MINUTES OF AUGUST 6.2008
Chairperson, Terry Butler called the meeting to order at 8:30 a.m.
Commissioners in attendance: Roger Haneman, Don Sheeley, Bill
Dinsmoor, Mark Goodman and John Starr. Fred Ayarza was excused.
Staff present: Kathy Strickland, Chief Deputy Clerk
Engineering - Tricia Aragon, Department Head
Trisha Nelson, Assistant Engineer
Aaron Reed, Construction Management
Restaurant encroachment issue.
Kathy said the mall ]eases are reviewed by the Commercial Core & Lodging
Commission. Anything outside the mall is handled through the Engineering
Department.
John asked how often Engineering gets complaints from the public. Trisha
said basically our complaints are from construction. We have had three or
four regarding the same restaurant.
Trish Aragon stated that all rights-of--ways are handled through Engineering.
Bill and John said the issue is who should handle dining in the right-of--way.
Terry said our malls seven years ago where thriving and all of a sudden the
malls where dead. We re-vitalized the malls with flowers etc. and that
became very successful. As a result some of the other restaurants asked to
go out in front of their restaurants.
Kathy said those request where brought to the City Clerk and jointly
reviewed with the Engineering department.
Trish said Engineering is mostly concerned with the safety of pedestrians.
Kathy said existing restaurants with liquor licenses are allowed to expand
and apply for a one time modification fee through the Colo. Department of
Revenue, liquor enforcement division. They then go to engineering with
their diagrams and apply for an encroachment.

Bill said consistency of enforcement and how we do this should needs to be
addressed.
Don suggested one entity should be doing the outside seating.
Andrew Kole said CCLC asked restaurants to think out of the box as to how
to make the town more vibrant.
Trisha said restaurants are not our purview. With restaurants we are looking
at it in a more technical manner.
Bill said if CCLC had a complaint the police would have to do a citation.
Terry Butler said Engineering is in overload with 19 projects. Then there
are all the others projects coming onboard.
Terry said cclc deals with the downtown restaurants. A citizen board is a
little softer than "city hall". If we are already doing the malls it wouldn't be
that hard to take over restaurant encrochments.
Bill asked what the dollar expense or manpower is with the Engineering
Department.
Aaron Reed said the $343. for an encroachment offsets the time spent
enforcing.
Don made the motion that CCLC continue reviewing mall leases and review
outside seating off the mall, second by Mark.
Discussion:
John said he feels the mall lease holders should also apply for an
encroachment license. John said the CCLC would be the first responders.
Roger asked what is required with the Engineering department. Trish said
Engineering is aware of what is going on in the right-of--way.
Trish said the encroachment fee goes into the general fund. Kathy said the
mall lease fees goes into the Parks fund for repair of the fountain, bricks,
iron fences and XMAS lights.

Roger commented if we are taking over enforcement you would make a
complaint to the Engineering or Police Department and we try to deal with
the owners or managers acid if that doesn't work then we get forceful.
Amended motion: The motion is subject to final review by the City Manager
or the appropriate review boards.
Motion carried 5-1. Bill opposed.
CCLC needs to do a walk through with the engineers and go over all the
appropriate guidelines.
Comments: John asked when buildings go through the process is there any
mechanism to require a particular business to go with a particular trash
company. Engineering can't require businesses to take on trash for several
businesses. John said it is a community benefit if a compactor could handle
the entire alley.
Aaron said you can't require businesses to use a certain hauler.
Trisha said we are looking at construction waste. The Brand bldg. and the
Elks bldg. have an encroachment for their compactor. We try to help
businesses etc. if they need an encroachment for a compactor but we do not
require it.
John said we need to look at all the developments in the core as a whole.
Trish said we are willing to give businesses an encroachment for a
compactor.
Terry said CCLC is interested in the future to meet with engineering
regarding compactors when there is development and require a development
to provide a compactor for the entire alley.
Don nominated Mark Goodman as Vice-chair. All in favor, motion carried.
Market discussion:
The board discussed vendors and their display of appropriate merchandise
and conduct. Roger said flouting the authority needs addressed. We need to
set a precedent. Kathy said selling and displaying outside the tent is
prohibited.

John said next year we have to tighten the application and make sure
everything is very clear regarding our regulations, We also have first
amendment issues.
Kathy said she will talk to the appropriate vendors and see if issues can be
worked out.
