RE: Villa Condominium Association Proposed Fence
Dear Ms. Murry:
I understand that the Villas of Aspen is proposing to install a screen fence along its
property line abutting 7th and Bleeker Streets, In order to avoid any unnecessary, design
expense on the part of the Association, I have asked staff to review code requirements
and prior approvals which may impact the installation of a fence at that location:
Please see the attached memorandum from our staff planner, Dave Michaelson, Mr.
Michaelson concludes that there would be significant height restrictions within thirty
(30') feet of the edge of the paved roadway, and that removal ofplantings specified in the
Villas Planned Unit Development approval would requii-ean amendment to that approval,
Given these considerations, the Association may want to hold any fence installation
design at least thirty feet back from the roadway and avoid any of the required plantings,
I would also appreciate it if the stakes placed on City property for the' survey activity
could be removed at your earliest convenience, Please let me know if! may provide any
further information or assistance, '

VILLAS PUD APPROVAL AND FENCING RESTRICTIONS (Hallam and 7th)
As we have discussed, I have reviewed all of the available files on the Villas PUD approval and
subsequent amendments to the original 1973 approval, Based on my review, no precise requirement or
standards for fencing was included in the approval or amendments, above and beyond requirements found
in the underlying zouing or other applicable municipal codes, A landscape plan was submitted, but did
not reference non-vegetative elements, I have attached a copy of the approved landscaping plan, and
have highlighted the new vegetation that was included within the approval, and the portion of the trail
alignment adjacent to State Highway 82. Minutes clearly indicate that the approvals were predicated on
satisfactory implementation of the landscape plan. Based on the record, and the prominence of the
property as the western gateway to the City, any removal of vegetation associated with the PUD approval
would require some fonn of PUD amendment. In addition, the Parks Department would require a
mitigation plan to address the removal of trees greater than 6" in caliper, As shown on the landscaping
plan, the location of the trail and landscaping constrain the placement of a fence along the SH 82 conidor,
Although no specific language regarding fencing was included within the PUD, there are significant
requirements within the Aspen Municipal Code, specifically amendments approved by Ordinance 22,
series of 1995 (applicable section attached), Current code allows for fencing in every zone district
provided that no fence shall exceed six (6) feet above natural grade, Fences visible from the public right-
of-way must be constructed of wood, stone, wrought iron or masonry. Plans showing the proposed
construction, material, location and height must be presented to the building inspector before a building
pennit for a fence is issued,
There are several compliance issues with fencing requirements based on Ordinance 22, For example, the
six (6) foot limitation applies to natural grade. The property has undergone significant topographic
modifications in the past, and the existing benn may be nearly three (3) feet above natural undisturbed
grade, In addition, fencing for comer lots are restricted to 42" above street grade, and the fence must be
setback least thirty (30) feet from the edge of the roadway, The following graphic cross-section
summarizes the code requirements, In addition, the fencing cannot "obstruct" traffic vision, which would
be detennined at the time the building pennit was submitted,

section 2: section J-~O~ of Chapter 24 of the Aspen Municipal Code
a new definition for "building envelope" is hereby added, which new
text shall read as follows:
Building envelope is that area on a lot which encompasses all
development including but not limited to excavation, fill,
grading, storage, demolition, ,structures, building heights,
decks, roof overhangs, porches, patios and terraces, pools,
any areas of disturbance, ,access ways and parking. Approved
plantings of landseape materials on natural grade and approved
walkways and driveways may occur outside of a building
envelope. Other..ise, all areas outside of a building envelope
shall remain in oristine and untouched condition unless
approved by the community Development Director.
For purposes of site specific development plans, building
envelopes may be established to restrict development to
protect slopes, important vegetation, water courses, privacy
or other considerations. Building envelopes shall be
described on recorded plats, site specific development plans,
ordinances, resolutions, and building permit site plans.
section 3: section 3-~01 of Chapter 24 of the Aspen Municipal Code
definition of "fence" is hereby amended, which new text shall read
as follows:
'Fence means a structure, including berms, which serves as a
barrier intended to prevent escape or intrusion, to mark a

Dear Leon:
In connection with the pending~ annexation to the
City of Aspen, The Villa of Aspen, Inc. has determined that
it would be impractical to attempt to comply with the latest
condition imposed by the City Council requiring that the
Villa landscaping plan be guaranteed by means of a performance
bond or certificate of deposit. However, the Villa's land-
scaping agreement is already specifically enforceable by the
City, and the Villa is willing to agree in writing that in
the event the City finds it necessary to enforce the agree-
ment through the courts, the Villa will reimburse the City
for its costs and reasonable attorney's fees if such enforce-
ment action is successful.
This would appear to be a satisfactory alternative to the
bond proposal, since it insures that the City will not incur
any out-of-pocket expenses if it has a legitimate case, but I
would appreciate your thoughts on the matter before the August
14 City Council meeting at which the idea will be considered.
While I've already dis~ussed the matter with Herb Bartel and
Albie Kern, I don't know if they've reached any conclusions as
to the adequacy of this counterproposal.
