Weaver Subdivision Insubstantial Plat Amendment
SUMMARY: Planning staff recommends approval of an
amendment to the 1987 Amended Weaver Subdivision to move the
property line between Lots 1 and 2 to the east by 30 feet. Staff
recommends these approvals with conditions.
APPLICANT: Fredna and Arthur Stromberg, represented by Tom Todd
LOCATION: 442 W. Bleeker (AKA pioneer Park) at. the northeast
corner of Fourth Street and Bleeker Street
ZONING: R-6
APPLICANT'S REQUEST: The applicant seeks insubstantial plat
amendment to move the lot line between the two lots that were
created in a 1987 Lot Split. This action is being pursued so that
the Aspen Historic Trust, Inc. may purchase the reduced Lot 2 for
a permanent passive public park. Please refer to Attachment "A"
for the proposed plat.

in the alley and rights-of-way must be executed and recorded prior
to Engineering sign-off of the amended plat.
2) This plat shall be titled "Second Amended Plat of the Weaver
Subdivision".
3) Note the book and page of previously recorded plats to include
reference to the pioneer Park Condominium Plat (1982).
4) The Surveyor's Certificate shall include the statement
regarding "all easements of record as indicated on title policy
# dated have been shown hereon" and shall state that
the survey closes to 1:10,000.
5) Provide plat signature blocks with current signatures.

to City Planning Director.
7) The 10'x7.0' utility easement shall remain.
8) The aerial power line in the alley has been undergrounded. The
Plat shall reflect this change.

10) Design for any work done in the public right-of-way shall be
approved by the City Engineer and must have a permit from the City
streets Department.
STAFF COMMENTS: Pursuant to section 7-1006 A. the Planning
Director may approve an amendment to an approved plat for "any
minor change to a plat which the planning director finds has no
effect on the conditions and representations limiting the approved
plat." During recent discussions, Planning staff has concluded
that the relocation of the lot line between Lots 1 and 2 does not
change the conditions or representations of the (first) Amended
Weaver Subdivision Plat. The resulting Lot 2 will become permanent
open space upon conveyance to the Aspen Historic Trust, Inc. The
increased size of Lot 1 will not result in increased development
rights. Lot 1 contains three structures with an accumulated FAR
of 5,053 s.f. (per Zoning Officer Bill Drueding's 12/4/92 memo,
Attachment "B"). with the increase of 3,000 s.f., Lot 1 will be
20, 603 s.f., with an allowable FAR of 4,350. Thus, with added lot
area, the parcel will remain non-conforming due to FAR. Lot 2 will
be reduced to 9,000 s.f.
The application states that the existing FAR on Lot 1 is 4,194 s.f.
per the County Assessor's records. Staff must rely on the
evaluation of the City's Zoning Officer to determine FAR per the
Land Use Code. No additional d~nsity will result from the plat
amendment. .
STAFF RECOMMENDATION: Staff recommends approval of the Second
Amendment to the Weaver Subdivision Plat as an insubstantial plat
amendment with the following conditions:

Pursuant to the meeting which you, Arthur H. Stromberg and I
had on Tuesday, October 13, 1992, I am submitting on behalf of
our clients, Arthur H. and Fredna C. Stromberg, the Land Use
Application Form and its accompanying baCk-Up information.
Pursuant to section 7-1006(A) of the City of Aspen Municipal Code
(the "Code"), our clients are requesting an insubstantial plat
amendment to the two-lot Amended Weaver Subdivision (hereinafter
sometimes referred to as the "Property").
As we discussed, the Strombergs want to modify the boundary
line separating Lots 1 and 2 of the Amended Weaver Subdivision.
You expect this application to be reviewed by Planning and Zoning
staff without the need for public hearings or City Council input.
Set forth below are the responses to Attachments 2 and 3 of the
Land Use Application Form.
PART I: RESPONSES TO ATTACHMENT NO.2. MINIMUM SUBMISSION

2. . Description of the Propertv. The street address of the
Property is 442 West Bleeker street, Aspen, Colorado 81611. The
legal description of the Property is Lot 1 and Lot 2, Amended
Weaver Subdivision. The Plat Map for the Amended Weaver
Subdivision is recorded in Book 20 at Page 1. A copy of the Plat
Map is attached hereto and labeled as Exhibit "B."
3. Ownership and Encumbrance Report. Attached hereto as
Exhibit "C" is Pitkin County Title, Inc.'s ownership and
encumbrance report listing the names of the owners of the
Property and all mortgages, judgments, liens, easements,
contracts and agreements affecting title to the Property. It
demonstrates that our clients are the sole owners of. the Property
and have the right to submit this Land Use Application.

5. Development Review Standards. The proposed boundary
line adjustment complies with the substantive development review
standards relevant to this application due to the following
facts:
Lot 1 of the Amended Weaver Subdivision is improved with a
brick two-story victorian structure and attached carriage house.
Lot 2 of the Amended Weaver Subdivision is unimproved with the
exception of a gazebo. The new configuration of the Property
would increase the size of Lot 1 from 17,602.50 square feet to
20,602.50 square feet and decrease the size of Lot 2 from 12,000
square feet to 9,000 square feet. The applicants are seeking
this reconfiguration because they propose to sell Lot 2, as
reconfigured, to the Aspen Historic Trust, Inc. a Colorado non-
profit corporation. The Aspen Historic Trust, Inc. will develop
the reconfigured Lot 2 as a passive public park and convey it to
the City of Aspen. Attached hereto as Exhibit "E" is a copy of
the Vacant Land/Farm and Ranch Contract for Sale of Real Estate
covering the proposed sale with the Aspen Historic Trust, Inc.
According to section 5-201(D) of the Code, the maximum
external floor area for the 17,602.5 square foot Lot 1 is 4,150.1
square feet. According to the pitkin County Assessor's records,
the historic home (2,922 square feet) and carriage house (1,272
square feet) located on Lot 1 total 4,194 square feet. Lot 1 is
thus non-conforming with respect to maximum external floor area
calculations. By increasing the size of Lot 1 by 3,000
additional square feet, the maximum external floor area for Lot 1

will be 4,300.1 square feet. By approving this Land Use
Application, the non-conforming external floor area of Lot 1 will
thus be eliminated.
By decreasing the size of Lot 2, the maximum external floor
area ratio for any residence constructed. on Lot 2 will be reduced
from 3,840 square feet to 3,660 square feet. In the event Aspen
Historic Trust, Inc. satisfies its obligations to perform under
the aforementioned contract, then the entire question of maximum
land use densities on Lot 2 will be moot because Lot 2 will be
permanently deed restricted for passive public park purposes.
PART II: RESPONSES TO ATTACHMENT NO.3. SPECIFIC SUBMISSION
CONTENTS.
1. Written Description of Existino Conditions on the
Propertv which are Requested to be Altered. Applicants are
requesting that the boundary line between Lot 1 and Lot 2 of the
Amended Weaver Subdivision be moved east approximately 30 feet.
This will result in the increase of the size of Lot 1 from
17,602.50 square feet to 20,602.50 square feet. Lot 2 will be
reduced in size from 12,000 square feet to 9,000 square feet.
The Amended Weaver Subdivision Plat Map also shows that an
enclosed gazebo located on Lot 2 will be moved from Lot 2 to Lot
1. Applicants request that the enclosed gazebo remain on Lot 2.

as Exhibit "B" is a copy of the Amended Weaver Subdivision Plat
Map recorded in Book 20 at Page 1 which shows in red the
approximate location of the proposed relocated boundary line
between Lot 1 and Lot 2.
3. Listinq of all Previous Development Approvals
Granted to the Propertvwith the Approximate Dates of said
Approvals. The history of development approvals affecting the
Property is as follows:
(a) Prior to 1982, the Property consisted of
all of Lots K, L, M, N, 0, P, Q, Rand S and all of
Lots A, Band C except the north 70 feet of Lots A, B
and C and also except the east 39 inches of Lot C,
Block 36, Original Aspen Townsite, Aspen, Colorado.
(b) In January of 1982, the Property was
subdivided into two lots and was thereafter known as
Lots 1 and 2, the Weaver Subdivision. The Weaver
Subdivision Exemption Map is recorded in Plat Book 12

Recorder's records. In connaction therewith, Lot 1 of
the Weaver Subdivision was condominiumized into a 2
unit condominium project known and referred to as the
pioneer Park Condominium. The Pioneer Park Condominium
Map is recorded in Plat Book 12 at Page 57 of the
pitkin County, Colorado Clerk and Recorder's records.
The original Weaver Subdivision Exemption Map and the
pioneer Park Condominium Map are included with the
title documents under Exhibit "F."
(c) In August of 1987, the owner of the
property obtained an insubstantial amendment to the
Weaver Subdivision, which resulted in the enlargement
of Lot 2 from 6,000 square feet, to 12,000 square faet
in area, with a corresponding reduction in the size of
Lot 1 from approximately 23,602.50 square feet to
17,602.50 square feet. As mentioned above, the Amended
Weaver Subdivision Exemption Map is attached hereto and
labeled as Exhibit "B."
4. Copies of anv recorded documents which affect the
proposed development, includinq but not limited to recorded
Plats, Aqreements. and Deed Restrictions. Attached hereto and
labeled as Exhibit "F" is a package of all of the documents
affecting title to the proposed development. No changes are
proposed to these recorded documents except for the text of the
Amended Weaver Subdivision Exemption Plat. The "redlined" text
of the Amended Weaver Subdivision Exemption Plat shewing proposed
changes is included with Exhibit "F."

Addendum to that ~~tain Vacant band Contract to Buy and Sell
Real Estate dated If ~ q~ , 1992, between Aspen Historic
Trust, Inc., and/or AS's gns, Purchaser, and Arthur H. and Fredna C.
Stromberg, Sellers, for that property known as t~e easterly 75% or
the easterly three city townsite lots within Lot 2, "eaver
Subdivision, .as amend",'.'. City and Townsite of Aspen, also known as
400 West Bleeker StreeL, Aspen, Colnrado.
I. The Sellers are prospective purchase:!:'s of Lot lane
Lot 2 of the Weaver Subdivision under a back-~~ cont:!:'act with the
Weavers, which back-up contract is conditioned upon the te=ination
of the contract between the Weavers and Bruce Beroer. The
successful acquisition of Lot I and Lot 2 Weaver subdi;ision, by
Sellers herein, shall be a condition precedent to Sellers'
obligations hereunder.
2. In the event the Berger contract is te=inated and
condition precedent is satisfied to the Sellers' back-up contract
to acquire Weaver Lot I and Lot 2, Sellers shall seek approval from
the City of Aspen to vacate the Weaver Subc.iv:'_sicn or seek a
subdivision exemption or lot Line adjustment o:!:' Qt:,e:!:' app:!:'ovals to
authorize conveyance .to Purchaser of the easte:!:'ly three city
townsite lots contained within Lot 2 of the Weaver Subdivision.
3. Sellers warrant that they are
withholding as defined under internal Revenue
(Foreign Person Transferor) and will execute an

9. This Agreement is further conditioned upon the
raising of sufficient funds by Purchaser. on or ~e=ore clcs5.~g to
purchase the said property for a park and open s?ace to co::r?lement
the historic buildings on the adjacent Lot 1, Weaver Subdivision
Amended. Purchaser will keep Sellers advised of the progress of
such funding provided, however, in the event Purchaser is unable to

10. The property shall be conveyed subject to the
restriction of use as a limited use public park and open space

existing gazebo building. Said property will ~e conveyed to the
City of Aspen following the closing Subject to ~he afore~entioned
restriction.
II. . Purchaser .will apply for a waiver 0:: ?ayment of RE'::'::
and HRETT taxes from the City of Aspen as ?rc.,-ic.ed for i~ the
Ordinances of the City of Aspen of record. In the event th~
Purchaser is unable to obtain a waiver of those taxes, Purchaser
shall be solely responsible for payment of those taxes.
12. Purchaser acknowledges that the gazebo currently
located on Lot 2 is to be moved to Lot _ Durs\:.a~t to the
subdivision agreement. Purchaser desires to obtain t5.tle to the
gazebo; and, subject to this paragraph, Sellers desire to sell to
Purchaser as part of this contract that gazebo. Vpon Sellers'
acquisition of the property, Purchaser shall COIT~e~ce efforts, at
its sole cost and expense, to obtain an ~~en~"ent to the
subdivision agreement of the Amended Weaver Subdi7ision to indicate
that the gazebo may remain upon Lot 2. Sellers will cooperate with
Purchaser by signing all necessary documents and/or applications.
.In the event that Purchaser fails to obtain such approval on or
before the date of Closing, Sellers shall have 120 days fro~ date
of Closing to remove the gazebo from Lot 2 and move 5.t to ~ot 1.
