A RESOLUTION OF THE CITY OF ASPEN CITY COUNCIL APPROVING THE.
TEMPORARY USE OF TENT STRUCTURES AT 330 E. MAIN STREET, LEGALLY
DESCRIBED AS LOTS A - I AND LOTS O — S, AND THE EASTERLY 20 FEET OF
LOT N AND THE EASTERLY 170 FEET OF THE VACATED ALLEY ALL IN BLOCK
74, CITY AND TOWNSITE OF ASPEN, PITKIN COUNTY, COLORADO.

WHEREAS, the Community Development Department received an application from
Sunny Vann of Vann Associates, LLC, on behalf of Iconic Properties — Jerome; L.L.C.,
requesting Temporary Use approval to' erect various temporary use structures on site from
December 1, 2017 through November 30, 2018; and
WHEREAS, pursuant to Chapter 26.450.050 of the Land Use Code, City Council may
grant a temporary use approval for up to 180 days, and no more than ten (10) annual recurrences;
and
WHEREAS, the City Council reviewed the application and considered the Temporary
Use proposal under the applicable provisions of the Municipal Code as identified herein, has
reviewed and considered the recommendation of the Community Development Director, and has
taken and considered public continent at a duly noticed public hearing; and,
WHEREAS, the City Council approves the tent structures in the Main Street courtyard and
Mill Street terrace, allowing for temporary use for seventy-four (74) days; and,
WHEREAS, the City Council finds that the request for the extended- temporary use
proposal for special event tents to be in accordance with the applicable development standards
associated with the request, and has approved it for five (5) annual recurrences.
WHEREAS, the City Council grants approval for use of the Ice Lounge through April
l', 2018 with no annual recurrences thereafter; and,
WHEREAS, the City Council finds that this resolution furthers and, is necessary for the
promotion of public health, safety and welfare.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ASPEN, COLORADO, THAT:
Section 1
Pursuant to the procedures and standards set forth in Title 26 of the Aspen Municipal
Code, the City Council hereby approves a Temporary Use request to allow the erection of
tents on the subject site, in the Main Street Courtyard and Mill Street terrace, for seventy-four
(74) days in each calendar year for five (5) years, from January 2018 through December 2022.
After five (5) years, the applicant may submit an application to be.reviewed administratively for
an additional five (5) annual recurrences (2023-2027). Use of the Ice Lounge in the Mill Street
terrace is approved through April 1". 2018, with no annual recurrences.

Temporary structures that are approved on a site for a period greater than fourteen (14) days are
subject to growth management review, resulting in affordable housing mitigation. The
applicant is required to provide housing mitigation for sixty (60) days for the tent structures and
one -hundred -and -one (101) days for the Ice Lounge, for a total of one -hundred -and -sixty-one
(161) days. Staff has calculated the amount of affordable housing due, based on the fees in
2017, as $6,387.94. Affordable Housing mitigation fees will be calculated at the current rate
each year. Affordable Housing Mitigation for the Main Street Courtyard tents will be collected
upon issuance of the first permit to be erected in that location. Mitigation for the Mill Street
Terrace will only be collected upon approval from the Fire Department for the erection of any
structures. Only mitigation for the actual days erected will be required. The methodology is
shown in Exhibit A.
Section 3•
A tent permit approval, including verification from the Aspen Fire Department that the structure
meets all necessary safety requirements, is required prior to the erection of each temporary
structure. If the Fire Department is unable to approve a tent in a given location it may not be
erected.
Section 4:
All material representations and commitments made by the Applicant pursuant to the
temporary use proposal as herein awarded, whether in public hearing or documentation presented
before the City Council, are hereby incorporated in such plan development approvals and the
same shall be complied with as if fully set forth herein, unless amended by an authorized entity.
Section
This resolution shall not affect any existing litigation and shall not operate as an abatement
of any action or proceeding now pending under or by virtue of the ordinances repealed or
amended as herein provided, and the same shall be conducted and concluded under such prior
ordinances.
Section 6•
If any section, subsection, sentence, clause, phrase, or portion of this resolution is for any
reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be
deemed a separate, distinct and independent provision and shall not affect the validity of the
remaining portions thereof.

Posting of notice: By posting of notice, which form was obtained from the
Community Development Department, which was made of suitable, waterproof
materials, which was not less than twenty-two (22) inches wide and twenty-six
(26) inches high, and which was composed of letters not less than one inch in

required in Section 26.304.035, Neighborhood Outreach. A copy of the

requested, to affected mineral estate owners by at least thirty (30) days prior to the
date scheduled for the initial public hearing on the application of development.

Dear Jessica:
Please consider this letter an application for Temporary Use Approval for the Hotel
Jerome which is located at 310 East Main Street in the City of Aspen (see Exhibit 1,
Pre -Application Conference Summary, attached hereto). The Hotel would like to
erect temporary tents in its Main Street courtyard and on its Mill Street terrace at
various times during the coming year to accommodate a variety of special events. In
addition, the Hotel wishes to install an ice lounge with a canopy on the Mill Street
terrace which would be in place for the duration of 2017/2018 winter season, weather
permitting. The property's Parcel ID# is 2737073211004.
The application is submitted pursuant to Sections 26.4i2, 26.450 and 26.470.090.I.
of the Aspen Land Use Regulations (the "Regulations") by Iconic Properties -
Jerome, LLC, a Delaware limited liability company (hereinafter "Applicant"). The
Applicant's ownership of the property is evidenced in the attached Title Insurance
Policy (see Exhibit 2). Permission for Vann Associates, LLC, Planning Consultants,
to represent the Applicant is attached as Exhibit 3. A land use application form; an
application fee agreement; a homeowner association compliance form; and a list of
property owners located within three hundred feet of the Hotel are attached as
Exhibits 4, 5, 6 and 7, respectively.
Proposed Temporary Uses
The Hotel Jerome has historically accommodated special events in its courtyard that
required the erection of temporary tents. The terrace, which can be accessed from the
Hotel's ballroom, has also been tented in connection with such events. These events
have included weddings, receptions, lunches/dinners, and conference/seminar meet-

ings. In the past, a Temporary Use Permit would be obtained prior to each event and
would be processed administratively by the City. The Hotel, however, has been
advised that all future tent requests will require compliance with the applicable
provisions of the Regulations including the provision of affordable housing mitigation
when required. Tent requests which cumulatively exceed seven days are subject to
approval by the City Council at a public hearing.
The decision to erect tents in the courtyard and on the terrace has typically been left
to the event client, and is usually dependent upon the extent to which the client is
concerned about the weather. While reservations are usually made well in advance of
the event, the decision to tent the space is typically made closer to the actual date.
Either the Hotel or the client would work with one of the local tent rental companies
to provide the desired tent. The erection and removal of the tents would typically
take two days. The tents do not require additional employees, generate additional
Hotel guests, or result in the creation of new commercial space as the areas to be
tented can be used for such events without the erection of a tent. The tents are
intended solely as an insurance policy to ensure that events can take place regardless
of the weather.
It should be noted that the Hotel currently has reservations for 15 special events in
2018, some or all of which contemplate the erection of tents. Based on past experi-
ence, additional reservations for such events which may also request tents are
anticipated. As it is difficult to predict the actual number of events that will occur,
and given the time and costs required to prepare and process the required land use
application, the Applicant proposes to request approval for a given number of
events/days and to calculate the applicable affordable housing mitigation fee therefore.
To simplify the required calculations, it is assumed that all events will be tented, and
that two days will be required per event to erect and take down the tents.
More specifically, the Applicant requests approval to accommodate and tent 37 events
in 2018 which equates to 74 days for mitigation purposes. As presently envisioned,
27 cyegnts are expected to occur in the Main Street courtyard while the remaining 1.0
events will utilize the Hote s 1 e errace. pproval is also requested for the
-unenutusneacrcanopy that will §h`iel a proposed terrace ice lounge during the winter
season.
As the seasonal erection of tents within the courtyard and terrace is expected to
continue for the foreseeable future, the Applicant requests that the City Council
approve a minimum of five annual recurrences as provided for in Section 26.450.050.

Review Requirements
The Applicants proposed tents are subject to review pursuant to the City's Temporary
and Seasonal Uses; Commercial Design Review; and Growth Management regula-
tions. Each of these review requirements is addressed below.
A. Temporary and Seasonal Uses
The applicable review requirements for temporary uses, which are contained in
Section 26.450.030, Temporary and Seasonal Uses, of the Regulations, and the
proposed uses compliance therewith, are summarized below.
1. The location, size, design, operating characteristics and
visual impacts of the proposed use.
The largest courtyard tent to be erected will measure approximately_30.
feet b_ y 60 feet while the largest terrace tent will measure 20 feet by _ f40�_ While
smaller tents may be erected in either space depending on event requirements,
approval for the largest tents that would be erected is requested to simplify the
application approval process. TheZtpgrace cano y, which will only cover the ice
lounge, will measure approximate)feet by 10 feet. The largest courtyard tent
would essentially occupy the entire courtyar an would be visible from both Mill
Street and the adjacent sidewalk. Only its 30 foot dimension, however, would front
the street and sidewalk. The majority of the tent would be partially shielded from
view by the adjacent Aspen Times and Hotel structures. An illustrative site plan
depicting the Hotel and reconfigured courtyard, and photographs of a typical court-
yard tent, are attached as Exhibits 8 and 9, respectively.
The terrace tents and the ice lounge and canopy will be visible from
Mill Street and the adjacent sidewalk. Again, only the tent's 20 foot dimension would
front the street and sidewalk with the majority of the tent shielded from view by the
Hotel's surrounding walls. The terrace is located above the street and sidewalk grade
which will help to reduce its visual impact. The terrace tents will typically be simpler
in design than those erected in the Hotel's courtyard. The courtyard and terrace tents
will be accessed and serviced from within the Hotel.

2. The compatibility of the proposed temporary use with the
character, density and use of structures and uses in the immediate vicinity.
As discussed above, the majority of the courtyard and terrace tent walls
are surrounded by and shielded from view by the adjacent Aspen Times and Hotel
Jerome structures. Tents have historically been erected in both the courtyard and on
the terrace with no known adverse impact on the character of the immediate site area.
The tents are temporary in nature, and are consistent with the operation of a lodge
such as the Hotel Jerome.
3. The impacts of the proposed temporary use on pedestrian
and vehicular traffic and traffic patterns, municipal services, noise levels and
neighborhood character.
The proposed tents and ice lounge will have no significant impact on
pedestrian and vehicular traffic and will place no unusual demand on municipal
services. All special events will comply with the City's applicable noise regulations,
and the Hotel will manage such events so as to minimize noise that would adversely
impact its guests. The various tent rental companies have historically utili_z_ed Ba.eeker
Street for setup and removal.
4. The duration of the proposed temporary use and whether a
temporary use has previously been approved for the structure, parcel, property
or location as proposed in the application.
Temporary Use Permits have previously been issued for the erection of
tents on the Hotel property. The Applicant is requesting approval to accommodate 37
events in 2018 which equates to a total of 74 days, assuming two days are required to
setup and remove the tents. A minimum of five annual recurrences is requested to
avoid the preparation of a yearly application and the significant costs and processing
time associated therewith.
5. The purposes and intent of the zone district in which the
temporary use is proposed.
The Hotel Jerome is zoned CC, Commercial Core. Lodging uses are
permitted by right in the CC zone district and are intended to support and enhance the
City's local and resort economy. The proposed temporary uses are consistent with
this purpose in that they enable both locals and tourist to take full advantage of the
various services provided by the Hotel. The City's approval of the requested tents
will significantly enhance the Hotel's ability to provided these services.

6. The relation of the temporary use to conditions and charac-
ter changes which may have occurred in the area and zone district in which the
use is proposed.
The use of tents has historically been permitted at the Hotel Jerome and
predates those used at other lodge properties including the Little Nell and St. Regis.
The City's has also permitted such tents to be erected on various municipal properties
for events such as the yearly Food and Wine Festival. These temporary tents further
the ability of the both the City and its lodges to accommodate events throughout the
year regardless of the weather.
7. How the proposed temporary use will enhance or diminish
the general public health, safety or welfare.
The proposed tents will enable the Hotel Jerome to accommodate events
throughout the year regardless of the weather thereby enhancing the general public
safety and welfare.
B. Commercial Design Review
The proposed temporary uses are also subject to Section 26.412.060.A.,
Commercial Design Review, of the Regulations. This Section requires that applica-
tions for Commercial Design Review comply with the City's Commercial, Lodging
and Historic District Design Standards and Guidelines. Per the Pre -Application
Conference Summary, the Applicant need only respond to certain of the standards and
guidelines. The applicable standards and guidelines, and the proposed temporary uses
compliance therewith, are summarized below.
1. Section 1.2: Complete and accurate identification of materi-
als is required.
Photographs of typical tents to be erected within the courtyard are
provided as Exhibit 9. The tents and the materials from which they are constructed
are consistent with those previously erected on the Hotel property and on similar
lodge and municipal properties in the City. The ice lounge will consist of a simple 12
foot by 12 foot block ice walled enclosure with a small overhead canopy.

The proposed tent materials will be consistent with similar tents erected
throughout the City on both public and private properties. The tent materials are non -
reflective, neutral in color and typically white. The tents are pedestrian in scale.
3. Section 1.24: Introducing a new material, material application,
or material finish to the existing streetscape may be approved by HPC or P&Z if
the following criteria are met:
• Innovative building design.
• Creative material application that positively contributes to the
streetscape.
• Environmentally sustainable building practice.
No new tent material is proposed as all tents will resemble and be
consistent with those historically erected at the Hotel Jerome and throughout the City.
4. Section 1.24: Architectural that reflects corporate branding of
the tenant is not permitted.
The proposed tents will not incorporate corporate branding.
5. Section 2.14: Architectural details should reinforce historic
context and meet at least two of the following qualities:
• Color or finish traditionally found downtown.
• Texture to create visual interest, especially for larger buildings.

• Traditional material: Brick, stone, metal and wood.
As stated above, the proposed tents will consist of a color and material
historically used within the City.
6. Section PA 1.5: Street level Pedestrian Amenity areas shall be
open to the sky.
• Direct access to the Pedestrian Amenity from the street is required.
• A street level Pedestrian Amenity space may be covered, subject to
HPC or P&Z approval. If the space is covered, the street -facing portion shall be
entirely open.
The proposed tent locations are within existing open areas on the Hotel
property. The reconfigured courtyard was approved in connection with the Hotel's
recent Planned Development amendment approval and was designed in compliance
with the City Pedestrian Amenity space requirements. The courtyard is directly
accessible from the adjacent Main Street sidewalk.
7. Section PA 1.7: Design amenity space that enhances the pedestri-

C. Growth Management
Pursuant to Section 26.470.090.I. of the Regulations, temporary uses
such as tents that are erected for more than 14 days in a 12 month period are subject
to affordable housing mitigation. Mitigation, however, is only required for those days
in excess of 14 in a 12 month period. Mitigation in the form of cash -in -lieu is
permitted by right. As the proposed Main Street courtyard and Mill Street terrace
tents will be erected for more than 14 days in 2018, mitigation is required. Per the
Pre -Application Conference Summary, no mitigation is required for the unenclosed
terrace ice bar canopy.
The applicable cash -in -lieu mitigation fee calculation methodology, and
the resulting fees for the courtyard and terrace tents, is as follows.

DESCRIPTION:
The prospective applicant, The Hotel Jerome, would like to erect tents on their property located at 3A E. Main St. The
tents would be erected at various times throughout the coming year for special events. The number of days in total that
these tents would be erected would be more than 14 days. In addition, the Hotel is interested in having an ice bar with a
canopy. These are 2 separate requests, but can be handled in one application, which will include a noticed public hearing
with City Council. The applicant should identify how many days and the size of the canopy and proposed tents. The
requirements for each are listed below:
Requirements for tents
As per Chapter 26.450, Temporary Use, any temporary use longer than 14 days will be considered an Insubstantial
Temporary Use, and will need to be approved by City Council during a public hearing. Council may allow a Temporary Use
for up to 180 days, with the ability to request for one extension or for a seasonal use of up to 10 years. The applicant will be
required to respond to the criteria found in subsection 26.450.030.
Temporary uses that exceed fourteen (14) days are subject to housing mitigation. Mitigation shall be based on the number
of days in excess of 14 in a 12-month period, as calculated in Section 26.470.090.1.
The applicant has the choice of either mapping out all of their days where they may need a tent over the course of the next
year, or if time allows they may apply one by one for each event. The procedure and fees would be the same for either
route, however, if the applicant wished to obtain approval for each event, the fees and paperwork would be required for
each application.
Commercial Design Review, pursuant to the Commercial Core Character area and section 26.412 is required.
Requirements for ice bar and canopy
All the above requirements are required to be met for the temporary canopy, including the temporary use review criteria
and the commercial design review criteria. However, because the canopy could be removed and does not have sides, it
does not trigger the growth management review for temporary enclosures (26.470.090.1)
