SUMMARY:
The applicant, L.J. Erspamer and Colorado Riff Raft, is requesting a temporary
use permit to store rafting equipment and vehicles on Lots 7-12, Block 11, Eames
Addition, City and Townsite of Aspen, which is located at the intersection of Juan
and Aspen Streets.
The Community Development Department recommends approval of the
temporary use permit for Colorado Riff Raft from May 1, 1997, to September 30,
1997, with conditions.
PREVIOUS COUNCIL ACTION:
Council approved this temporary use in this location for 1995 and 1996.
BACKGROUND:
The applicant has been operating this business in Aspen since 1979. He has used
several sites in Aspen for storage and staging of his equipment. This site has
proven to be better logistically than other sites.
The applicant has been approved for temporary use permits in the past for this site
and is proposing virtually the same operation this year.
CURRENT ISSUES:
No complaints were received last summer regarding Riff Raft's operation on this
site.
FINANCIAL IMPLICATIONS:
There are no discernible public costs associated with this request.
STAFF COMMENTS:
26.96.030 Criteria Applicable to all Temporary Uses
When considering a development application for a temporary use, City Council shall
consider, among other pertinent factors, the following criteria as they, or any of them,
relate thereto.
A. The location, size, design, operating characteristics, and visual impacts of the proposed
use.
Staff Finding=
Colorado Riff Raft is proposing to use this site to store approximately 20 vehicles
and 6 trailers with rafts. This site is approximately 18,000 square feet and is used
in the winter as a parking lot for Aspen Skiing Company employees.
Raft guides for the morning trips will be on site generally from 6:30 a.m. to 9:00
a.m. Raft guides for the afternoon trips will be on site generally from 11:30 a.m.
to around 12:30 p.m. The raft guides will return to the site between 4:00 p.m. and
6:00 p.m. All guides are expected to be finished by 7:00 p.m. Periodically,
guides will be on site for logistics and maintenance. No raft customers will be on
site.
The applicant should take appropriate measures to detain the effects of the
temporary use on site. Including, drainage from washing equipment, tracked
mud, parked vehicles, and any trash disposal containers.
B. The compatibility of the proposed temporary use with the character, density and use of
structures and uses in the immediate vicinity.
Staff Finding_
This property is zoned R-15 PUD. Zone districts in the immediate vicinity are
L/TR, PH, & AH1-PUD. The uses in the area are mostly residential and small
lodges. The applicant has worked with the neighbors to ensure they are not
disturbed by the operation. Letters of support are included as Exhibit "C."
C. The impacts of the proposed use on pedestrian and vehicular traffic and traffic patterns,
municipal services, noise levels, and neighborhood character.
Staff Finding:
The temporary use will have very little impact on the traffic patterns in the area.
The applicant should make proper arrangements with the Water Department for
water to be used. Noise levels are expected to be minimal and diminished by the
surrounding vegetation.
D. The duration of the proposed temporary use and whether a temporary use has previously
been approved for the structure, parcel, property or location as proposed in the
application.

Staff Finding_
The proposed temporary use will be from May 1, 1997, to September 30, 1997. A
temporary use permit was approved in for this use in this location in 1995 &
1996.
E. The purposes and intent of the zone district in which the temporary use is proposed.
Staff Finding
The purpose of the R-15 zone district is "to provide area for long-term residential
purposes with customary accessory uses." The site, however, is somewhat
separated form the surrounding uses, and the applicant has maintained a good
relationship with the neighbors. Due to these factors, Staff feels that this
temporary use is compatible with the area.
F. The relation of the temporary use to conditions and character changes which may have
occurred in the area and zone district in which the use is proposed.
Staff Finding,;
Because Colorado Riff Raft has support from the neighbors, Staff feels that this
temporary use is compatible with the area. The use is also compatible with the
surrounding L/TR zone district as they both serve the summer tourist market.
G. How the proposed temporary use will enhance or diminish the general public health,
safety, or welfare.
Staff Finding;
The storage of rafting equipment on this site will not diminish the public
health, safety, or general welfare. Successful local businesses enhance the general
public welfare.
RECOMMENDATION:
The Community Development Department recommends approval of the Colorado
Riff Raft temporary use permit for the storage of raft equipment and vehicles on
Lots 7-12, Block 11, Eames Addition, City and Townsite of Aspen, with the
following conditions:
1) The duration of this temporary use permit shall be from May 1, 1997, to
September 30, 1997.
2) Raft guides may be on site from 6:30 a.m. to 9:00 a.m., from 11:30 a.m. to
12:30 p.m., and from 4:00 p.m. to 7:00 p.m. Raft guides may be on site for
incidental reasons anytime between 6:30 a.m. and 7:00 p.m. No raft guides may
be on site between 7:00 p.m. and 6:30 a.m.
3) The applicant shall take appropriate measures to detain the effects of the
temporary use on site. Including, but not limited to, drainage from
washing equipment, tracked mud, parked vehicles, and any trash disposal
containers.
4) The applicant will make appropriate arrangements with the City Water
Department.
5) No customers of Riff Raft are permitted on site.
6) The applicant shall manage and conduct activities on site in such a manner
as not to create a nuisance, as defined in Section 15.04.520 of the
Municipal Code.
7) The applicant shall not create or allow noise levels in excess of those
permitted level as set forth in Section 18.04.040 of the Municipal Code.
8) The applicant shall comply with Section 13.08.110 of the Municipal Code,
which prohibits idling the motor of a stationary vehicle for more than 5
minutes within any one hour time period.
9) The applicant shall adhere to all representations made in the application
and in public hearings. Failure to comply with the conditions of approval
or representations made shall be cause for the suspension of the temporary
use permit.
PROPOSED MOTION:
"I move to approve Resolution No. o2002—for a temporary use permit for Colorado
Riff Raft to store rafting equipment and vehicles on Lots 7-12, Block 11, Eames
Addition, City and Townsite of Aspen."

[Site conditions at the time of site visit: 03/10/97; 2.5 ft snow pack with 3.5 ft drifts; most of paved
tennis court area (parking lot) had been plowed with drifts around the perimeter.]
After reviewing the above referenced application and making a site visit, I am reporting the
combined comments made by the members of the DRC:
1. Prior Approvals and Use: This applicant's previous use of the same location for the
temporary staging area for this seasonal rafting operation has not caused any complaints or
problems with the neighbors or general public that were brought to the attention of the
Engineering Dept.
2. Water Usage: The water department has requested that the applicants make proper
arrangements with the City Water Utility Dept. for the water used by the applicants.
3. Retention of Drainage and Trash Disposal: Any drainage flows generated on this
site (washing of rafts, vehicles, equipment, etc.) will need to be detained on the site and
preferably disposed of on the site rather than discharged on to S. Aspen Street. The
applicant shall take appropriate measures including installation of temporary mud racks, etc.
to prevent tracking mud or debris onto the City streets. Any trash disposal containers
should be kept on -site and not placed in the public right-of-way.
4. Vehicle Parking: Vehicle parking should be restricted to the parking lot and not
encroach on to the streets of the surrounding neighborhood.

The Aspen/Pitkin Environmental Health Department has reviewed the land use submittal under
authority of the Municipal Code of the City of Aspen, and has the following comments.
AIR QUALITY: Sections 11-2.1 "It is the purpose of the air quality section of the Municipal .Code] to
achieve the maximum practical degree of air purity possible by requiring the use of all available
practical methods and. techniques to control, prevent and reduce air pollution throughout the
City..." The Land Use Regulations seek to "lessen congestion" and "avoid transportation demands
that cannot be met" as well as to "provide clean air by protecting the natural air sheds and
reducing pollutants".
The applicant must comply with Ordinance No. 74, Section 11.2.70 which refers to engine idling. It is
unlawful to permit the idling of a motor for more than 5 minutes within any one hour period of
time. The applicant should be considerate of the neighborhoods that surround the parking lot
located on the corner of Juan and Aspen Streets.
NOISE ABATEMENT: Section 16-1 "The city council finds and declares that noise is a significant source
of environmental pollution that represents a .present and increasing threat to the public peace
and to the health, safety and welfare of the residents of the City of Aspen and it its visitors.
.....Accordingly, it is the policy of council to provide standards for permissible noise levels in
various areas and manners and at various times and to prohibit noise in excess of those levels."
Colorado Riff Raft will need to comply with Aspen's noise ordinance which restricts the decibel (dB)
level in the lodge district to 60 dB between 7:00 AM and 10:00 PM and 55 dB between 10:00 PM and
7:00 AM.

in Aspen. We need to inflate and deflate rafts, rig paddles, life jackets, throw lines and
other equipment for our trips.
We are the only raft company based in Aspen. It is very important for the guests that come
to Aspen to have a quality river experience that they expect while visiting this community.
This can be accomplished by having our equipment located near our main office in Aspen.
The size of the area is about as large as two tennis courts. Some guides report at 6:30am
while most report at 7:00am or later to prepare the trips. We will finish the preparations by
8:30 or 9:OOam. The afternoon trips will have the guides report at 11:30am and depart at
about 12:30pm. The trips return between 4pm and 6Fn and all guides should be finished
by 7:OOpm.
Periodically we have to be on site throughout the day for logistics and maintenance. The
visual and audio effects area at a minimum due to the bushes and shrubbery around the
site. The impact is minimal to the neighborhood. Sound will be minimized as the vehicles
will park in a perimeter around the lot.
There is very little traffic at this site due to the dead end of Aspen Street at the Lift 1 A
area. There is very little pedestrian traffic as well. The vehicles will drive up Aspen Street
from Durant about 1 block.
We will not use any permanent structures. The neighborhood character will not change as
this site has been a parking lot. We will Sweep this lot and keep it clean. This will improve
the area and the image of it. The proposal will not increase the density in any way.
We would like to start on location May 1, 1997. Our lease runs until September 30, 1997.
We have a renewal for 4 more years on our lease with the same dates for each summer.
The use of this lot will reduce the amount of traffic coming into and out of Aspen during
the day especially during rush hour. This will be a great asset to the community as it will
reduce pollution and traffic congestion.
This use would allow us to respond in a more affective manner to our guests and locals for
the spontaneous river trip.
I have included some letters from the neighbors that approve the Temporary use. We have
a very special relationship with the neighbors and will work very hard to continue to have
this special feeling.
We have been in the rafting and outdoor business since 1979. We started at the old base
of Little Nell. We have moved to several locations since Aspen has grown. This area has
proved to have the least impact and best reception with the neighbors than any other area.
I feel the Temporary Use permit is the best method for this area at this time.

A. This application shall not change any visual impacts or characteristics of the lot.
B. This site is compatible with the current usage.
C. There will be no change in traffic patterns. Noise levels will be a minimum. There will
be no increase in municipal services. The neighborhood character shall be the same. This
site will reduce traffic congestion by less traffic in and out of Aspen. Employees can bike
and walk to work rather than drive their car. There will be less traffic on Highway 82 if
this proposal is approved.
D. The duration is from May 1, 1997 until September 30, 1997. There will be no
structure on this property.
E. This proposal is compatible with the surrounding zone district as it adjoins the current
zoning district to which this proposal is applicable. The neighborhood has been receptive
and agreeable to our proposal and past usage.
F. The relation of the temporary use is compatible with current use as it is a parking lot.
G. The site is compatible to the community character and will not affect the general public
health, safety or welfare.

.AGREEMENT OF LEASE

This Agreement is entered into on this , c 3 — day of c 19� between Colorado Riff
Raft, Inc, ("CRR") and Aspen Skiing Company, dba Aspen M6dntain ("Aspen") for a term ending
September 30, 1996.
In consideration of the mutual promises set forth herein, the above -identified parties hereby agree as follows:
WHEREAS, Aspen is lessee of a parcel of property known as the Tennis Court Parking Lot ("Premises") on
Aspen Street.
WHEREAS, CRR wishes to sublet Premises for a period of time beginning May 1, 1996 through September
30, 1996 for the purposes of parking business vehicles and equipment. This lease is automatically renewed
annually for 5 years, until September 30, 2000. The parties hereto agree that, except as otherwise provided
herein. this lease shall be subject to the terms of said prime lease between The Aspen Skiing Company, and
Savannah Limited Partnership, including the termination and notice thereof provisions.
NOW, THEREFORE, Aspen agrees to sublet Premises to CRR for a total fee of $1,000.00, annually, due
and payable on ~1 / i I,-) W of each succeeding year.
CRR agrees to repair and/or replace any property damaged, as determined by Aspen, as a result of its use of
the Premises and, at the term of this contract, return Premises to its previous condition.
CRR further agrees to obtain all permits and licenses necessary for the use of the Premises.
CRR agrees to indemnify and forever defend and hold harmless Aspen from and against any and all
demands, claims, damages, causes of action, liability losses, law suits, expenses (including attorney's fees),
or claims of any kind, nature, or description, without limitation, whether foreseen or unforeseen, arising
directly or indirectly out of his use of the Premises and all related activities. CRR will name Aspen as an
additional insured on his Comprehensive General Liability Insurance Policy with limits of not less than
$1,000,000.00 per occurrence. A certificate of insurance will be provided. CRR also agrees to maintain
Workmen's Compensation insurance in accordance with provisions outlined by the State of Colorado.
This Agreement and all questions relating to its validity, interpretation, performance and enforcement shall
be governed by and construed in accordance with the laws of the State of Colorado, notwhithstanding any
Colorado or other conflict of law provisions to the contrary.
Neither party to this Agreement shall act as Agent for the other. Neither party shall have any authority to
assume obligations or liabilities or to act on behalf of the other party. The parties are not partners or joint
venturers in performing this Agreement or pursuing its underlying objective.
