A. The location, size, design, operating characteristics, and visual impacts of the proposed use. B. The compatibility of the proposed temporary use with the character, density and use of structures and uses in the immediate vicinity. C. The impacts of the proposed temporary use on pedestrian and vehicular traffic and traffic patterns, municipal services, noise levels, and neighborhood character. D. The duration of the proposed temporary use and whether a temporary use has previously been approved for the structure, parcel, property or location as proposed in the application. E. The purposes and intent of the zone district in which the temporary use is proposed. G. How the proposed temporary use will enhance or diminish the general public health, safety or welfare. atb\tempuse.doc • • MEMORANDUM TO: Julie Ann Woods, Community Development Director FROM: Sarah Oates, Planning Technician S O RE: Silver Lining Ranch —Temporary Use Permit DATE: June 14, 1999 Kevin Smyley, representing the Silver Lining Ranch, applicant, is requesting a Temporary Use Permit to use the 18,569 square foot Ranch facility for a Halloween haunted house October 28-31, 1999, and as a Santa's workshop December 22-25, 1999. Both events are for the Aspen youth and will be open to the public. The applicant has addressed several issues in the attached application (see Exhibit B). The hours of the Halloween haunted house will be from 5:00 p.m. to 9:00 p.m., and Santa's workshop will run from 1:00 p.m. to 5:00 p.m. Any parking overflow can be accommodated by the Aspen Club parking lot, and, since the event will be held indoors, noise will be at a minimum. The Community Development Director may approve Temporary Use Permits not exceeding seven days. Staff recommends the Director approve the Temporary Use of the Silver Lining Facility for the purposes of a haunted house and Santa's workshop with the following conditions: 1. The dates of operation for the haunted house will be limited to October 28-31, 1999, and the hours of operation will be from 5 p.m. to 9 p.m. 2. The dates of operation for Santa's workshop will be limited to December 22-25, 1999, and the hours of operation will be from 1 p.m. to 5 p.m. 3. Parking will be handled in such a manner that overflow traffic will be directed to the Aspen Club parking lot. At no time will the street be used for parking. 4. All activity will be limited to inside the Silver Lining Ranch facility. A. The location, size, design, operating characteristics, and visual impacts of the proposed use. Staff Finding: The proposed events will be held in an existing structure. The events are community activities which will be held for a short duration. The impacts are minimal. B. The compatibility of the proposed temporary use with the character, density and use of structures and uses in the immediate vicinity. Staff Finding: The structure is currently used as a facility to house children with life -threatening illnesses and is adjacent to an athletic club and spa. The proposed events will not alter the character, density or uses in the immediate vicinity. C. The impacts of the proposed use on pedestrian and vehicular traffic and traffic patterns, municipal services, noise levels, and neighborhood character. Staff Finding: The applicant has addressed any potential parking problems by working with the neighboring athletic club to use its parking facilities. Due to the short duration of the events, there will be no significant impact on traffic patterns, municipal services or neighborhood character. Noise levels will be at a minimum because both events will be held inside. D. The duration of the proposed temporary use and whether a temporary use has previously been approved for the structure, parcel, property or location as proposed in the application. Staff Finding: The applicant is requesting a Staff level approval for a seven day temporary use (three days in October and four days in December). A temporary use had not been granted for this proposal before. E. The purposes and intent of the zone district in which the temporary use is proposed. Staff Finding: The property is zoned Academic (A) with a SPA overlay. The purpose of the Academic zone district is to establish lands for education and cultural activities. The facility is intended to provide children with cancer and life -threatening diseases with a retreat. A community activity for Aspen's youth is compatible with the facility's intended use. F. The relation of the temporary use to conditions and character changes which may have occurred in the area and zone district in which the use is proposed. Staff Finding: There are no changes in the surrounding land uses that would prohibit these events. 0 • G. How the proposed temporary use will enhance or diminish the general public health, safety, or welfare. Staff Finding: The proposed temporary use does not impact the general public health, safety or welfare. It is expected that the proposal would enhance the public welfare by filling a void in such opportunities for Aspen's youth and parents. APPLICANT and CITY agree that because of the size, nature or scope of the proposed project, it is not possible at this time to ascertain the full extent of the costs involved in processing the application. APPLICANT and CITY further agree that it is in the interest of the parties to allow APPLICANT to make payment of an initial deposit and to thereafter permit additional costs to be billed to APPLICANT on a monthly basis. APPLICANT agrees he will be benefited by retaining greater cash liquidity and will make additional payments upon notification by the CITY when they are necessary as costs are incurred. CITY agrees it will be benefited through the greater certainty of recovering its full costs to process APPLICANT'S application. 4. CITY and APPLICANT further agree that it is impracticable for CITY staff to complete processing or present sufficient information to the Planning Commission and/or City Council to enable the Planning Commission and/or City Council to make legally required findings for project approval, unless current billings are paid in full prior to decision. 5. We are seeking to use the Ranch facility between October 28th and October 31 st as a site for a Halloween haunted house. Additionally, we are applying to open the Ranch facility to the public between December 22"d and December 25th for tours of Santa's workshop. The following responses address the criteria listed in Section 26.96.030: A. There will be no visual impacts of the proposed use because all decorations will be contained within the Ranch facility or enclosed within the immediate premises. B. The proposed temporary use will be consistent with all structure and uses in the immediate vicinity. It will not alter the character, structure or density of the existing Ranch facility. C. The Ranch facility is in a position to accommodate an increase in parking spaces created by the proposed use. The neighboring Aspen Club will be available to address any overflow from the Silver Lining Ranch Halloween haunted house night. The noise created from this propose use will occur only during early evening hours and be will be contained within the Ranch facility. The overall participation in this event by the community will not have any significant on traffic patterns for the City of Aspen. D. The duration of the proposed use for the Halloween haunted house is between 5:00 P.M. and 9:00 P.M. on October 291h, 30th, and 31st. The additional proposed use for Santa's workshop is between the hours of 1:00 P.M. and 5:00 P.M. on December 22"d 23rd and 24th. The Ranch facility where both proposed uses would occur, has previously been approved by the City of Aspen as a facility to house children with cancer and life -threatening diseases. E. The purpose of the proposed uses is to promote community relations and provide enjoyable activities for the youth of the Aspen community. F. The proposed temporary uses will create positive overall feelings of goodwill in the community and become desirable activities for the youth of the community.
