The Planning Office recommends approval of the temporary use permit Y(j. for Colorado Riff Raft from May 1, 1995 to October 31, 1995. PREVIOUS COUNCIL ACTION: Last year City Council approved the use ob ULL, of Lot 3 of the Aspen Mountain PUD as Riff Raft's staging area from June to October 1994. The applicant is seeking use of a different site for this season. BACKGROUND: The Applicant has been in business in the Aspen area since 1979. The rafting vehicles and equipment have been stored in different parts of Aspen since the inception of the business. Rafting equipment has been stored at the Aspen Highlands base area, a property at Race and Spruce Street, the Little Nell Hotel site, and the top of Mill Street. The applicant has been unable to use any of these past sites for this summer's rafting season and is therefore seeking City approval to use the site at the corner of Juan and Aspen Street. A copy of the application is included in Exhibit "A". CURRENT ISSUES: There is one letter of objection to this request and two letters of support. These letters are included as Exhibit "B". FINANCIAL IMPLICATIONS: There are no discernable public costs associated with this temporary use request. STAFF COMMENTS: Please refer to the application information (Exhibit "A") for description of the proposal. Review criteria and staff response are attached as Exhibit "C". The applicant shall manage and conduct its activities as allowed under this temporary use permit in such a manner so as to not create or allow a public nuisance as defined at Section 13-89 of the Municipal Code and or Section 16-13-304 (1)(a) of the Colorado Revised Statutes, and applicant shall not create or allow noise levels in excess of those permitted levels as set forth at Section 16-4 of the Municipal Code. 5. All representations that are made within the submitted application and at the public hearing are incorporated herein and shall be adhered to. 6. Failure to comply with the above conditions of approval or representations made within the application and at the public hearing shall be cause for the suspension of the temporary use permit. If equipment is to be washed there is suitable area on the site to absorb the water. Any utilities if installed would by on easement of property and not on public property. A trash dumpster will be located on the site. This will be on private property. There will be no customers meeting at the site and employees will park on the property. We have purchased a bicycle rack as most of the guides ride to work. I have read the letter from Coates, Reid & Waldron written by Michael L. Spalding. The big concern about guest parking is not a problem due to the fact that our clients are picked up at Hotels and/or meet us at our office -at the base of the Gondola at 555 East Durant. They are on the other side of the Mine Dumps apartments and sound would not travel that far under any circumstances. Willoughby Park is located across the street from this location. The Rafting company is not allowed to use the Park's parking area for their customers. The Transportation Department has signed the area for 2 hour parking but the applicant should be made aware of this restricted parking and advise their customers and employees accordingly. Colorado Rift Raft is also prohibited from depositing any trash or debris into the Park's litter barrels. This also applies to the Ski Club's dumpster unless prior arrangements are made with the Ski Club. Although there are no conditions of approval, the applicants need to keep the following concerns in mind. A copy of the ordinances may be obtained through this Department. AIR QUALITY: Sections 11-2.1 "It is the purpose of [the air quality section of the Municipal Code] to achieve the maximum practical degree of air purity possible by requiring the use of all available practical methods and techniques to control, prevent and reduce air pollution throughout the city..." The Land Use Regulations seek to "lessen congestion" and "avoid transportation demands that cannot be met" as well as to "provide clean air by protecting the natural air sheds and reducing pollutants". The applicants need to comply with Ordinance No.74, Section 11.2.70 which refers to engine idling. It is unlawful to permit the idling of a motor for more than 5 minutes within any one hour period of time. The applicants should be considerate of the neighborhoods that surround the parking lot located on the corner of Juan and Aspen Streets. This is the parking lot across from The Skiers Chalet restaurant. We need a place to park our buses, vans, trailers and equipment for river rafting operations in Aspen. We need to inflate and deflate some rafts, rig up paddles, life jackets, throw lines, and other equipment for our trips. We are the only raft company be based in Aspen. It is very important for the guests of Aspen to have a quality river trip that they expect from this community. This can be accomplished by having our equipment located near our main office. The size of the area is about as large as two tennis courts. Our guides report at 6:30am to put together the trips. We will finish by 8:30am. The afternoon trips have the guides report at 11:30am and depart at 12:30pm. The trips return between 4pm and 6pm and all guides will finish by 7:00pm. Periodically we have to be on site throughout the day for logistics and maintenance. The visual and audio effects are at a minimum due to the bushes around the site. The impact is minimal to the neighborhood. Sound will be minimized as the buses will park in a perimeter around the lot. This will prevent sound from escaping the area. There is very little traffic at this site due to the dead end of the street at Lift IA. There is very little if any pedestrian traffic as well. The vehicles will drive up Aspen Street from Durant about 1 block. We will not use any permanent structures. The neighborhood character will not change as this site has been a parking lot. We will sweep this lot and keep it clean and improve the image of the lot. This proposal will not increase the density in any way. This temporary use would allow us to respond more efficiently to hotels and locals in need of spontaneous river trips. I have included a few letters from the neighbors that approve of the variance and use. The gentleman from the Holland House gave me a verbal OK. The Aspen Ski Club will meet in April and they will give me a letter after that meeting. We have been in the rafting and outdoor activity business since 1979. ASPEN, COLORADO 81611 (303) 925-1670 Lis C,4 i (-� ✓�S Rc LE�� Exhibit C Section 24-7-1203 Review Standards for a Temporary Use Permits When considering a development application for a temporary use, city council shall consider, among other pertinent factors, the following criteria as they, or any of them, relate thereto. A. The location, size, design, operating characteristics, and visual impacts of the proposed use. Response: Colorado Riff Raft is proposing to store 17 vehicles, 25 rafts and six trailers on the level portion of the site. The vehicles include seven buses, eight vans, and one mini -bus. This site is about 18,000 sq. ft. in size. The proposed temporary use will operate from May 1, 1995 to August 31, 1995, with some use of the site until October 31, 1995. Raft guides will begin raft preparation between 6:30am and 8:30am. This consists of loading rafts onto trailers, loading paddles, lifejackets, and safety equipment into the vehicles. There will also be a preparation period between 11:30am and 12:30pm. Rafts and equipment will return to the site between 4:OOpm and 6:OOpm. Upon return vehicles are cleaned out. There will also be some periodic maintenance and logistics taking place on the property throughout the day. No raft customers will be at this site. Visual impacts will be negligible due to an existing stand of trees between the site and neighboring properties. B. The compatibility of the proposed temporary use with the character, density and use of structures and uses in the immediate vicinity. Response: The property is zoned R-15A and is surrounded by the Conservation zone district on Aspen Mountain and the L/TR zone district to the north. There are several condominium projects to the north, the closest being about 100 feet away and at a lower elevation. The Juan Street Affordable Housing project is adjacent to the site. C. The impacts of the proposed temporary use on pedestrian and vehicular traffic and traffic patterns, municipal services, noise levels, and neighborhood character. Response: The location of the storage area is part way up Aspen Street across the street from Skiers Chalet. The project will not require any municipal services to be extended to the site. Traffic to the site will have a minimal impact on vehicular and traffic patterns in this area of town. • • Noise from the proposed use should be negligible due to the natural vegetative screening and the low impact of the storage and loading of rafting equipment. The surrounding uses are primarily lodging accommodations, an affordable housing project, and the recreational nature of Aspen Mountain. Colorado Rift Raft serves Aspen's visitors and locals for commercial rafting operations. D. The duration of the proposed temporary use, and whether a temporary use has previously been approved for the structure, parcel, property or location as proposed in the application. Response: Colorado Riff Raft has stored their equipment at the Aspen Highlands base area, however, this site will not be available this year due to proposed construction activities. The applicant has also been storing equipment near the Smuggler Tennis Club for several years, but that site is no longer available. Last year the applicant obtained approval from City Council to use the Ritz Carlton construction staging site at the top of Mill Street. E. The purposes and intent of the zone district in which the temporary use is proposed. Response: The purpose of the R-15A zone district is, "to provide areas for long term residential purposes with customary accessory uses. Recreational and institutional uses customarily found in proximity to residential uses are included as conditional uses." Because of the lodging and recreational nature of this area and the separation this site has with neighboring residential properties, this temporary use seems to be compatible with the area. F. The relation of the temporary use to conditions and character changes which may have occurred in the area and zone district in which the use is proposed. Response: The use is compatible with the neighboring L/TR zone district and serves the local and visitor population of Aspen. G. How the proposed temporary use will enhance or diminish the general public health, safety or welfare. Response: Storage of rafting related equipment of a local business should do nothing but enhance the general public health, safety or welfare of this community.
