SUMMARY: Pursuant to Ordinance 5, Series of 1992, the applicant,
Aspen Theatre in the Park (Theatre Company) has submitted an
application for the temporary use of the Rio Grande property for
a theatre tent for their summer season. Ordinance 5, Series of
1992, provides for the review of a land use as a temporary use by
the city Council.
PREVrOUS COUNcrL ACTrON: Last fall, Council directed staff to
prepare a Master Plan for the Rio Grande property. The Theatre
Company would like to expand their facilities for this season
before the Master Plan is adopted. Staff developed the Temporary
Use Permit to provide a mechanism for Council to review land uses
that are of a temporary nature.
Council approved first reading of Ordinance 37, Series of 1992 at
the May 11, 1992 meeting.
BACKGROUND: The Theatre Company seeks to set up a tent to serve
as a temporary facility to produce live theater from May 26, 1992
to September 20, 1992.
In 1986, after four years of performances in the basement of the
Hotel Jerome, the Artistic Director of the Theater Company
approached the City Council with a request to set up a summer tent
on the Rio Grande property. For the past six summers the yellow
and white tent has been set up on the Rio Grande property for live
theater.
Although a performing art center is a permitted use in the Public
zone district (which is the underlying zoning of the Rio Grande
property) the dimensional requirements are established by the
adoption of a conceptual and final development plan. Currently,
a SPA Master Plan effort is underway to determine the appropriate
land uses for the Rio Grande property. 'Upon adoption of the
conceptual plan, specific land use entities will need to submit for
a Final SPA review and approval where specific dimensional
requirements will be set.

The Theatre Company plans to upgrade the current facilities with
a larger tent, improved flooring and electrical needs. A lighting
stand is proposed that will also serve as a storage shed when the
tent is dismantled. (The permanent shed will be reviewed during
the Master Plan effort.) In order to allow the Theatre Company to
expand the facility without the Master Plan in place, a temporary
use permit and review is necessary for the new tent for this summer
until the Master Plan is completed.
CURRENT ISSUES: Prior to the establishment of the theatre tent and
even as late as last year, the Rio Grande property was home to the
snow dump, impound lot, and storage for various buses, vans and
large equipment.
According to the application, the presence of the theatre tent for
the last six summers has helped to bring together a group of
volunteers to begin the reclamation of the property. There have
been major improvements including the Art Park revegetation effort
and the establishment of a kayak course.
Please see attachment B for Review standards for a Temporary Use.
FINANCIAL IMPLICATIONS: The Theatre Company will bear all costs
for assembly and disassembly of the facility. The Council has
supported the Theatre Company's endeavors for at least six years
at budget time and has provided in-kind support by granting the use
of the Rio Grande site for the tent.
RECOMMENDATION: Staff recommends approval of the temporary use for
the use of the Rio Grande property for a theater tent by the Aspen
Theatre in the Park with the following conditions:
1. The duration of this temporary use shall be from May 26, 1992
to September 20, 1992, with four performances a week.
2. Hours of performances will be approximately 8-10 pm, with
performances four nights a week.
3. Rehearsal hours will range from approximately 6-9 pm., six
nights a week, except for the two "tech weeks" (June 22-29 and July
28-August 4) when use of the tent may go until midnight.
4. The size of the tent shall not exceed 60' x 80' and 26' in
height.
5. The Aspen Theatre shall assume all costs associated with
erecting and taking down the theatre facility.

The Aspen Theatre in the Park is in the process: of preparing an
'application for a Temporary Use Permit to set up the summer theatre
tent on the Rio Grande property. .
This is the sixth season for the Aspen Theatre Company on the Rio
Grande property. The Theatre is one of the land uses that has been
incorporated into the Rio Grande Master Plan effort. However,
final adoption of the Master Plan is not anticipated until mid-
summer and the curtains must go up. Therefore the Theatre Company
is filing for a temporary use permit to establish the tent in time
for the beginning of their summer season.
The tent is located on the lower portion of the Rio Grande
property. It is necessary for Council to grant permission to the
Theatre Company to file a development review application on City
owned property.
RECOMMENDED MOTION: "I move to direct the city Manager to grant
permission for the Aspen Theatre Company to apply for a Temporary
Use Permit for a theatre tent on the Rio Grande property."

that a mechanism should be developed to allow the Theatre Company
to apply for temporary status until the Master Plan for the Rio
Grande property is completed. Staff developed the Temporary Use
Permit to provide a mechanism for Council to review land uses that
are of a temporary nature.
BACKGROUND: The Theatre Company seeks to erect a tent to serve as
a temporary facility to produce live theater from May 26, 1992 to
September 20, 1992.

conceptually approve certain land uses for the property. Upon
adoption of the conceptual plan, specific land USe entities will
need to submit for a Final SPA review and approval. The Theatre
Company will need a temporary use permit for this summer's
production as the Master Plan will not be completed until mid-
summer.

Pursuant to section 24-7-1203 the following review criteria shall
be considered for all temporary uses:
A. The location, size, design, operating characteristics, and
visual impacts of the proposed use.
RESPONSE: Please see the attached plans for the tent. The
Theatre Company will be erecting a new tent this summer. The
tent will be approximately 60' X 80' and 26' in height. The
tent will seat about 100 patrons and provide needed storage
space.
The proposed temporary use will operate from June 3
September 20, 1992. Performances will occur four nights a
week from 8-10 pm. beginning June 30, '1992. Rehearsal hours
will range from approximately 6-9 pm., six nights a week.
"Tech week" (sound and light set-up) will occur June 22-29 and
July 28-August 4. During those weeks the tent will be used
up until 12 midnight.
The existing access road that is used during the winter for
the snow dump operation will provide access for all service
and deliveries to the theatre.
B. The compatibility of the proposed temporary use with the
character, density and use of structures and uses in the immediate
vicinity.
RESPONSE: The Rio grande property is zoned Public with an SPA
overlay. The Master Plan process has recognized an Art
oriented theme "for this property. The combination of the Art
Museum across the river with the Art Park and Theatre tent
promote the use of this property for the arts. The Theatre
Company is a compatible use with the Art Theme that has been
endorsed by the Rio Grande Group (spearheading the Master Plan
effort) .

Grande playing field has been encouraged until the valley wide

C. The impacts of the proposed temporary use on pedestrian and
vehicular traffic and traffic patterns, municipal services, noise
lev~ls, and neighborhood character.
RESPONSE: The location of the ';I'heatre tent is within walking
distance of the parking garage and until conceptual adoption
of the Master Plan there is adequate parking for service and
patron parking on the .site. The Theatre uses temporary toilet
facilities but hopes to pursue permanent facilities if final
SPA approval is received. In addition, the theatre is in the
center of the City and very accessible to bikes and
pedestrians.

site for six summers, there was never a formal review process
in place for Council and staff's review. The Theatre Company
has received funding from the City and causal consent to use
the property for approximately 6 years.
The Theatre Company will soon start building the floor of the
tent and will begin rehearsals June 3, 1992. Opening night
is scheduled for' June 30, 1992. The Theatre has requested a
temporary use permit from May 26, 1992 to September 20, 1992.
E. The purposes and intent of the zone district in which the
temporary use is proposed.
RESPONSE: The purpose of the PUblic zone district is to
provide for the development of governmental and quasi-
governmental facilities for cultural, educational, civic, and
other governmental purposes.
Because of the public and cultural nature of this area and the
location in the center of the community, staff supports this
temporary use.
F. The relation of the temporary use to conditions and character
changes which may have occurred in the area and zone district in
which the use is proposed.
RESPONSE: The Theatre Company is becoming an integral part
of the entire enhancement program of this site. During the

a theatre tent to be an appropriate use for this site.
G. How the proposed temporary use will enhance or diminish the
general.public health, safety or welfare.
RESPONSE: This temporary use will provide an additional
cultural amenity for this site. The tent provides a casual
evening use along the river adding vitality to a public space
that has been so abused. Aspen Theatre in the Park should do
nothing but enhance the general public health, safety or
welfare of this community.

The Aspen Theatre in the Park began in 1982 as Theatre Under the Jerome,
later becoming the Aspen Theatre Company. In 1986 ,i'finding itself as a
theatre without a stage, Kent Reed, Artistic Director, approached
Aspen City Council with a request to erect a tent on the snowdump at
the Rio Grande site. Permission was granted and the yellow and white
tent went up for the first summer season. A tradition began and fbr
the past six summers the yellow and white tent has been erected and
live theatre is a part of the Aspen summer eultural program.
Prior to the presence of the tent on the snowdump, the Rio Grande area
was a barren waste land which was home to the snow dump, the impound
lot and a free storage lot for various buses, trucks and pieces of large
equipment not in use by their owners. Trees and vegetation along the
river were dying because of the neglect and abuse of the area.
The presence of the theatre brought together a group of volunteers to
begin the reclaimation process which resulted in the Art Park, a
beautifully landscaped area of Which the theatre tent is the center.
The area, during the past five years has seen major improvements with
the construction of the City Parking Facility, Aspen Youth Center, the
Pitkin County Library and most recently the beginning of the regrading
of the Roaring Fork River bank and the construction of the kayak course.
The Aspen Art Musem located across the river, the Art Park, the walking
trails and the tranquility of the residential area together with the
activities of the other facilities has brought a revitalization to the
long neglected Rio Grande parcel. The tent erected by Aspen Theatre in
the Park has created the impetus for the redevelopment of the Rio Grande
and its presence will continue to be a positive addition which will make
the Rio Grande Park an activity center combining the arts and outdoor
activities and connecting the town with the river.
The location of the theatre tent is shown on the attached site map and
is approximately in the center of the park, below the parking facility.
The location of the tent is such that it is easily accessible by public
transportation, pedestrian traffic and by automobile with adequate
parking available at the city parking garage. Some parking is
available at the tent, but is discouraged except to vehicles necessary
to the operation of the theatre. The theatre has operated in the
same location for the past six summer seasons with minimal, if any,
impacts and has been compatible with the surrounding neighborhood.

Theatre in the Park will be erecting a new tent this spring which was
described to City Council in the fall 1991 and City Council agreed
would be appropriate for the area. The tent will have interior structural
supports of aluminum. A platform will be constructed to provide for
seating and a stage. A platform to house the lighting equipment will
be constructed as well as partitions and some storage areas. The tent
is made of a white opaque material and will be an attractive addition
to the area.
A temporary permit is requested for a period of 5 months. The construction
of the platform and erecting of the tenrt will commence May 15 and the
dismantling will be September 15 _ 20.

Aspen Theatre Company, a non-profit organization performing
c01lllllunity services within the City of Aspen (hereinafter "Aspen
Theatre Company").
R E C I TAL S
1. Aspen Theatre Company performs the following co~~unity
services in 1992:
The Aspen Theatre Company was founded to provide our c01lllllunity and
visitors with a year-round, quality professional resident ensemble
acting company made up of primarily local theatrical talent.
2. Recognizing the benefit of the services performed by
Aspen Theatre Company, the City desires to contract with Aspen
Theatre Company, on the terms and conditions hereinafter set forth.
NOW, THEREFORE, in consideration of the mutual covenants and
agreement contained herein, the parties agree as follows:

In consideration for Aspen Theatre Company providing
services set forth hereinabove, the City grants, for
services, the following amounts:

CONDITIONS OF GRANT
The grant herein is subject to compliance by Aspen Theatre
Company with the following conditions:
a. The grant will be expended solely for the provision of the
services hereinabove identified.
b. Aspen Theatre Company will consult with the City with
regard to the services for which the grant is to be expended.
c. Within 30 days of June 30th and December 31st of the
fiscal year, Aspen Theatre Company shall furnish the City BUdget
Supervisor in such reasonable detail as the City may require, an
accounting of the expenditure of the .grant.
d. Any deliberations and/or decisions involving the use of
city of Aspen funds must be conducted in a pUblic meeting.
