Mayor Ireland called the meeting to order at 5:00 p.m. with Councilmembers Skadron
and Romero present.
RESOLUTION #90, SERIES OF 2008 - Quasha Settlement
John Worcester, city attorney, pointed out this resolution approves a potential settlement
of the Si Johnson ditch access litigation. Staff is recommending adoption of this
resolution. Phil Overeynder, Water department, reminded Council this property is
located at 715 South 7` street. Two years ago it was found there was encroachment on
an easement the city used for accessing the Si Johnson ditch. The city filed for an
injunction to stop construction of a new house. The judge issued an injunction and set a
trial date of November 2008. Overeynder outlined this settlement defines the extent of
the easement rights and dismisses claims against the city. In the agreement the city
agrees to provide water in the future on payment of fees and disconnection from their
well.
Councilman Romero noted this is not meant to be part of the city's trail system but
merely an access easement. Overeynder said he has gone over that with the parks
deparhnent and will make sure they understand the timing and use restrictions outlined in
the agreement.
Councilman Romero moved to approve Resolution #90, Series of 2008; seconded by
Councilman Skadron. All in favor, motion carried.
Councilman Romero moved to adjourn at 5:07 p.m.; seconded by Councilman Skadron.
