OUTLINE DEVELOPMENT PLAN: WOERNDLE SUBDIVISON
All of the land included within the perimeters of the proposed planned unit
development is owned in whole by Ilse and Tony Woerndle. Development of the
. project will begin as soon as final approval is received by the City Council.
The development will occur in .an order1y manner beginning wi th the four sites
located above the Salyation Ditch. The initial phase is to include the pla-
cing underground ~ll utilities for sites 1 - 4 and the construction of
Mayflower Court. The second phase of development will be the construction
of single family dwellings on sites 1 - 4. The third phase of development
will include the underground installation of utilities for sites 5, 6, and
7 and the construction of Aeue Park. The fourth and final phase will be the
construction of single family dwellings on sites 5 - 7. The expected com-
pletion date will be Novemb.er 15, 1978.
It is the intention of the developer to connect with city water and sewer.
Each lot within the subdivided area will be provided with water and sewer
in accordance with City of Aspen specifications. The feasibility of the
water supply to the Woerndle Subdivision will be assessed by the City En-
gineer. To determine feasibility he will take pressure tests on the exis-
ting main and report his findings to the Planning and Zoning Commission and
the City Council within thirty days. The Aspen Metro Sanitation District
has recommended that the developer enter into a collection systems agree-
ment with them. This agreement meets with the approval of the developer.
Even though Mayflower Court and Aeue.Park are to remain private cul-de-sacs,
they will be constructed in accordance with city specifications for street
construction and subject to the approval of the City Engineer. Surfacing
of the cul-de-sacs will not occur until one year after the installation of
the underground utilities.
It is the intent of the developer through the planned unit development to
provide a maximum choice in the type of environment and living area avail-
able to the pub 1 i c: An envi ronment whi ch preserves the trees, natural topo-
graphy and prevents soil erosion; A development which provides creative,
efficient use of the land resulting in smaller networks of utilities, open
space and recreation areas; A development of stable character in harmony
with the surrounding environment.

~ERNDLE SUBDIVISION AGREEMENT
THIS AGREEMENT, made and entered into this~day
of s:e ~ t:iA A ber=, 1974, by and between ANTON WOERNDLE
and ILSE WOERNDLE (hereinafter referred to as "Owners"),
JAMES J. COSTLEY (hereinafter referred to as "Developer"),
and THE CITY OF ASPEN, COLORADO, a municipal corporation
(hereinafter referred to as "City").,

WHEREAS, Owners hold record title to a parcel of
land situate in the City of Aspen, County of Pitkin, State of
Colorado, which parcel is more particularly described on
Exhibit A attached here'toi and
WHEREAS, Owners and Developer have submitted to City
for approval, execution and recording a subdivision plat of
the above-described property, such subdivision to be known
and designated as "Woerndle Subdivision"; and
WHEREAS, the subject property is located within an
area of the City zoned R-15 pun, and
WHEREAS, the City has fully considered such subdivi-

sion plat, the proposed development and the improvement of
the subject property shown thereon, and is willing to approve,
execute and accept said plat for recordation upon the agreement
of Owners and Developer to the matters hereinafter described,
which matters are deemed necessary to protect, promote and
enhance the public welfare; and
WHEREAS, Owners and Developer are willing to enter
into such agreements with the City.
NOW, THEREFORE, in consideration of the premises,
the mutual covenants herein contained, and the approval,

execution and acceptance of said sUbdivision plat by the City
for recording, the parties hereto hereby agree as follows:
'1. Developer 'shall construct and install the storm
drainage facilities prior to submitting an application for a
Certificate of Occupancy for the first residential dwelling
on the subject property, or by October 15, 1976, whichever
first occurs. These facilities shall include catch basins
and dry wells to be constructed in Aene Park and Mayflower
Court cuI de sacs to retain run off from roadway. Run off
shall be directed away from salvation ditch.
2, Developer shall landscape the subject property
in an amount of $5,000.00 and in a manner which shall be
harmonious and compatible with existing vegetation and which
shall also provide planting to screen the subdivision from
Highway 82, prior to submitting an application for a Certifi-
cate of Occupancy for the first residential dwelling on the
subject property, or by October 15, 1976, whichever first
occurs.
3. City, Owners and Developer mutually agree that
the sum of $3.400.00 represents four (4%) per cent of the
current fair market value of the land described above, and
that such amount shall be paid to the City by Developer prior
to recording the subdivision plat.
4. Five of the seven residential lots in the sub-
division will pay the water tap-on fee at a fee equal to that
for county property and the remaining two lots shall each pay
such fee equal to that for city property. Before the sale of
any lot, Developer shall designate to the City and the purchaser
which fee is to be paid.
5. Mayflower Court and Aene Park are to remain
private roads to be w~intained by the Homeowners Association

or such other private individuals or entities as may agree or
be bound so to do.
6, All dwellings constructed on the lots are to
be single family residential dwellings.
7. Soil suitability reports regarding Lots 6 and 7
shall be submitted to the Building Inspector at the time
application is made for building permits for said lots.
8. Owners and Developer shall agree to hold harmless
the Salvation Ditch Company for any damage to the subdivision
caused by flooding or seepage not resulting from negligence
of the Salvation Ditch Company.
9. Developer shall construct, according to City
specifications, 8n water lines with fire hydrants in Aene
Park and Mayflower Court, said lines and hydrants to be deeded
to the City of Aspen upon completion. Said construction shall
be completed prior to sUbmitting an application for a Certificate
of Occupancy for the first residential dwelling on the subject
property.
10. City represents that it may not be able to hook
up water for all the lots immediately, but intends to make
the same available when its ability to serve the entire area
becomes feasible.
11. Upon execution of this Agreement by all parties
hereto, City agrees to approve and execute the final plat of
Woerndle Subdivision and accept the same for recording in
the real property records of Pitkin County, Colorado, upon
payment of recording fees and costs to City by Owners and
Developer.
12. This Agreement shall be binding upon> the parties
hereto and their respective heirs, personal representatives,

Re: Woerndle Subdivision Preliminary Plat.
Dear Sir:
We have reviewed the preliminary plat of "Woerndle
Subdivision" for the adequacy of Utility Easements
and dedication of same.
We will need the following phraseology be used for
the dedication use of easement within said subdivision
Final plat.
A perpetual easement for the installation and main-
tenance of utilities and drainage facilities, includ-
ing, but not limited to, electric lines, gas lines,
telephone lines, is reserved and dedicated over and
through the roads and streets within this subdivision.
Together with perpetual rights of ingress and egress
for installation, maintenance and replacement of such
lines. Said easement and rights shall be utilized in
a reasonable and prudent manner.
We believe all preliminary, as well as final plats
should show the dedication or reference to the par-
ticular "Protective Covenants" which will run with
the property. Also, all "private roads" should be
dedicated to the utilities for the installation, opera-
tion and maintenance of gas, lights, power and tele-
phone lines. No easements should be reserved to the
property owners cities or counties exclusively.

Dear Marty:

I have reviewed the agreement 'and ,find it satisfactory,
but one element leaves me unsatisfied.
C.R.S. 1963, section 120-14-3 (e) (2) provides:
"No roadway, or part thereof, shall be
vacated so as to leave any land adjoining
said roadway without an established public
road connecting said land with another
established pUblic road."
. I ,wish you would, although it is implied in the"
easement agreement, get a Consent of vacation from,
Ferguson if he is not serviced by another established
roadway. I cannot determine from ,the (annexation)'map
I have "in my file if this is the case or'not. I would
like the consent for our file-inasmuch as we are not
a party to this agreement. Thank you.

Pursuant to our discussion yesterday, I am enclosing a copy
of an Easement Agreement regarding a portion of the private
Aene road. Jon.Mulford (with Dwight Shellman's office)
representing Mr. Ferguson was in my office yesterday and
reviewed and approved the Agreement.
I have sent the original to the Woerndles to be signed
and returned, and will then send it to Mr. Ferguson, so
that it may be back in time to have the Riegers able to
sign before July 22.
I am also enclosing a copy of Gerry Pessman's letter with
the legal description.

Dear Planning and Zoning Commission:
I represent James J. Costley, developer of the proposed
Woerndle Subdivision. On his behalf, I should like to
outline for you the general nature of the covenants
which will be prepared governing the use, maintenance
and continued protection of said development and its
common open spaces. By his signature below mine, Mr.
Costley will indicate his agreement and consent to have
prepared, executed and filed the completed documents
incorporating in detail the points mentioned herein.
1. Common areas. The common areas noted on the proposed
subdivision plat (or as may be amended pursuant to
city requirements) shall be owned and maintained by a
Homeowner's Association to be formed as a non-profit
Colorado corporation. This Association shall maintain
the common areas, including the roads, with a possible
contribution to the maintenance of roads utilized by
adjoining land~ners, The roads will be built and
maintained pursuant to city or county standards, which-
ever are higher. No improvements shall be constructed
on the common areas, and the natural vegetation on said
areas will be preserved to the maximum extent possible,
supplemented by landscaping of a harmonious aesthetic
nature.
2. Residential areas. The residential areas (the seven
lots) shall be used for single family dwelling houses
only. No business or other commercial use shall be
permitted. No trees or brush growing on any residential
lot shall be felled or trimmed, nor shall any natural
areas be cleared on any residential lots without the
prior permission of the developer or architectural
committee, as appropriate. No house shall contain

greater than 2500 square feet of floor area. Restrictions
on height and setback shall be at least those of the
then applicable city requirements, and probably greater.
No temporary buildings shall be permitted, except as may
be necessary for a brief period of construction, No
resubdivision of any lot shall be permitted. Plans for
houses must be approved by the developer or architectural
committee, as appropriate.
3. Enforcement powers. The developer or Homeowner's
Association, as appropriate, shall have the necessary
powers to enforce the covenants and restrictions appli-
cable to the development.

WOERNDIE PUD - OUTLINE DEVELOPMENT PLAN
Written Report to City Council
The Planning and Zoning Commission has recommended the
Woerndle PUD Outline Development Plan for approval by
the City Council.
Reasons for approval are as follows:
1. The application is consistent R-15 mandatory PUD in
the County.
2. The development is restricted to single family dwellings
and is less dense than R-15 in the city which permits
duplexes on 15,000 square feet.
3. The cluster plan provides for open space areas that
will retain natural aspen grove cover. By varying set
back and lot area' requirements for each building
the plan takes advantage of 5 common areas and permits
larger areas of contiguous open space. -
4. Undersized private roads were designed in order to
preserve as much as possible the natural terrain of
the site. Their maintenance will be the responsi-
bility of a home owners association.
5. Utilities will be placed underground.
6. Access cuts have been reduced to two for seven building
sites; four of these will access on Mc Skimming Road
rather than the highway.
7. The development is in harmony with the surrounding
residential neighborhood.

8. A more desirable environment can be expected to result
from the submitted plan than would be possible through
strict application of other sections of the zoning
resolution.
The development is subject to subdivision procedure and
planning considerations related to drainage, soil conditions,
ditch seepage, trails, protection of Salvation Ditch,
water supply, fire protection and dedications of public ROW
will be made conditions of subdivision approval.

Considerations
The planned unit development plan is not a subdivision plat, it will be
necessary to subdivide the property and comply with subdivision regulations.
Right-of-ways, easement for trails, 4% dedication, drainage and other
engineering requirements will be considered at time of subdivision.
Common areas of PUD should be remained open and not used for swimming pools
and used only for open space and ply lots for the benefit of the subdivision.
A landscaping plan should be submitted showing areas where the natural
vegetation will not be disturbed and detail landscaping along salvation
ditch which will screen the development from the highway is to be
evaluated by Planning and Zoning for the final development plan.
Roads shall be shown to remain private.
Home Owners Association to be formed for maintenance of roads and open
spaces.
The City will have to resolve the issue of water plant investment fees before
annexation.
City Council at their meeting held May 13, 1974 passed the Woerndle resolution
on annexation and passed on first reading the ordinance on annexation, final
reading of ordinance will be read June 2, 1974.

Woerndle property consists of approximately 2.4 acres on
the north side of Highway 82 at McSkimming Rd., east of
town.
When a development proposal was presented to the County, the
County P & Z suggested to the developer that the site might
properly be annexed to the city. It was decided that the
city P & Z should review a proposal for the site prior to
annexation. A preliminary subdivision plat and a PUD outline
development plan was approved in concept by the P & Z last
summer. Approval was given, conditional on l)annexation;
2) 'resolving a problem of water supply; 3) correcting minor
subdivision problems. The city engineer, on the basis of
the recent water service study, states that at least some
of the project can be served by autumn, 1974. At this time
the developer is requesting City Council consideration of
an annexation petition.
Summary
The P & Z Commission has given conceptual approval of the
proposed use of the land.
The Economist finds no significant costs to the city would
result from annexation, and that the PIF is sufficient to
cover an extension of water service to the project,

In 1964 I had, my property surveyed as well as the
Alpine Inn and a portion of the present subject $ubdivision. I
am enclosing a copy of that survey. This SUl"Vey was made in two
pans by G. E. Buchanan and for ready X'eference I have pieced the
two parts together.

inspection of Rty property which adjoins the north corner of this
subdivision that survey markers placed in the grOl.U'ld by Mr. Buchanan
have heen removed since lll$t August when I made an inspection of that
particular area in looating those markers for my partnel' in Aspen.

There are other items in the WQerndle Subdivision plat
that indicate possible serious disel"epacncies in the plat with
respect as to how it may lie upon thegt'ound. The not'1:h lUie of
Lot 5 discloses 135 feet plus or minus :running between the
turnaround circle and the l;!01'Ile1' of $S.lvation ditch. I ser10nsly
doubt thi.$ line would melilaul'eon the ~d 1ll0Ji'e than 120 feet.
Of course. I am also conee1'Iled that only one of the lotIO
meet the area requirement for R-15 and 1 ser1on$ly doubt that Lot 5
will meet this requirement When the 50' public access road is
plotted.

llhank yoU! for your letter of May 5, 1972 in regard to the Woerndle Subdivision.
It. is hoped that this letter will answer your concerns.
1. As previously demonstrated, if my client would use the present
Riverside Addition lots as presently platted, he could deed 6 parcels,
from Block 18 of Riverside Addition by use of present lot designations,
that would meet the minimum lot requirements. Riverside Ave. and
Aene Ave. are a.lJ:!eady platted, as shown on the Willits plat, so it could
be construed that there is access. The 7th lot, the triangle, meets the
minimum lot requirement.. We feel that the HE-Subdivision as we have
shown it would clear up an existing mess, give the City the right of way
it needs to make McSkinmdng Road safer, (concern no. 4), and upgrade
the present Aspen Grove Subdivision, which has much smaller lots.
2, The"private" road, as noted is in use at the present time, being the
access for the parking for the Alpine Lodge, and is shown on the
Riverside Addition as Aene Road. Whether it is dedicated as a public
access or not is a legal question, since the original recorded plat has
dissappeared from the Pitkin County Courthouse
3. Salvation Ditch as relates to Lots 6 & 7, can be solved by noting on
the plat that building permits will not be issued until a qua:li.fied
soils engineer'issues a statement that there will be no problem with
seepage. A. house is all ready in place on Lot 5.
4. As noted on the preliminar,v plat, the access to McSkimming Road is to
be dedicated to the Public, so the problems can be corrected by the
residents of Aspen Grove. It is to be noted that the pumping station for
the water line to Aspen Grove is on my clients ground, without benefit of
easement, and it is my belief that there has not been enough time that it
has been used to qualify it for a prescriptive right.
5. We will increase the radii to 50 ft. for service vehicle turnarounds.
We would rather get an approval from the board of adjustment for lot size, than
go to PUD development.

v/' As an adjoining landowner, I object to this subdivision
as pertains to our common bouhdry lines on the northwest side of
the subdivision.
~he plat fails to disclose existing fence lines and
structures' on this northwest side, such structures and fences having
been in existence more than thirty years I am informed.
~e plat also subdivides an existing public road which I
presently use to gain access to my property.

The plat is also at variance with a survey by Mr. G. E.
Buchanan that was made for me October 29, 1964.
The'plat also surveys from a marker that requires a 75 foot
drop line to a plotted curve being an obscure point in the public
roadbed.
I suggest the northwest section of this plat be redrawn
to disclose the public thoroughfare, the existing fences and structures
prior to its being approved.
Mr. Walter F. Hampel, Jr. in As~en is familar with my property
and assists me in its management. I would appreciate your feeling free

Dear Mr. Pesman:
At its meeting on Tuesday, May 2nd the Aspen City Planning
and Zoning Commission reviewed the preliminary plat of Woerndle
Subdivision for compliance with the City's Subdivision Regula-
tion. As a result of the discussion several concerns regarding
the present plat were raised and are listed below:
Vl. Only one of the seven lots meets the minimum lot area
requirement for the city's R-15 residential zone.
2. The Commission felt that a private road serving as
. access to three lots should not connect directly with
~ a state highway and that this particular ingress/egress
point is potentially unsafe.
3. Salvation Ditch presents problems with regard to
preservation~ access and maintenance of the ditch and
establishment of a permanent easement for the ditch.
V Ditch seepage and toptgraphy raise questions regarding
the development feasibility of the area not platted as
lots 5, 6 6 1. .

V 4. McSkimming Road. as shown on the plat, creates align-
ment and safety problelllS where it enters the highway,
however it is probably the responsibility of the public
sector to correct these.
V 5. The 30' radius indicated in both-cul-de-sacs is inade-
quate for service vehicle turnaround.
The Commission indicated that it felt a PUD treatment of the
property to allow flexibility in building site placement and
building height would be the most practical method of allowing
maximum density while creating a more suitable residential
development for this particular tract.
PUD treatment would require R-15 (PUO) zoning after annexation
to the city. The city z~ing code should be consulted for details
of the application procedure.

Our office represents Mr. and Mrs. Robert Weldon, the owners
of Lot 1, Block 1, Aspen Grove Subdivision. This property
appears to be adjacent to the boundary line of the proposed
Woerndle Subdivision which passes within a portion of what was
formerly known as Icircuit.Avenue."
We are unable to determine from the survey information given
by the proposed subdividers whether this boundary conflicts
with interests of our clients. We have previously submitteq.
clarifying documents to, the proposed subdivider but have had
no response to date. It would be greatly appreciated if your
Commission would defer preliminary or final approval of the
subdivision plat pending advice that these parties have either
eliminated the possibility of a cOnflict or have resolved it
satisfactorily.

Gentlemen:
In December" of 1964 I scquired title to lots 1 through
16 and the west half to lot 17, block 17, Riverside Addi.tion.
This property is on Highway 82 adjoining the west and north side
of the Alpine Inn. l'lhen I purchased this property I was cogni;ant
of the fifty foot street which provided access to ,this property
from the east. I was informed that this street in recent years.
provided access to the Aspen Grove Cemetery. This entrance way
to subject property was a very important factor in my decision
to purchase same and I,also had same surveyed by Mr. Buch~lan
under date of October 29, 1964.
In August of 1958 the Alpine Lodge owner and myself
agreed to certain property line adjustments along our north
and west brnlndaries. I also placed an attractive wooden, rail
fence along this boundary, and a twenty foot gate as an entrance
way from the street in question since I do on occasion have need
to enter the property from this direction.
I am opposed to any abandonment of this street off · ~
Highway 82 being fifty foot wide and further opposed to any aban- ~ .
donment of the twenty-five foot streets running diagonally, one
north and one south, the latter previously going to the Aspen
Grove Cemetery,
I am enclosing plat showing the Alpine Lodge and our
agreed p~operty line, such agreement filed for record August 13,
1968, Book 23S, Page 905 and in "red" I have inserted the streets
I refer to as being opposed to their abandonment. '
