SUMMARY: The Planning Office recommends approval of the temporary
use permit for the theatre tent and theatrical productions from May
15 through September 20.
PREVIOUS COUNCIL ACTION: A temporary use permit was granted last
year for the Aspen Theatre in the Park for the same uses requested
this year. First reading of Ordinance 23, 1994 was held on May 23,
1994.
BACKGROUND: The theatre group has staged summer performances in
a tent at the Rio Grande Art Park since 1986. The temporary use
procedure was established in 1992 for temporary uses which may or
may not be allowed within a given zone district. The Applicant has
not yet applied for or received approval of a permanent theatre
facility at Art Park via the Rio Grande Final SPA process,
therefore they must receive a temporary use permit.
CURRENT ISSUES: There are no new issues associated with this
year's temporary use application. The Applicant is aware of the
risks associated with the late application for their permit. They
are proceeding to erect the tent at their own risk.
At first reading, Council asked the applicant and staff to consider
alternatives to the shiny plastic cover used for the disassembled
tent during the winter. Staff sought input from other City
departments, but the only response was to shop at the surplus store
in Glenwood Springs for a camouflage patterned tarp. Planning is
not sure this would be an improvement over what is currently used.
If cloth fabric were used to reduce the shine, it would probably
attract dirt and be equally unattractive.
FINANCIAL IMPLICATIONS: There are no discernable public costs
associated with this temporary use request.
STAFF COMMENTS: The same tent and layout is proposed for this
year's theatre complex. Please refer to the application
information (Exhibit "A") for text and graphic descriptions.

RECOMMENDATION: The Planning Office recommends approval of the
Aspen Theatre in the Park temporary use for the tent and theatrical
productions in the Rio Grande Art Park from May 15 through
September 20, 1994.
ALTERNATIVES: Council could elect to approve a different duration
for the temporary use or they could deny the request.
PROPOSED MOTION: "I move to approve second reading of Ordinance
23 for a temporary use permit for the Aspen Theatre in the Park
tent and productions as presented in their application dated April
27, 1994."

Aspen Theatre in the Park is requesting a temporary use permit for the theatre
tent on the Rio Grande Parcel which includes the Art Park. The temporary use permit
is requested for a period of 5 months. The erecting of the tent would commence May
15 and the dismantling will be September 15-20. The theatre has operated in this
location for the past eight summers.
The theatre has operated in the same location since the summer of 1986 and is
in large part resonsible for the reclaimation of the area. The first summer a group of
theatre volunteers undertook a cleaning and planting project which resulted in the
Art Park. The theatre tent is consistent with the Master Plan for the Rio Grande Parcel.
Representatives of Theatre in the Park have worked closely with Leslie LaMont, the
Parks Department and the planning committee for the area to ensure that the theatre
is compatible with the neighborhhood and the uses envisioned for the Rio Grande
parcel. The theatre has operated in the same location for the past 8 summers with
minimal, if any, impacts and has been compatible with the surrounding neighborhood.
Theatre in the Park will erect the same attractive white tent as last summer. The
tent has interior structural supports of aluminum. A platform was built to provide for
seating and the stage which was stored on site for the winter. A platform to house
the lighting equipment as well as partitions will be constructed inside the tent. A
propane heating system which was installed last summer will also be in use. The
shed for the portable restroom facilities remains. An attached site plan shows the
square footage and location of the tent and facilities.
The attached site plan shows the location of the theatre tent which is
approximately in the center of the park below the parking facilitiy. The location of the
tent is such that it is accessible by public transportation, pedestrian/bicycle traffic and
by automobile with adequate parking at the city parking garage. There will not be
parking available next to the theatre, but we do request at least 3 spaces be available
for delivery vehicles necessary for nightly operation of the theatre and to provide for
handicapped parking.
Theatre in the Park, together with the Aspen Art Musem located across the river,
the Art Park, the walking trails and the tranquility of the residential area along with the
activities of the other facilities has brought a revitalization to the long neglected Rio
Grande parcel. The Rio Grande Park has become an activity center combining the arts
and outdoor activities while connecting the town with the river.
The tent will be erected after May 15, depending on the weather conditions,
with a crew of approximately 2 to 6 people and will be dismantled after September 6
with the same crew. During the operation of the theatre there is a set crew of 2 -5
people per day with a maximum of 15 during rehersals. The performances are
scheduled for 6:30 p.m. - 9:00 p.m. on Wednesday and Thursday and 8:00 p.m. -
10:30 p.m. on Friday and Saturday. Rehersal hours will range from approximately 6-
10 p.m., six nights per week, except for the two tech nights" when use of the tent may
go until midnight. The tent seats 100 people. During the set-up, dismantling and
operation of the theatre there is minimal traffic impacts consisting of 3 - 4 vechicles
moving equipment and sets.

Review Standards for a Temporary Use
Pursuant to Section 24-7-1203 the following review criteria shall
be considered for all temporary uses:
A. The location, size, design, operating characteristics, and
visual impacts of the proposed use.
RESPONSE: Please see the attached plans for the tent. The
Theatre Company will be setting up an approximately 60' x 80'
and 26' in height. The tent will seat about 100 patrons and
provides storage space.
The proposed temporary use will operate from May 15, 1994 -
September 20, 1994. Performances will occur four nights a
week from 6:30-9 pm. on Wednesdays and Thursdays and 8-10:30
pm on Fridays and Saturdays beginning June 29, 1994.
Rehearsal hours will range from approximately 6-10 pm., six
nights a week. Two "tech nights" (sound and light set-up)
require staff to be present until midnight.
The existing access road that is used during the winter for
the snow dump operation will provide access for all service
and deliveries to the theatre, as well as access for handicap
vehicles. Three parking spaces will be available for these

B. The compatibility of the proposed temporary use with the
character, density and use of structures and uses in the immediate
vicinity.
RESPONSE: The Rio grande property is zoned Public with an SPA
overlay. The Master Plan process has recognized an Art
oriented theme for this property. The combination of the Art
Museum across the river with the Art Park and Theatre tent
promote the use of this property for the arts. The Theatre
Company is a compatible use with the Art Theme that has been
recommended in the conceptual SPA Rio Grande master plan.
Other uses on the site are snow dump/melt operations (to be
moved), the Art Park and the Kayak course. Active recreation
on the Rio Grande playing field has been encouraged until the
valley wide rail utilizes the field for a terminal.
C. The impacts of the proposed temporary use on pedestrian and
vehicular traffic and traffic patterns, municipal services, noise
levels, and neighborhood character.
RESPONSE: The location of the Theatre tent is within walking
distance of the parking garage. "Snow dump road" will
accommodate vehicles for delivery and handicapped

accessibility purposes only, and parking at the tent is only
for service/delivery and the disabled.
The Theatre uses temporary toilet facilities located in a
shed. In addition, the theatre is in the center of the City
and very accessible to bikes and pedestrians.
Performances will be held four nights a week, up to 10:30 pm.
Rehearsals are generally during the early evening but during
"tech nights" work at the tent may go until midnight.
D. The duration of the proposed temporary use, and whether a
temporary use has previously been approved for the structure,
parcel, property or location as proposed in the Application.
RESPONSE: Although the Theatre has been performing on this
site for eight summers, there was never a formal review
process in place for Council and staff's review. The Theatre
Company has received funding from the City and causal consent
to use the property for approximately eight years.
Opening night is scheduled for June 29, 1994. The Theatre has
requested a temporary use permit from May 15, 1994 to
September 20, 1994.
E. The purposes and intent of the zone district in which the
temporary use is proposed.
RESPONSE: The purpose of the Public zone district is to
provide for the development of governmental and quasi -
governmental facilities for cultural, educational, civic, and
other governmental purposes.
Because of the public and cultural nature of this area and the
location in the center of the community, staff supports this
temporary use.
F. The relation of the temporary use to conditions and character
changes which may have occurred in the area and zone district in
which the use is proposed.
RESPONSE: The Theatre Company is becoming an integral part
of the entire enhancement program of this site. The
conceptual Rio Grande SPA master plan recommends the continued
use of the seasonal tent as an appropriate land use on this
site.
G. How the proposed temporary use will enhance or diminish the
general public health, safety or welfare.
RESPONSE: This temporary use will provide an additional
cultural amenity for this site. The tent provides a casual

evening use along the river adding vitality to a public space
that has been so abused. Aspen Theatre in the Park should do
nothing but enhance the general public health, safety or
welfare of this community.

The Planning Office has completed its preliminary review of the captioned application. We
have determined that this application is complete.
We have scheduled this application for 1st Reading before the Aspen City Council on Monday,
May 23, 1994 at a meeting to begin at 5:00 p.m. Second Reading and Public Hearing will be
on June 27, 1994. Should these dates be inconvenient for you, please contact me within 3
working days of the date of this letter. After that the agenda dates will be considered final and
changes to the schedule or tabling of the application will only be allowed for unavoidable
technical problems. The Friday before the meeting dates, we will call to inform you that a
copy of the memo pertaining to the application is available at the Planning Office.
Please note that it is your responsibility to mail notice to property owners within 300' and to
post the subject property with a sign at least ten (10) days prior to the public hearing. Please
submit a photograph of the posted sign as proof of posting and an affidavit as proof of mailing

CITY OF ASPEN hereinafter CITY and

2. APPLICANT understands and agrees that City of Aspen Ordinance
No. 77 (Series of 1992) establishes a fee structure for Planning Office applications
and the payment of all processing fees is a condition precedent to a determination
of application completeness.
3. APPLICANT and CITY agree that because of the size, nature or
scope of the proposed project, it is not possible at this time to ascertain the full
extent of the costs involved in processing the application. APPLICANT and
CITY further agree that it is in the interest of the parties to allow APPLICANT
to make payment of an initial deposit and to thereafter permit additional costs to
be billed to APPLICANT on a monthly basis. APPLICANT agrees he will be
benefited by retaining greater cash liquidity and will make additional payments
upon notification by the CITY when they are necessary as costs are incurred.
CITY agrees it will be benefited through the greater certainty of recovering its full
costs to process APPLICANT'S application.
4. CITY and APPLICANT further agree that it is impracticable for
CITY staff to complete processing or present sufficient information to the
Planning Commission and/or City Council to enable the Planning Commission
and/or City Council to make legally required findings for project approval, unless
current billings are paid in full prior to decision.

5. Therefore, APPLICANT agrees that in consideration of the CITY's
waiver of its right to collect full fees prior to a determination of application
completeness, APPLICANT shall pay an initial deposit in the amount of $
which is for hours of Planning Office time, and if actual recorded costs
exceed the initial deposit, APPLICANT shall pay additional monthly billings to
CITY to reimburse the CITY for the processing of the application mentioned
above, including post approval review. Such periodic payments shall be made
within 30 days of the billing date. APPLICANT further agrees that failure to pay
such accrued costs shall be grounds for suspension of processing.

FROM: Aspen Theatre in the Park
Aspen Theatre in the Park is requesting a temporary use permit for the theatre
tent on the Rio Grande Parcel which includes the Art Park. The temporary use permit
is requested for a period of 5 months. The erecting of the tent would commence May
15 and the dismantling will be September 15-20. The theatre has operated in this
location for the past eight summers.
The theatre has operated in the same location since the summer of 1986 and is
in large part resonsible for the reclaimation of the area. The first summer a group of
theatre volunteers undertook a cleaning and planting project which resulted in the
Art Park. The theatre tent is consistent with the Master Plan for the Rio Grande Parcel.
Representatives of Theatre in the Park have worked closely with Leslie LaMont, the
Parks Department and the planning committee for the area to ensure that the theatre
is compatible with the neighborhhood and the uses envisioned for the Rio Grande
parcel. The theatre has operated in the same location for the past 8 summers with
minimal, if any, impacts and has been compatible with the surrounding neighborhood.
Theatre in the Park will erect the same attractive white tent as last summer. The
tent has interior structural supports of aluminum. A platform was built to provide for
seating and the stage which was stored on site for the winter. A platform to house
the lighting equipment as well as partitions will be constructed inside the tent. A
propane heating system which was installed last summer will also be in use. The
shed for the portable restroom facilities remains. An attached site plan shows the
square footage and location of the tent and facilities.
The attached site plan shows the location of the theatre tent which is
approximately in the center of the park below the parking facilitiy. The location of the
tent is such that it is accessible by public transportation, pedestrian/bicycle traffic and
by automobile with adequate parking at the city parking garage. There will not be
parking available next to the theatre, but we do request at least 3 spaces be available
for delivery vehicles necessary for nightly operation of the theatre and to provide for
handicapped parking.
Theatre in the Park, together with the Aspen Art Musem located across the river,
the Art Park, the walking trails and the tranquility of the residential area along with the

activities of the other facilities has brought a revitalization to the long neglected Rio
Grande parcel. The Rio Grande Park has become an activity center combining the arts
and outdoor activities while connecting the town with the river.
