Ordinance 5, Series of 1992, provides for the review of a land use as a temporary use by the City Council. ZONING: R-6, Medium -Density Residential COUNCIL GOALS: The review of this application is consistent with Council Goal # 14 - to develop a consistent and fair government so that citizens know what to expect from elected officials, employees, and government processes. PREVIOUS COUNCIL ACTION: Council approved first reading of Ordinance 7, Series of 1992 at the January 27, 1992 meeting. REFERRAL COMMENTS: Engineering: Having reviewed the above referenced application, and having made a site inspection, the engineering department has the following comments: 1. The applicant shall work with the City Electric Department concerning electric power requirements and safeguarding the neighborhood and the city electric system from power outages. 2. The site survey which was submitted is 20 years old. Applications generally require surveys that have been performed within the past 12 months. 3. The parking plan that was submitted was based on a 20 year old survey. The applicant did not provide a parking plan which matches the existing conditions today in 1992. The parking plan also showed stacked parking spaces which have not been approved in any • 0 previous applications that I know of. However, it would not be inappropriate to approve stacked parking for a temporary use. 4. It is suggested that a condition of approval be that there shall be no parking on city streets of production vehicles. Parking in general is a concern. It is desirable to ensure that the applicant does not produce greater on -street parking impacts than the neighborhood has experienced in the past. The applicant may need to utilize satellite parking such as at the city parking plaza. 5. Although it is not usual to ask this type of condition, perhaps the applicant would be willing to provide some open ended willingness to consider and remedy problems that might arise during the course of the use which are impossible to identify in advance. Police Department: The --Department did review the application and - commented that they did not foresee any traffic congestion problems. BACKGROUND: The applicant, Fall -Line Productions, has been working with the School District and the City of Aspen to secure an appropriate site for production offices, set construction and filming for a feature film. The applicant will be leasing the Red Brick School from the Aspen School District and requests a temporary use permit to utilize the building. Council reviewed the application at first reading of the ordinance. In response to Council's concerns and the conditions of approval that were recommended in staff's memo, Fall -Line Production has modified their proposal for the Red Brick School. The applicant will only use the school, on a consistent basis, 16 days out of their 95 day temporary use request. Six days will be spent filming and an additional ten are required for set-up and break -down. Hours of use will be limited from 9 am. to 7 pm. except when filming. During filming 24 hour access to the building is necessary. Fall -Line Production has leased the old Aspen Savings and Loan building for their office use. Because the temporary use request is for 95 days until June 15, 1992, Fall -Line does anticipate using the school on a minimal basis for storage type uses. However any activity outside of the 16 days necessary for filming will be on an ad -hoc basis and the company will adhere to the strict hours of operation, 9 am. to 7 pm., and restricted traffic routes. The 16 days will not occur all at once at the school but will be disbursed throughout the life of the temporary use permit. There will be many days when no activity occurs at the school. During the filming a shuttle van service drivers. When production trucks are parked behind the school, only 5 personal cars will be parked behind the school and vans will shuttle employees to and from the building. The production vehicles will only be on -site during the six days of filming. When filming does not occur at the school, only 20 cars will be allowed to park at the school. Please find attached a revised parking plan and a list of the production vehicles. 'According to the applicant, the list is inclusive but may not include every vehicle that is utilized. The trucks will only be parked at the school on the day of or the day before an actual day of filming. No truck engines will start before 7 am. and they will only ---idle for five minutes; --per - Ordinance 4, Series of 1992. As was discussed at the Council meeting, on -board generators will be used during filming on a 24 hour basis, if necessary. According to the applicant, their noise impact is negligent and should not create a noise problem for the neighborhood. Auxiliary power to the school will be supplied by a power drop from existing power sources and not from the traditional film generators. In addition, Fall -Line will provide a neighborhood hotline for any citizen that has a concern regarding the production of the movie. A security guard will be employed during those 16 days of high activity at the school. The applicant has provided a copy of an insurance policy showing a $2,000,000.00 policy for damage done to other people's property. PROBLEM DISCUSSION: The Red Brick School was used last year by the School District for kindergarten and first grade classes and the business offices. The total population of the school was approximately 250 (230 students, 10 full-time teachers, 5 special teachers, 3 business office employees, and 2 janitorial staff). In addition, the Yellow Brick School, which is located across the intersection from the Red Brick School, educated approximately 220 students with 17 faculty members. The schools were in session from 8:30 am to 3:15 pm. According to the applicant and school personnel, approximately 12 buses dropped off and picked up students at both schools. It is also estimated that 50 students were dropped off and picked up by car. A large percentage of faculty drove to the school and parked behind the gym of the Red Brick School. Together with trash and delivery service, and field trips, it is estimated that the total number of vehicular round trips were 160 vehicles per day. 3 9 • Both student and community related extra -curricular activities occurred in the school gymnasium. Barricades were set up daily to interrupt traffic in the vicinity of the two schools. Currently the Red Brick School is being used as office space and warehousing. Three employees utilize the offices and UPS and mail deliveries are made every day with larger deliveries occurring every 1-2 weeks. The Yellow Brick is now the site of the Early Learning Center, a ballet class, and gymnastics class. Approximately 80-100 people use the Early Learning Center, 50-60 students attend the gymnastics classes Monday, Wednesday and Friday and 20 students per day for ballet. Fall -Line Productions seeks to use the Red Brick School until June 15, 1992. The school will be used for - set construction, filming and minimal storage. All activities will be conducted indoors. Pursuant to Section 24-7-1203 the following review criteria shall be considered for all temporary uses: A. The location, size, design, operating characteristics, and visual impacts of the proposed use. RESPONSE: The proposed temporary use will not require any design or size changes to the building. To accommodate the parking in the rear of the building the play equipment will be removed from behind the Red Brick School. However the use will extend the hours of operation that have historically been in place at the school. According to the revised application, the production company's hours of operation will be from 9 am. - 7 pm. When there is filming within the building after 7 pm., black out windows will be used to mitigate light impacts on the neighborhood. All deliveries will•be conducted during the day. Shuttle vans will pick-up and drop-off employees. Access to the building will be from the rear entrance on the north side of the building. Garmisch Street will be the designated traffic route. The applicant has presented an accurate parking plan that is attached to this memo. Traffic routes, access to the property from the rear of the building and no on -street parking for Fall -Line employees will be strictly enforced. A twenty-four hour a day security guard will be employed during the 16 days of high activity to enforce those restrictions and help prevent curiosity seekers from interfering with daily operations. The school will continue to operate their business offices out of the Red Brick School. n u • B. The compatibility of the proposed temporary use with the character, density and use of structures and uses in the immediate vicinity. RESPONSE: A school is a conditional use in the R-6 zone district. There has been a school on this site since 1896. As was previously discussed, the school generated approximately 160 vehicular round trips per day and an estimated 250 people used the building. The applicant contends that the anticipated impacts to the neighborhood will be less than those experienced during the school's tenure. During peak production periods, approximately 50-60 people will be involved. "Peak" is the 16 days necessary to conduct filming at the site. Those 16 days will be disbursed throughout the life of the temporary use permit. However, it is anticipated that during the - ten days of set -up -and break. --- down less than 50 people will be on -site. C. The impacts of the proposed temporary use on pedestrian and vehicular traffic and traffic patterns, municipal services, noise levels, and neighborhood character. RESPONSE: The temporary use will serve for set construction (within the gym) , and the school gym will be used for filming. Most of the filming will be done off -site. According to the application, to mitigate impacts to the neighborhood, all personnel will be required to enter exclusively through the rear entrance on the north side of the building. The fenced area on the north side of the building will be used for employee parking. Production trucks will also park in this area when filming occurs at the school. According to the applicant, only six days of filming are anticipated to occur at the Red Brick School. The rest of the company's filming time will be spent at other locations throughout the valley. During peak period it is anticipated that as many as 18 production vehicles will be parked in this area with five personal cars. The applicant has committed that employees be brought on -site via a shuttle service. During those times when f ilming is underway, the company plans to park production vehicles and trailers behind the building in accordance with the attached parking plan. Please see attached list of production vehicles that will be used during filming. Although these trucks will not be moving on and off location during filming, as an additional precaution for the neighborhood, no trucks will arrive, depart or start their engines before 7 am. or after 7 pm. Engines will only be 5 allowed to idle for five minutes per Ordinance 4, Series of 1992. On -street parking will be discouraged. According to the application, all personnel will use shuttle vans. Five parking spaces will be available for personal cars in the parking area behind the school. Occasional loading and unloading of trucks into the gym may require loading from the front of the building. Trucks will only be allowed on the street for loading and unloading purposes. All traffic associated with Fall -Line Productions will access the building via Main Street north down Garmisch to the school. The land uses along this route are the Hotel Aspen, medical clinic, a fourplex, four single family residences and the Yellow Brick School. This route has been designated as the least disruptive to the surrounding neighborhood. In addition, the site is within two blocks of the Main Street bus routes and four blocks to the parking garage. The security personnel will assure that all traffic and parking restrictions are followed. All deliveries will access the property via the rear door on the north side of the building, except for those deliveries that cannot be controlled i.e. UPS, Federal Express. Trash containers will be provided and arrangements will be made for pick-up as required by either BFI or Pak 'Em. Because of the electrical needs of a film production the Company will use a power drop from existing power sources. On -board truck generators will run at all times. However, the applicant maintains that these units will have a minimal noise impact on the neighborhood. The trucks area quiet enough to allow filming to take place during their operation. The generators are contained within the trucks and are not dependent upon the trucks engines for operation. The applicant has revised the temporary use permit to use the school for 16 days of the temporary use permit. Only during the six days of filming at the school will the trailers, wardrobe, bathroom facilities and other large production vehicles be stationed behind the Red Brick School. There are 10 days needed for set-up and break -down at the school and during that time approximately 20 cars will be parked behind the school. D. The duration of the proposed temporary use, and whether a temporary use has previously been approved for the structure, parcel, property or location as proposed in the Application. 0 0 • RESPONSE: The request is from the date of approval through June 15, 1992. However, the applicant will only be using the school for 16 days. No temporary use has been previously approved for this site. E. The purposes and intent of the zone district in which the temporary use is proposed. RESPONSE: Public schools are a conditional use within the R- 6 zone district. Pursuant to the Section 24-5-201 of the Land Use Code: "The purpose of the Medium -Density Residential (R- 6) zone district is to provide areas for residential purposes with customary accessory uses. Recreational and institutional uses customarily found in proximity to residential uses are included as conditional uses. Lands in the Medium -Density Residential (R-6) zone district are generally limited to the original Aspen Townsite, contain relatively.. dense settlements of predominantly detached and duplex residences and are within walking distance of the center of the city." It is because of the residential nature and desire to preserve the integrity of the zone district that the applicant has proposed implementing mitigation measures to reduce the impacts to the surrounding neighborhood and has revised their application. Only set construction, filming and some storage a O on the site. The school will only be used for 16 days out of-�� day temporary use permit. Hours of operation shall be from 9 am. to 7 pm. except when filming. No trucks shall be parked behind the school unless it is during the six days of filming at the school and then the trucks shall be stationary to the greatest extent possible. The designated traffic route down Garmisch has been chosen to reduce the traffic impacts on the neighborhood similarly with all access to the building being from the rear. F. The relation of the temporary use to conditions and character changes which may have occurred in the area and zone district in which the use is proposed. RESPONSE: Because the School District built the new schools at the Maroon Creek campus, both the Red Brick and the Yellow Brick Schools were closed after the 90-91 school year. The Yellow Brick has been converted into the Early Learning Center, plus gymnastic and ballet classes and the Red Brick School still retains some office and storage function. The applicant contends that the proposed temporary use with a peak of 50-60 people, 20 cars and 18 production trucks for 16 days will be a reduction of impacts experienced during school's operation which included approximately 250 people, 12 buses twice a day, and approximately 160 vehicle round trips per day. 7 • 0 G. How the proposed temporary use will enhance or diminish the general public health, safety or welfare. RESPONSE: This temporary use, if operated as outlined in this application and with close observance of staff recommendations, should not diminish the general public health, safety or welfare of this community. In addition benefits to the community include: an estimated 4 - 8 million dollars spent in the Aspen area by the production company, high school classes will study film making via an agreement between the School District and the production company, and an empty building is being utilized while the maintenance costs are being provided by the tenant. RECOMMENDATION]: Staff recommends approval of the temporary use -for the use of the Red Brick School -by Fall -Line Productions with the following conditions: 1. The duration of this temporary use shall be from February 10, 1992 to June 15, 1992, however, the school will primarily be used 16 days during the time period of this temporary use: six days of filming and 10 days to set-up and break -down from the filming. Some storage activity will occur at the site throughout the life of the temporary use permit. 2. Hours of operation shall be limited to 9 am. to 7 pm. seven days a week, except during the ix days of filming when hours of operation shall be 3. On -board truck generators may be allowed to operate without limitation at the school but only during the six days of filming. Power to the school for filming purposes will be supplied by a power drop from a nearby power sources. 5. All vehicles, including employee, production and catering vehicles, shall be parked behind the Red Brick School according to the submitted parking plan, Exhibit A. The applicant shall submit a letter, to be reviewed and approved by the City Council, that outlines the extent to which the building will be insured and the amount of protection for any damage to the building. 10. The applicant shall manage and conduct its activities as allowed under this temporary use permit in such a manner so as to not create or allow a public nuisance as defined at Section 13-89 of the Municipal Code and or Section 16-13-304-(1)(a) of the. Colorado Revised Statutes, and applicant shall not create or allow noise levels in excess of those permitted noise levels as set forth at Section 16-4 of the Municipal Code. 11. All representations that are made within the submitted application and at the public hearing are incorporated herein and shall be adhered to. 12. Failure to comply with the above conditions of approval or representations made within the application and at the public hearing shall be cause for the suspension of the temporary use permit. Given the concerns which were expressed by City Council, and my client's in-house discussions, it became apparent to us that the requirements which the City Council and Planning Office were requesting were not practical for a full three-month basis. We have, therefore, talked with the School Board to modify the agreement we have reached with them. We are now proposing the following use of the Red Brick School Building (the "School Building"). They will utilize three (3) fifteen -passenger vans, and two (2) seven -passenger vans which will be hired for this time period. Employees will be shuttled from the Inn at Aspen where the company is housing all of its out-of-town employees. Fall -Line will also shuttle certain employees from the public parking structure. The shuttles will be equipped with radios or walkie-talkies, and will run as often as necessary to fulfill the company's transportation needs. These shuttle vans will only use the Main Street to Garmisch Street approach to the School Building. During the time that preparation and filming is taking place at the School Building, and production trucks are parked in the rear parking area, no more than five (5) personal cars • • Ms. Leslie Lamont January 30, 1992 Page 2 may be parked behind the School Building. When production vehicles are not at the School Building, no more than twenty (20) cars will be allowed to park at the School Building. This list is inclusive, but may not include every truck being utilized. On -board truck generators will run throughout the day, as their noise impact on the neighborhood will be minimal. Power to the School Building for filming purposes will be supplied by a power drop from a nearby power utility pole, and not from the traditional film generators. Fall -Line Productions will provide a neighborhood hotline, not only for the neighbors, but for any concerns that citizens have throughout the city regarding our movie production. Enclosed please find a copy of our insurance policy which shows a $2,000,000.00 policy for damage done to other people's property, together with a supplemental letter from the insurance company. The applicant shall work with the City Electric Department concerning electric power requirements and safeguarding the neighborhood and the city electric system from power outages. 2. The site survey which was submitted is 20 years old. Applications generally require surveys that have been performed within the past 12 months. 3. The parking plan that was submitted was based on a 20 year old survey. The applicant did not provide a parking plan which matches the existing conditions today in 1992. The parking plan also showed stacked parking spaces which have not been approved in any previous applications that I know of. However, it would not necessarily be inappropriate to approve stacked parking for a temporary use. 4. It is suggested that a condition of approval be that there shall be no parking on city streets of production vehicles. Parking in general is a concern. The schools had some impact on on -street parking. It is desirable to ensure that the applicant does not produce greater on -street parking impacts than the neighborhood has experienced in the past. Ordinance 5, Series of 1992, provides for the review of a land use as a temporary use by the City Council. This is first reading of Ordinance, Series of 1992. ZONING: R-6, Medium -Density Residential COUNCIL GOALS: The review of this application is consistent with Council Goal # 14 - to develop a consistent and fair government so that citizens know what to expect from elected officials, employees, and government processes. PREVIOUS COUNCIL ACTION: Council adopted Ordinance 5, Series of 1992, January 15, 1992. REFERRAL COMMENTS: Due to the short time frame which staff has had to review this application, referral comments from Engineering and Environmental Health were unavailable. Their comments will be incorporated into the memo prior to second reading of the Ordinance. The Police Department did review the application and commented that they did not foresee any traffic congestion problems. BACKGROUND: The applicant, Fall -Line Productions, has been working with the School District and the City of Aspen to secure an appropriate site for production offices, set construction and filming for a feature film. The applicant will be leasing the Red Brick School from the Aspen School District and requests a temporary use permit to utilize the building. PROBLEM DISCUSSION: The Red Brick School was used last year by the School District for kindergarten and first grade classes and the business offices. The total population of the school was approximately 250 (230 students, 10 full-time teachers, 5 special teachers, 3 business office employees, and 2 janitorial staff). In addition, the Yellow Brick School, which is located across the intersection from the Red Brick School, educated approximately 220 students with 17 faculty members. The schools were in session from 8:30 am to 3:15 pm. According to the applicant and school personnel, approximately 12 buses dropped off and picked up students at both schools. It is also estimated that 50 students were dropped off and picked up by car. A large percentage of faculty drove to the school and parked behind the gym of the Red Brick School. Together with trash and delivery service, and field trips, it is estimated that the total number of vehicular round trips were 160 vehicles per day. Both student and community related extra -curricular activities occurred in the school gymnasium. Barricades were set up daily to interrupt traffic in the vicinity of the two schools. Currently the Red Brick School is being used as office space and warehousing. Three employees utilize the offices and UPS and mail deliveries are made every day with larger deliveries occurring every 1-2 weeks. The Yellow Brick is now the site of the Early Learning Center, a ballet class, and gymnastics class. Approximately 80-100 people use the Early Learning Center, 50-60 students attend the gymnastics classes Monday, Wednesday and Friday and 20 students per day for ballet. Fall -Line Productions seeks to use the Red Brick School until June 15, 1992. The school will be used for offices, set construction and some filming. All activities will be conducted indoors. Pursuant to Section 24-7-1203 the following review criteria shall be considered for all temporary uses: A. The location, size, design, operating characteristics, and visual impacts of the proposed use. RESPONSE: The proposed temporary use will not require any design or size changes to the building. To accommodate the parking in the rear of the building the play equipment will be removed from behind the Red Brick School. However the use will extend the hours of operation that have historically been in place at the school. According to the application, the production company's primary hours of operation will be from 8 am-8 pm. However twenty-four hour access into the building is necessary. If there is filming within the building after V, • 8 pm., black out windows will be used to mitigate light impacts on the neighborhood. All deliveries will be conducted during the day except shuttle vans may need to pick-up and drop-off employees after 8 pm or before 8 am. However, all access to the building will be from the rear entrance on the north side of the building. Garmisch Street will be the designated traffic route. The applicant will present a parking plan and route map for Council's review. Traffic routes, access to the property from the rear of the building and no on -street parking for Fall -Line employees will be strictly enforced. A twenty-four hour a day security guard will be employed to enforce those restrictions and help prevent curiosity seekers from interfering with daily operations. The school will continue to operate their business offices out of the Red Brick School. B. The compatibility of the proposed temporary use with the character, density and use of structures and uses in the immediate vicinity. RESPONSE: A school is a conditional use in the R-6 zone district. There has been a school on this site since 1896. As was previously discussed, the school generated approximately 160 vehicular round trips per day and an estimated 250 people used the building. The applicant contends that the anticipated impacts to the neighborhood will be less than those experienced during the school's tenure. The proposed use will initially require approximately 15 persons. During peak production periods, approximately 50- 60 people will be involved. "Peak" is estimated to begin February 10, ending about March 7. There may be a few "peak" days after March 7. C. The impacts of the proposed temporary use on pedestrian and vehicular traffic and traffic patterns, municipal services, noise levels, and neighborhood character. RESPONSE: The temporary use will serve primarily as the production office, set construction (within the gym), and the school gym will be used occasionally for filming. Most of the filming will be done off -site. According to the application, to mitigate impacts to the neighborhood, all personnel will be required to enter exclusively through the rear entrance on the north side of the building. The fenced area on the north side of the building will be used for employee parking. 3 Production trucks will also park in this area when filming occurs at the school. According to the applicant, only 6 days of filming are anticipated to occur at the Red Brick School. The rest of the company's filming time will be spent at other locations throughout the valley. During peak period it is anticipated that as many as 50 vehicles will be parked in this area. The applicant has committed that employee parking will be located off -site to accommodate the production vehicles and a shuttle service will bring personnel to and from the site. During those times when filming is underway, the company plans to park production vehicles and trailers behind the building in accordance with the attached parking plan. A catering truck, as well as trailers with additional restroom facilities will also be present. Although these trucks will not be moving on and off location during the filming, as an additional precaution for the neighborhood, no trucks will start their engines before 7 am and will only be allowed to idle for five minutes per Ordinance 4, Series of 1992. On -street parking will be discouraged. According to the application, all personnel will be directed to adhere to the parking plan represented in the application. Failure to abide by the restrictions may be grounds for dismissal. Occasional loading and unloading of trucks into the gym may require loading from the front of the building. But trucks will only be allowed on the street for loading and unloading purposes. All traffic associated with Fall -Line Productions will access the building via Main Street north down Garmisch to the school. The land uses along this route are the Hotel Aspen, medical clinic, a fourplex, four single family residences and the Yellow Brick School. This route has been designated as the least disruptive to the surrounding neighborhood. In addition, the site is within two blocks of the Main Street bus routes and four blocks to the parking garage. The security personnel will assure that all traffic and parking restrictions are followed. All deliveries will access the property via the rear door on the north side of the building, except for those deliveries that cannot be controlled i.e. UPS, Federal Express. Trash containers will be provided and arrangements will be made for pick-up as required by either BFI or Pak 'Em. Because of the electrical needs of a film production the Company will be using specially designed generator trucks. As outlined in the application, operations will not begin before 8 am which precludes the use of generators prior to that time. The applicant maintains that the trucks are quiet enough to allow filming to take place during their operation 4 thus assuring that the neighborhood will not be impacted by their noise. The generators are contained within the trucks and are not dependent upon the trucks engines for operation. Staff commends the applicant for developing an access and parking mitigation plan that should reduce the impacts upon neighboring residents. However, parking a significant number of trucks at this location during peak filming hours may create a disruptive situation that cannot be mitigated. Staff has discussed with the applicant the need to only park those vehicles at the school that are needed for the specific production activities during the "peak" period. Therefore the applicant has committed to park the larger vehicles that will not be necessary at the school at another off -site location. It is only during the 6 days of filming at the school that the trailers, wardrobe, bathroom facilities and other large production vehicles will be stationed behind the Red Brick School. D. The duration of the proposed temporary use, and whether a temporary use has previously been approved for the structure, parcel, property or location as proposed in the Application. RESPONSE: The request is from the date of approval through June 15, 1992. No temporary use has been previously approved for this site. E. The purposes and intent of the zone district in which the temporary use is proposed. RESPONSE: Public schools are a conditional use within the R- 6 zone district. Pursuant to the Section 24-5-201 of the Land Use Code: "The purpose of the Medium -Density Residential (R- 6) zone district is to provide areas for residential purposes with customary accessory uses. Recreational and institutional uses customarily found in proximity to residential uses are included as conditional uses. Lands in the Medium -Density Residential (R-6) zone district are generally limited to the original Aspen Townsite, contain relatively dense settlements of predominantly detached and duplex residences and are within walking distance of the center of the city." It is because of the residential nature and desire to preserve the integrity of the zone district that the applicant has proposed implementing mitigation measures to reduce the impacts to the surrounding neighborhood. To reiterate, hours of operation shall be from 8 am to 8 pm. No trucks shall be parked behind the school unless it is during the 6 days of filming at the school and then the trucks shall be stationary to the greatest extent possible. The designated traffic route down Garmisch has been chosen to reduce the traffic impacts 5 on the neighborhood similarly with all access to the building being from the rear. The primary intent of utilizing the Red Brick School is for office use related to the production of a feature film. F. The relation of the temporary use to conditions and character changes which may have occurred in the area and zone district in which the use is proposed. RESPONSE: Because the School District built the new schools at the Maroon Creek campus, both the Red Brick and the Yellow Brick Schools were closed after the 90-91 school year. The Yellow Brick has been converted into the Early Learning Center, plus gymnastic and ballet classes and the Red Brick School still retains some office and storage function. The applicant contends that the proposed temporary use with a peak of 50-60 people and 50 cars and trucks will be a reduction in the impacts from when the school was functioning with approximately 250 people, 12 buses twice a day, and approximately 160 vehicle round trips per day. G. How the proposed temporary use will enhance or diminish the general public health, safety or welfare. RESPONSE: This temporary use, if operated as outlined in this application and with close observance of staff recommendations, should not diminish the general public health, safety or welfare of this community. In addition benefits to the community include: an estimated 4 - 8 million dollars spent in the Aspen area by the production company, high school classes will study film making via an agreement between the School District and the production company, and an empty building is being utilized while the maintenance costs are being provided by the tenant at a substantial savings to the School District. RECOMMENDATION: Staff recommends approval of the temporary use for the use of the Red Brick School by Fall -Line Productions with the following conditions: 1. The duration of this temporary use shall be from February 10, 1992 to June 15, 1992. 2. Hours of operation requiring outside activity shall be limited to 8 am to 8 pm seven days a week. However, generators shall not start prior to 8 am. 3. All employee and production vehicles, which includes catering vehicles, shall be parked behind the Red Brick School according to the submitted parking plan, exhibit A. No production trucks shall 6 • be parked along: Garmisch Street, Hallam Street, or the alley along the east side of the building unless they are unloading materials into the gym. 4. No heavy trucks including semi -trailers shall be permitted at or around the site except for the 6 day period of filming in the school. Trucks shall not start their engines prior to 7 am and shall idle for no longer than 5 minutes pursuant to Ordinance 4, Series of 1992. 5. All Fall -Line Production related traffic shall travel the designated route which is Main Street to Garmisch Street to the school, exhibit B. 6. Except for the provision of condition number 3 above, all deliveries and access to the building shall be from the rear entrance on the north side of the building. 7. Windows of the school shall be blacked out during filming after 8 pm. 8. All representations that are made within the submitted application and at the public hearing are incorporated herein and shall be adhered to. 9. Failure to comply with the above conditions of approval or representations made within the application and at the public hearing shall be cause for the suspension of the temporary use permit. RECOMMENDED POINTS OF DISCUSSION: 1. The applicant states in the application that hours of operation will be from 8 am to 8 pm for outside activity. Although the school was a site of heavy activity, that activity was typically over by 4 pm and did not operate on the weekends. The application confirms that 24 hour access to the building is necessary. It could be anticipated that production crews would work round the clock and seven days a week. The impacts from traffic, pedestrians, vehicles leaving the site, delivery vehicles etc. very late at night is not consistent with the integrity of the residential zone district and is not within character of the neighborhood. Council may want to consider hours of occupancy in the building and limit work to week days. 2. The Temporary Use Ordinance does authorize Council to establish a financial security to assure that the applicant will be in full compliance with the conditions of the permit. The School District is considering similar provision with their Lease with Fall -Line Productions. 7 3. Staff requests the applicant to indicate the number of trucks necessary for filming at the school. Staff also would like the applicant to clarify why 50 vehicles will be parked on site when the company has stated that a shuttle service will be used. Staff does not support the full, maximum use of the playground for parking an extraordinary number of vehicles. 4. Staff requests that the applicant indicate the number of production vehicles that will be used at the school during both "peak" and non -peak periods. 5. Staff also requests that Council identify issues and concerns at First Reading in order for the applicant and staff to provide information and/or clarify any outstanding questions at Second Reading. The Applicant will be leasing the building, commonly referred to as the Red Brick School on Hallam Street, from the Aspen School District (owners of the property) for use as a production office and interior stage set during the filming of a feature film. Last year, the building was used by the School District for kindergarten and first grade classes, as well as the school business office, with a total population of approximately 250 (230 students, 10 full-time teachers, 5 special teachers, 3 business office employees, and 2 janitorial staff). — �----- -� Approximately 12 buses dropped students off at the school in the morning, and picked up students in the afternoon. In addition, it is estimated that 50 students were dropped off and picked up by car. A large majority of the faculty and staff also travelled to and from the campus by car, parking in the area behind the gym, in the area behind the business office, along the front of the building on Hallam Street, and on Garmisch Street. Regular trash pick-up, as well as occasional deliveries and field trips by bus generated some additional trips. The total number of round trips to and from the school each school day is estimated to have been 160 vehicle trips per day. A similar level of activity was ongoing at the yellow -brick school diagonally across from the site. In addition, extra -curricular activities occurred in the school gymnasium, which was utilized both by students and members of the community. Barricades were set up daily on Garmisch and Hallam to interrupt traffic in the vicinity of the two schools. The School building is presently being used on a limited basis by the School District for office space and storage of school equipment. The School District is submitting a letter'/ of consent to this application, which is attached hereto as Exhibit "C" and made a part hereof. On January 15, 19920, City Council adopted Ordinance No. 5, L Series of 1992, authorizing temporary land uses within all zone districts. Under Ordinance No. 5, Series of 1992, certain land uses may be permitted, if done solely on a temporary basis under certain specified conditions. Included in the Ordinance is a statement that "providing a procedure for the granting of temporary land uses would afford needed flexibility presently lacking in the Municipal Land Use Code that could be utilized to promote economic development, render relief in cases of hardship, and otherwise further the public health, safety and r, welfare". p 0 Ordinance 5 amends Article 7 of Chapter 24 by adding a new Division 12, "Temporary Uses". The ordinance describes temporary uses as "those uses or structures that may or may not be permitted in a given zone district, but which may be allowed on a non -permanent and temporary basis upon individual review of their proposed nature, location, duration, impact, and compatibility with surrounding permitted uses and structures, excepting outdoor merchandising or commercial displays which shall not be permitted as temporary uses." No temporary use shall be permitted except upon review and approval of the City Council in accordance with the procedures, standards and limitations set forth in Division 12. Sec. 7-1203 sets forth the criteria applicable to all temporary uses. When considering a development application for a temporary use, City Council shall consider, among other pertinent factors, the following criteria: A. The location, size, design, operating characteristics, and visual impacts of the proposed use. Applicant's Response: No exterior changes to the existing structure are anticipated under this application. Therefore, no visual impacts are contemplated, nor will any design or size changes be made to the existing structure. The operating characteristics of the building will change, but we believe that with the mitigation being proposed, the new use will actually lessen the impact on the neighborhood from that recently experienced from the school use. B. The compatibility of the proposed temporary use with the character, density and use of structures and uses in the immediate vicinity. Applicant's Response. While the zoning of the property is R-6, schools are uses which are permitted within the zone district. Attendant with such uses are heavy vehicular and pedestrian traffic. In addition, the outside activities of a large number of students creates noise impacts on the neighborhood. As mentioned previously, the school building has been used by the School District for kindergarten and first grade classes, as well as the school business office, with a total population of approximately 250 (230 students, 10 full-time teachers, 5 special teachers, 3 business office employees, and 2 janitorial staff). The proposed use will dramatically reduce the number of people utilizing the structure, and, in addition, will .mplement strict traffic controls, parking regulations, and noise curtailment. Twenty-four hour a day security will be present at the building to help assure the attainment of this goal. We believe our proposal will be much more suitable to the character and uses of the immediate vicinty than that which the neighborhood has traditionally experienced by the existence of the elementary school. - 2 - 0 • C. The impacts of the proposed temporary use on pedestrian and vehicular traffic and traffic patterns, municipal services, noise levels, and neighborhood character. Applicant's Response. The Applicant proposes to use the facility on a temporary basis as a production office and interior stage set during the filming of a feature film in the Aspen area. For the majority of the lease term, the facility will function as a production office. On occasion, the school gym will be used for filming, but for the most part filming will take place at locations off -site. Set construction will take place within the building, and the wardrobe department will also be housed in the building. Initially, a production staff and crew of approximately 15 persons will be on site. fl During the periods when filming is under way, use of the building may average 50-60 people for short periods. In order to mitigate the neighbors' concerns, all personnel will be required to exclusively enter from the rear entrance on the � north side of the building. Explicit instructions will be given to all employees to ensure that this requirement is adhered to. When the building is being used as a production office, the fenced area on the north side of the building will be used for staff parking. Trucks containing required equipment will also be parked in this area. During peak periods, as many as 50 vehicles will be parked in this area.. During those limited times when filming is under way on site, the fenced area will be utilized by production vehicles and trailers. A catering truck, as well as trailers with additional restroom facilities, will also be present. At that time, the Applicant has committed to arrange for off -site parking for other vehicles, and to arrange for a shuttle CJ) service to bring personnel to and from the site. The Applicant is further committed to provide 24-hour security personnel on -site. Included in the security staff's responsibilities will be to ensure that all foot traffic enters the building at the rear, that no parking takes place in front of the building, and to discourage curiosity seekers from milling around the building, or entering the building. n, On -street parking will be strongly discouraged. All personnel W " will be directed to adhere to the parking plan represented in this application. Failure to abide by the parking plan may be grounds for dismissal of offending employees. The only on -street parking which will be necessary is the occasional loading and unloading of trucks at the front entry of the gymnasium on Hallam Street. This will be necessary as this entry is required for some of the larger equipment which will be used during filming. Trucks will not be allowed on the street for extended periods of time. Once they are loaded or unloaded, they will either be moved to the fenced area at the rear of the building, or will move to the additional off-street parking areas Applicant is providing. �. - 3 - n•k" LAI' 0 • The primary hours of operation will be from 8:00 a.m. to 8:00 p.m. Twenty-four hour access to the building will be necessary. Whenever the building is used after 8:00 p.m., black -out windows will be utilized to mitigate light impacts on the neighborhood. All activities on -site will be conducted indoors. Any use of the building late in the evening will not generate noise which can be heard outside of the building. All vehicles operated by employees of Fall -Line Productions will be instructed to access the site via Main Street, and then north down Garmisch to the school, in order to minimize impacts on the neighborhood. Delivery services, such as UPS and Federal Express, will be requested to use this route, although the Applicant does not have complete control over these carriers. Existing uses along the Garmisch Street access route include the Hotel Aspen, the medical clinic, the yellow brick school, a fourplex, and four single-family residences. Designation of this route for vehicular access to the site will, therefore, assure that impacts on residential uses in the neighborhood will be minimized. The site is within two blocks walking distance of the Main Street bus routes, and is four blocks from the City parking structure which is accessible on foot either along Bleeker Street or the Post Office trail immediately to the north of the School site. Whenever trucks which are stationed in the school parking area are started before 8:00 a.m., their engine idling will be limited to 5 minutes. In order to avoid potential problems with the electrical system in the building, specially designed movie generator trucks will be used to supply the production's electrical needs during those times when filming is under way on -site, or when large amounts of electricity are needed. These trucks are quiet enough to allow filming to take place during their operation, thereby assuring that noise from these generator trucks will not be a problem for the neighborhood. Trash containers will be provided during the term of the lease, and arrangements will be made with the trash company for trash pick-up as required. At the conclusion of the lease, the exterior of the building will not look any different than it does today. The Applicant has agreed with the School District to return the interior of the structure to a condition comparable to that which existed at the beginning of the lease term. D. The duration of the proposed temporary use, and whether a temporary use has previously been approved for the structure, parcel, property or location as proposed in the Application. - 4 - 171 • Applicant's Response. The duration of the temporary use requested is from the date of approval through June 15, 1992. No temporary use has previously been approved for the property. E. The purposes and intent of the zone district in which the temporary use is proposed. Applicant's Response. The school site is presently zoned R-6. As stated in Sec. 5-201 of the City's land use regulations, the purpose of the R-6 zone is as follows: "The purpose of the Medium -Density Residential (R-6) Zone District is to provide areas for residential purposes with customary accessory uses. Recreational and institutional uses customarily found in proximity to residential uses are included as conditional uses. Lands in the Medium -Density Residential (R-6) Zone District are generally limited to the original Aspen Townsite, contain relatively dense settlements of predominantly detached and duplex residences, and are within walking distance of the center of the City." Public schools are listed as a conditional use in the zone district. F. The relation of the temporary use to conditions and character changes which may have occurred in the area and zone district in which the use is proposed. Applicant's Response. Until recently, the School District's use of the building has generated close to 250 people, plus extensive bus and car impacts on the neighborhood. The proposed use will dramatically reduce the number of people utilizing the structure, as well as the traffic impacts on the neighborhood. We believe that the proposed use will, in fact, be more consistent with the character of the neighborhood, and will be deemed a positive change to the building's traditional use. G. How the proposed temporary use will enhance or diminish the general public health, safety or welfare. Applicant's Response. This temporary use will have no negative impact on the general public, health, safety or welfare. It may have a positive effect on the City's opportunity to acquire the property. Sec. 7-1206. Procedure for temporary use approval. The hearing before the City Council shall be preceded by timely notice as specified in Section 6-205E(3) (a), (b) and (c) of Chapter 24 of the Municipal Code, and all hearings shall be conducted in accordance with the procedures set forth in Section 6-205C. - 5 - • 0 Sec. 7-1207. Application. A development application for a temporary use shall include the following information: A. The general application information required in section 6-202 of this Chapter.
