage exists and identify the appropriate water shortage stage. By adopting this resolution, Council directs the City Manager to implement actions necessary to meet the goals for the relevant stage. SECTION 3. WATER SHORTAGE ACTIVATION At its May 14, 2018 Regular Council Meeting, City Council adopted Resolution #75 (Series of 2018)which declared that the City is facing Stage One Water Shortage conditions. SECTION 4. ACTIONS The City Manager directs that the following actions be taken to comply with Stage One Water Shortage Restrictions: 1) Public facilities, including parks and golf courses, will lead by example and are directed to implement water use restrictions that will result in an increased efficient use of the water supply. 2) Public education materials shall be provided to the community to encourage efficient use of the available water supply. 3) Water surcharges shall be added to upper tiers of the billing structure to encourage a reduction in water use.
