The Bakery was recently approved by the P & Z as a conditional used subject to the restriction that no meals be served at the Bakery. We have asked Mr. Cl~yton Meyring, City Building Inpsector on Wednesday and Mr. Tom Dunlop of the Department of Environmental Health to investigate. The enclosed memo dated April 7, 1976, from Tom Dunlop shows the following: cold sandwichs are not made or warmed on the premi ses; and no sit-down facil ities exist for consu~ption on the premises. Should the P & Z members feel this to be a violation of the conditional use permit, we will ask the City Attorney to proceed further with this matter. I am not clear as to how this matter was discussed at the P & Z meeting,stnce Iwas not present. From conversations with Mr. Abbott this afternoon, evidently the following action occurred; Mr. Abbott learned of the sale of sandwichs; asked All ison Downing to investigate; Allison called Libby Klym; Libby briefly called me and asked what to do if a zoning violation occurred; I suggested a report shoul d be made to the City Bui.1 ding Inspector who is responsible'-f9t investigating zoning violations. The Building Inspector 'l{Asnot notified of the problem. .,.. ;~" Suspected zoning violations should be reported directly to the Building InSpector preferably in writing to assure prompt action., Should the Building Department not be able to follow through with an inspection of the suspected violation, the City Attorney and/or Assistant City Manager, Art Hoagland could be contacted. The development review functions of the Planning Offi,ce do not and shoul d not extend to foIl ow-up inspecti on duties. '~ We have also asked Meyring and Dunlop to inspect the Mesa Store Bakery to ascertain if there has been an expansion of restaurant service at the Bakery. We will also forward to the Board infor- mation we receive concerning the Mesa Store Bakery. They are made by Walter Huber whose facilities are located at the airport business center. Since there is no warming of the sandwiches on the Gerard bakery premises and since there are no sit down facilities for consumption on the premises, they need no Colorado State License to operate a Food Establishment. Notice of this hearing was distributed to property owners within 300 feet of the building. The property is zoned C-l, Commercial, which allows "commercial uses which are not primarily oriented towards serving the tourist population". The Planning Commission decided at their January 6, 1976, meeting that such use is a conditional use. The Planning Office feels that such use is appropriate for the CC districts and/or the Neighborhood Commercial district. We feel that it is easy for this type of business to gradually expand into a sandwich/restaurant type use, thereby creating an enforcement problem for the Building Inspector. We would recommend approval of this conditional use, provided that a use plan of the floor space is submitted and the seating area of customers restricted. The business is planned to be located in the newly constructed Victorian Square Building. In evaluating the contemplated use we would like to call your attention that the primary focuses of the business will be catering and the retail of fresh breads and pasteries. The zoning regulations expressly allow a catering operation in the C-l zone district. However, the retail sale of breads and pasteries may stand only upon a determination by this Commission that the use is expressly provided in the zoning ordinance as a "similar use" to the retail commercial establishments enumerated for at the C-l zone district. The applicant urges this Commission to find the characteristics of the proposed business indicate that it is not oriented toward the tourist population.
