Subdivision/Pud Dear City Council Members, On behalf of the condominium associations we manage that border Mill Street - Summit Place, Aspen Mountain Condominiums, Fasching Haus, Alpenblick Townhomes, and Fifth Avenue Condominiums, we would like to note our concern about traffic noise on Hill Street from Colorado Riff-Raft vehicles. We have heard from members of the :aoard of Managers of two of these Associations that between the hours of 6:30 a.llI. and 7:30 a.m., they counted a total of 15 oars and buses driving up Mill Street on behalf of Riff-naft, to park employee vehicles in Lot 3 of the Aspen Mountain Subdivision/pud as approved by counoil earlier this summer. The noise from 15 vehicles at that hour of the morning woke up and disturbed residents. Upon being contacted by the Planning Office, Rift-Raft owner L.J. Erspamer was extremely cooperative and helpful in working out a potential solution totha traffic noise problem. His plan was to redirect his employees to drive up Monaren Street instead of Mill. A test of this plan the next day appeared successful. We found L.J. to be most willinq to work on a solution to mitigate traffic noise impacts on the neighbors, and will certainly oall him directly should we have further prOblems. However, we would li~e Council to be aware that there have been traffic noise impacts on the Hill street neighbors, should We not be able to WOrk out any future Problems with L.J. directly. Galena Aspen, CO 81611 Dear Mary, We have recently been contacted by Bruce Hansen who lives on Mill St. Bruce was at the city council meeting that approved the use of the parking area at the top of Mill St. Bruce told my office manager on Thursday July 7, 1994 that there was continual noise in the morning and people tearing up and down the street always hurrying. Bruce stated that they thought it would be benign and if they knew then what they know now they wouldn't have allowed it. He also stated that if we were planning to be in the same location next year we would be mistaken or words to that affect. He also stated he didn't want it to turn into a major issue and would like us to do something about it now. I tried to call Bruce during the day but his phone was busy. Later on Thursday I called Bruce and he also made several accusations and used the word" we" when he referred to what he was going to do. He stated that there was a great deal of noise. I asked Bruce if he could hear us up on the site. He said no that it was the guides going up the hill to work in the morning. Bruce also stated that a vehicle drove up the hill every 5 minutes from 6:30 until 7:30. That was 12 vehicles an hour. I told Bruce that I would take care of the problem immediately. I said the guides would drive up an alternate street in the morning, I said that we no longer would allow motorcycles up in the morning under any circumstances. I told Bruce if that didn't work we would have the guides walk to work after parking by Koch Park. Bruce stated that he didn't want the guides to have to walk to work and that an alternate route would work. The next morning I parked on the corner of Durant and Mill st. Not one was from our company. Our rafting vehicles did not come down unt i 1 7: 10. When it di d I was standi ng on the corner of Galena and Mill St. with Bruce. The van drove by with 3 rafts on it and Bruce sai d that it was so qui et that he woul d have no problem with rafting vehicles coming down. Bruce said it was just the vehicles gOing up hill. His exact words were "It was very quiet this morning and if this is how it is going to be I have no problems with it. He also said he would call Maxwell Aley and tell him that he, Bruce, is satisfied with what LJ has done and not to proceed with anything. Later in the day I stopped by the new triplex town homes on Summit on the west side of Mill St. and talked to Lee Corn. I introduced myself and told him I owned Colorado Riff Raft. I asked him if there were any problems. Sam showed me his bedroom window on Mill St. Sam said that if we could use an alternate route up Monarch and then Summit he would have no problem with that. Sam also stated that Bruce had contacted him. I to 1 d Sam if he had even the sma 11 est of prob 1 ems wi th us to contact me immediately. Sam said that he had never knocked on any door and that he woul d not start now. Thi s statement was in reference to making a complaint and his intent was that he would not complain about us. I then received a call from you, Mary. about Carol O'Reilly from The Aspen Snowmass LOdging Company contacting you, I immediately met with Carol and she mentioned that she had only two calls from people. I believe they were Sam Corn and Bruce. I told her our solution and she thought it was fine. I told her if she had the slightest problem to contact me immediately. She was satisfied that I had met with her and that I was so concerned. She said that there should be no further problem with us. . I have monitored the situation since July 7, 1994. I have not heard any noise or complaints. We are committed to cooperation with the neighborhoOd. The close neighbors have been very friendly and content. I have visited with them and they have absolutely no problems with our operation and they are 40 yards away!! I work every day and all day so I will continue to monitor the situation. You should be aware that there is a lot of traffic up to that site of private individuals. Some looking for the jeep road up Aspen Mountain, some motorcycles doing the same and a lot of other tourists just looking. This is not our traffic. This traffic and other local traffic gOing to work will most likely be confused as being our traffic. Mary, I have worked very hard to get along with the neighbors and we get along quite well. I do believe this concern was of only one person who campaigned to get others involved. I have addressed this situation and all parties have told me personally that they are satisfied with the resolution. The Planning Office recommends approval of the temporary use permit for Colorado Riff Raft from June 14, 1994 to October 31, 1994. PREVIOUS COUNCIL ACTION: This site was approved to be a construction staging area for the Ritz Carlton Hotel. BACKGROUND: The Applicant has been in business in the Aspen area since 1979. The rafting vehicles and equipment have been stored in different parts of Aspen since the inception of the business. Rafting equipment has been stored at the Aspen Highlands base area, a property at Race and Spruce Street, and at the Little Nell site. The applicant has been unable to use any of these past sites for this summer's rafting season and is therefore seeking City approval to use the site at the uppermost end of Mill Street. CURRENT ISSUES: use application, There are no issues associated with this temporary Staff's review is included as Exhibit "B". FINANCIAL IMPLICATIONS: There are no discernable public costs associated with this temporary use request. STAFF COMMENTS: Please refer to the application information (Exhibit "A") for description of the proposal. Review criteria and staff response are attached as Exhibit "B", RECOMMENDATION: The Planning Office recommends approval of the Colorado Riff Raft temporary use permit for the storage of rafting equipment and materials on Lot 3 of the Aspen Mountain Subdivision PUD, subject to the following conditions: 1, The duration of this temporary use shall be from June 14, 1994 to October 31, 1994. 2. Raft guides may be on-site from 6:30am to 7:30pm. ~ ~ 3. No raft customers are permitted at this site. 4. The applicant shall manage and conduct its activities as allowed under this temporary use permit in such a manner so as to not create or allow a public nuisance as defined at Section 13-89 of the Municipal Code and or Section 16-13-304 (1) (a) of the Colorado Revised Statutes, and applicant shall not create or allow noise levels in excess of those permitted levels as set forth at Section 16-4 of the Municipal Code. 5. All representations that are made within the submitted application and at the public hearing are incorporated herein and shall be adhered to, 6. Failure to comply with the above conditions of approval or representations made within the application and at the pUblic hearing shall be cause for the suspension of the temporary use permit. We have been rafting in Aspen since 1979. It has been very difficult if not impossible to find a spot that is appropriate for our use. We are now the onlv rafting company left to have their main base in Aspen. We need to stage our river trips in Aspen to offer the local and guest the quality trips that Aspen has been known for. The size of the area would only be the flat area at the top of Mill Street. We wonld have our guides rig up trips starting at about 6:30am. The guides would all be gone by 9:00am. For the afternoon trips we would have to start to rig at about 1l:30am and be done by 1 :OOpm. The trips start to return at about 4pm and are finished at 7pm. Periodically we have to be on site throughout the day for logistics and maintenance. The visual and audio effects will be at a minimum due to the location. There are trees below the site to prevent any visual impact locally. The spot where the loading will be, is set back so sound will not carry. This will also prevent any visibility problems. This site is the bottom of the old Willoughby Ski Jump where there is nothing aroWld except the Winter Club building. There is no vehicle traffic at the site as this is a dead end. There is very little if any pedestrian traffic as well. The vehicles will have to drive up South Mill Street from Durant Street. The few trips a day up this street will not cause an impact of any sort. We will not use any structures that are permanent. The neighborhood character would not be changed as there is very little visibility of the site. This proposal will not increase the density in any way either. We desire to be at this location in a full capacity through the end of August of 1994. We will have a limited operation through the end of October of 1994. This use is compatible due to the fact that we offer river trips to their clients. This is one of the top activity attractions for guests who come to Colorado. This usage wilI have no effect to the character of the area as this is the bottom of the ski area. This is what I believe to be the original parking area for use of the old sled-tow.. If we can use this area it wilIlower the amount of traffic coming into and out of Aspen during rush hour. This alone wilI be a great asset to the valIey by decreasing the polIution and traffic problems. In addition, this proposed temporary use would allow us to respond more efficiently to hotels and locals in need of spontaneous river trips. A. The location, size, design, operating characteristics, and visual impacts of the proposed use. Response: Colorado Riff Raft is proposing to store 17 vehicles, 25 rafts and six trailers on the level portion of the site, The vehicles include seven buses, eight vans, and one mini-bus. This site is about one acre in size. The proposed temporary use will operate from June 14, 1994 to August 31, 1994, with some use of the site until October 31, 1994. Raft guides will begin raft preparation between 6:30am and 9:00am. which consists of loading rafts onto trailers, loading paddles, lifejackets, and saftey equipment into the vechiles. There will also be a preparation period between 11:30am and 1:00pm. Rafts and equipment will return to the site between 4:00pm and 7:00pm. Upon return vehicles are cleaned out. There will also be some periodic maintenance and logistics taking place on the property throughout the day. No raft customers will be at this site, visual impacts will be negligible due to an existing stand of trees between the site and neighboring properties. B. The compatibility of the proposed temporary use with the character, densi ty and use of structures and uses in the immediate vicinity. Response: This parcel was used as a staging area for construction of the Ritz Carlton Hotel. It is well screened with natural vegetation and is physically separated from residential uses, No structures are proposed for the use. There will be a porta-pottie and a dumpster on site, The property is zoned R-15A and is surrounded by the Conservation zone district on Aspen Mountain and the L/TR zone district to the north. There are several condominium projects to the north, the closest being about 100 feet away and at a lower elevation. There are also two single family residences in the area and the winter Club building. c. The impacts of the proposed temporary use on pedestrian and vehicular traffic and traffic patterns, municipal services, noise levels, and neighborhood character. Response: The location of the storage area is at the end of Mill street, There is no through traffic. The project will not require - - any municipal services to be extended to the site. Traffic to the site will have a minimal impact on vehicular and traffic patterns in this area of town, Pedestrian use in this area can be handled by the sidewalks which are already in place which stop just below this parcel. Noise from the proposed use should be negligible due to the natural vegetative screening and the low impact of the storage and loading of rafting equipment, The surrounding uses are primarily lodging accommodations and the recreational nature of Aspen Mountain. Colorado Rift Raft serves Aspen's visitors and locals for commercial rafting operations. D. The duration of the proposed temporary use, and whether a temporary use has previously been approved for the structure, parcel, property or location as proposed in the application, Response: Colorado Riff Raft has stored their equipment at the Aspen Highlands base area, however, this site will not be available this year due to proposed construction activities. The applicant has also been storing equipment near the Smuggler Tennis Club for several years, but that site is no longer available, As part of the Ritz Carlton approvals, this site was used as a construction staging area for the hotel. E. The purposes and intent of the zone district in which the temporary use is proposed. Response: The purpose of the R-15A zone district is, "to provide areas for long term residential purposes with customary accessory uses, Recreational and institutional uses customarily found in proximity to residential uses are included as conditional uses." Because of the lodging and recreational nature of this area and the separation this site has with neighboring residential properties, this temporary use seems to be compatible with the area. F. The relation of the temporary use to conditions and character changes which may have occurred in the area and zone district in which the use is proposed, Response: The use is compatible with the neighboring L/TR zone district and serves the local and visitor population of Aspen, G. How the proposed temporary use will enhance or diminish the general public health, safety or welfare. Response: Storage of rafting related equipment of a local business should do nothing but enhance the general public health, safety or welfare of this community. 2 I""".
