MEMORANDUM

SUBJECT: Ute Avenue Condominiums
DATE: October 23, 1973
At its meeting on October 16, 1973 the Planning and Zoning
Commission denied application for the Ute Avenue Condominiums,
851 Ute Avenue, under Ordinance 19 review based on the follow-
ing considerations:
New Tourist uses are not an allowed use in
Mixed Residential District.
Because the development was determined an
incorrect use, it was not evaluated in
terms of the relevant land use policies:
transportation, public facilities, air
quality and runoff.

Gillis made a motion to amend the original motion to
read that the COTI@ission would review the project under
Ordinance #19, seconded by Johnson. All in favor, moti n
carried.
Ms. Baer stated that this proposal was an addition of
a garage and a studio, and would not increase the densi y.
Gillis made a motion to approve the proposal, seconded y
Johnson. All in favor, motion carried.
Architect Larry Yaw was present and explained that this
was a proposal to add a second floor above the Tom Mix
Flying School for retail purposes. Stated that Tom Mix
has agreed to buy two parking spaces and construct roof
drainage according tO'specifications of the City Engine r-
ing Department. Would be an additional 900 plus square
feet.
Yaw further pointed out that this addition would not in-
terfere with the view.
Ms. BAer submitted a diagram of the proposed addition, and
stated that the Historic Preservation Committee had re-
viewed the proposal and had approved it,
Johnson made a motion to approve the addition, seconde by
Gillis. All in favor, motion carried.
Ms. Baer stated that the Historic Preservation Committ
had approved the structure, but would like to review t
color and the building material.
Ms. Baer briefly explained the diagram of the Commissi
and explained that the City Council must grant approva
to the covered walk.
Gillis made a motion to approve the proposal on the co -
dition that the drainage be satisfactory for the cover
roof, seconded by Jenkins. Motion included that the
requirement for parking space purchase be determined. All
in favor, motion carried. .
Ms. Baer explained that this was a review of two units
second phase of a new six unit condominium.
Johnson made a motion to recommend for approval on con
dition that the applicant dedicate a ski easement alon
the southerly boundary of the property, seconded by Je -
kins. All in favor, motion carried.
Ms. Baer pointed out that this was a project on Ute Av.
at the Aspen Alps Road, a request for new 14 unit con-
dominium. Further pointed out that the zoning in this
area was mixed residential.
Ms. Baer further pointed out that the Ordinance #19 Re
view Committee had recommended denial of the project f r
the fOllowing reason - use appears to be incompatable
with the land use plan and mass of the proposed struel; re
too great.

Bruce Kistler, attorney representing the developer, was
present and requested the COlnmission clarify the grounds
for denial.
Chairman Adams stated that the use doesn't conform with
the Land Use Hap.
Hs. Baer stated that the Planning Office felt it was a
tourist use in a mixed residential area.
Kistler asked the Commission if they would classify mixed-
residential as a land use which would prohibit second ho es.
Chairman Adams stated that they were applying the defin"tion
of permanent resident housing.
Hs. Baer expressed the Council's concern for permanent
housing.
Chairman Adams stated that the second home takes up spa e
in an area which he doesn't want to see devoted to that
use.
Bartel stated that Ordinance #19 requires that disappro
be in writing and sent by the Building Inspector.
Johnson made a motion that the Commission recommend the
Planning Office write a Resolution giving the reasons
for denial of the project and that this Resolution be
returned to the Commission for approval. Hotion second d
by Jenkins. All in favor, motion carried.

Hs. Baer stated that this was a request for one additio al
unit on the second floor of an existing lodge. Pointed
out that this is mixed residential.
Chairman Adams stated that he objected to any lodge ex-
pansion in that area. Felt it would be inconsistent to
not allow Stein Gantzel to build on to his lodge and al
low this expansion.
Hr. Eyemere's brother was present and st:ated that this
addition had been approved by the Board of Adjustment a d
the Advisory Board aad recommended approval.
Chairman Adams pointed out that this was fairly far-re-
moved from the core area and would create a transporta-
tion problem.
Gillis stated that sidewalks need to be considered for
that area.
Gillis made a motion to deny the project. Hotion faile
for lack of a second.
Johnson made a motion to approve the project. Hotion
failed for lack of a second.
It was pointed out that Hr. Eymere had initiated this b'-
fore Ordinance jf19, and that the Board of Adjustment ha
referred this to City Council, and that it had had ap-
proval.

Jenkins made a motion to approve the project on the
following conditions: (1) owners pave the alley;
(2) negotiate an acceptable parking plan subject to
City Engineer's approval; (3) supply drainage plan
to be approved by the City Engineer; (4) supply a
landscaping plan that also meets with the approval of
the City Engineer; (5) write into sales contract a
covenant restricting rental to not less than six
months. Motion seconded by Lewis. All in favor,
motion carried.
Mr. Murphrey, developer for the project, was present.
Chairman Adams stated that he would like to see the
revie,v under Ordinance #19 go to the newly formed
Advisory Board.
Ms. Baer pointed out that the Planning Office had
critical concern with the drainage. POinted out that
the ditch presently feeds the Glory Hole Park.
Ms. Baer further pointed out that the Planning Office
was requesting a setback of 20 feet.
Murphrey stated that they already were set back l8
feet, and there would be no problem with a setback of
2 additional feet.
Attorney Bruce Kistler was present, representing Mr.
Murphrey. Felt the rerouting could be approved by
the City Engineer.
Discussion followed on the preservation of trees on
the project. Murphrey stated that constr~otion would
cause minimal removal of trees, and stated that trees
would be added to the site.
Murphrey stated that on their final plan, would sub-
mit a detailed landscape plan.
Johnson made a motion to approve the preliminary pla
for the Ute Avenue Condominiums with the following
conditions: (1) dedicate 10' of south side of the
property for future street widening; (2) agree to
affiliate with future street and drainage improvemen
districts; (3) require an agreeable ditch maintenanc
and lease arrangement be made with City Engineer;
(4) City Engineer approve the drainage plan.
Motion was sec,onded by Geri Vagneur. All in favor,
motion carried.

on South MOnarch str:eet, just below the Mountain Que n
Development. Stated that it was a 6-unit project, 0
which four units have already been const:ructed.

Chairman Adams opened the public hearing for Ute Aven e
Condominiums Subdivision, Preliminary Plat.
Vidal excused himself from the table due to conflict
of interest with adjacent property.
Ms. Baer stated that this project consisted of 14 uni s
on 23,900 square feet.

Mr. Murphrey, the developer for the project, stated
that the units would range from $75,000- $120,000

there would be very little if any outside rental.
Murphrey explained that t.hey would save most of the
trees. Site was inspected by a landscaper who stated
. that there would be no problem with the tr.ees, 'and'
as little root damage as possible.
Murphrey pointed out that there would beoniy 2 curb
cuts of 12 feet. Stated that there were no problems
with visibility on the private road. The buildings
would be 3-stories with a rise going from 90' to 100'.
Pointed out that the average occupancy would be about
27%.

Jenkins stated that he did not like the idea of ab-
sentee owners. Stated that this does not produce
the needed revenue for the City. There would be no
tourist income or permanent housing.
Murphrey stated that the buildings only cover 27% of
the lot area, and provide a high tax base. Stated
that reasearch in this area showed that this type
of occupant will spend an average of $200/day. Stated
that approximately 70% of taxes are paid by condominiu
owners and tourists.

UTE AVENUE CONDOMINIUMS

Storm Drainage
Building storm water shall be collected by roof drains with interior
storm leaders. The storm leaders will be collected under floor in a
common storm drain and run to an exterior dry-well. Dry-well shall
be located between Building A and driveway and shall have an overflow
to drainage ditch. Dry-well shall be constructed of perforated
concrete rings with gravel bottom and backfill. Top to be cast-iron
manhole ring and cover. Building A to have 6" drain and Building B
to have 5" drain. Parking lot to be sloped from buildings to center
then out toward Ute Ave. This storm drainage shall be picked up in
a catch basin and dry-well with overflow similar to above. Above
system to be designed for a 4-inch per hour rainfall.
Re-routed Ditch
The existing ditch is to be re-routed as shown on the Preliminary
Plan. No permanent structures are to be built withint 5-feet of
either side of the ditch. Culverts as shown are to be constructed
and installed in accordance with City of Aspen engineering requirements
and approval.

Legal Notice
Notice is hereby given that the Aspen Planning and Zoning COImllission
shall hold a public hearing on September 18, 1973, 5:00 p.m., City
Council Chambers to consider the Ute Avenue Condominium subdivision
preliminary plat located specifically as follows: Lots 11, 12, 13,
Ute Addition and part of Lot 38, Section 18, Township 10 South, Range
84 West of the 6th PM.
Plat is on file in the office of the City/County Planner, City Hall,

Submitted herewith is a Preliminary Plat constituting a
joint filing of a preliminary plat under the Subdivision Reg-
ulations and a Conceptual Presentation under Ordinance 19.
With respect to the Conceptual Presentation under Ordinance
.19, the following additional information is supplied:
1. Site Finders, Inc., proposes to develop 14 residential
luxury condominium units for sale.
2. The units are expected to be offered at prices up to
$125,000.00.
3. As such, it is also expected that such will be used
primarily by their respective owners, and will not constitute
tourist housing. The sales price is expected to limit the units
to persons who will not evidence any significant interest in making
their respective properties available to the tourist pUblic for
rental:
4. One parking space is provided for each unit. Such is
considered sufficient for the following reasons:
a) Owners are expected to be residents of cities other

within walking distance of both ski lift, downtown core area, and

Mr. Woods would like to add an additional 3,OOOs.f. to this building
complex. This additional floor area to be above the existing Drug Store,
two floors, on"? of office space and the top floor an apartment for the
owner. Also, this proposed development would include the construction
of a new enclosed fire exit to serve the existing restaurant at the
co~rtyard level, the existing Drug Store, and the new upper floors. A
ramp with stairs would connect the new floors with the existing upper
floor. This would be the second means of "gress from the new floors,
also providing a second exit from the existing upper floor. All along the
Galena Street side of the existing Drug Store is propos"d a covered walk.
From a dGsign standpoint we will maintain a consistancy with the existing
Drug Store anrl a Victorean character to compliment the surrounding build-
ings.
The covered walk will continue the use of stained glass and columns along
Galena Street.
Submitted as a part of this statc>ment are sketches, etc. of the proposed
project for your revie". We would like to make an oral presentation to
further describe the objectives of this proposal to the Planning & Zoning
Commision.

Ms. Baer stated this would be a discussion only,
formal submission at the next meeting. Applicant
stated this project is located on the northwest
corner of Hopkins and Original, 10-unit condo-
minium. Basi.c concept wi.ll be a market for local
peopl-e because of its close proximity.to the down-
town. Price range and quality will not be low cos
but for middle income families. Ms. Baer pointed
out the applicant has agreed to a 16' reservation
of land for future acquisition by the State High-
way Depar~ent for right-of-way. Also this pro-
ject being submitted as a stream margin request.
Applicant is willing to burm the back portion of t
propoerty, project is about 20' above the stream.

Applicant.stated they will maintain 50% of the are
as open, units are 1440 square feet with lots of
storage facilities and their will be no management
facility with the building.
Ms. Baer stated the Planning office. is recommending
4% cash dedication.

as information only. Have requested a more suitabl

Attorney Bruce Kistler stated they are requesting
indication from the P & Z relating to density so th
two submissions do not have to be made under the
building permit review ordinance now being consider
by the City. Property located adjacent to the Aspe
Alps. Project consists of 14 units with lower unit
of 900 to 1000 square feet and upper units of 1000
to 1800 square feet. Will be utilizing the exist in
landscaping that now exists.
Requesting at this time consideration of an exempti n
of Ordinance 4tl9 relating to density in this area
so that the project does not have to be scrapped at
a later date. Total square footage of the project
is 23,975 square feet. Structures will require no
variances, utilities are available and ditch on the
east side of the property can be easily relocated.
Ms. Baer stated it is vital that this ditch be look d
at by an expert and it ties in with drainage off th
mountain and durant mine.
Commission stated they could not give an answer at
this time, as density consideration for this area
has not been definitely ascertained at this time.
