MEMO TO: Aspen Planning and Zoning Commission FROM: Planning Staff (HC) RE: Use Determination--Clothing store in C-l Zone This is a request by Michael Cooper for a use determination by the P&Z Commisssion for a clothing store to be located on Block 100 the south half of Lots A, B, and C, In a building under con- struction by Mr. Jerry Long. (The building is as yet unnamed.) A clothing store use is not listed as a permitted or conditional use in any zoning district. The use determination application is made pursuant to Sec- tion 24-2.1b of the City ZOning Code, The decision of the P&Z is made by virtue of analysis of the intention of the district and the compatibility of the proposed use with specified permitted and conditional uses. A description of the proposed use is provided by the appli- cant as well as a drawing of the proposed floor area configuration (Total 1400 sq. ft.). The Planning Office considers this use as described by the ap- plicantto be appropriate in the CC district. The Cl zone allows jewelry stores by right and part of the proposal contains an area for jewalry store. In our opinion, the retail space would be more locally oriented ,should clothing sales also be allowed.. We would not support a clothing store primarily oriented to sporting apparrel, In summary, the Planning Office recommends a determination by the P&Z that this is a use "similar to" those allowed by right in the Cl zone and as such is a use allowed by right in the Cl zone. Jerry Long. It is my intention to make the store a clothing store specializing in tops. This includes all varieties of shirts, sweaters, blouses, t-shirts, halter tops, boutique tops, french tops, etc., anything worn above the waist. 1'he shop will also have a sizeable children's department which will specialize in a large assortment of children's tons. The Drice range of ~r store is geiJ.red toward the affordability of the local Aspen resident. :;Je have found this system of pricing to be quite successful in our Steamboa.tstore.in both adult and children's clothing. We also custom silk-screen and heat-transfer designs on our shirts. It is also my intention to carry moderately-nriced jewelry. I feel that the residents of Aspen will enj oy and support a store which carries merchandise they can affOrd to buy. I wish to present this information and my intention to the Planning and Zoning Commission meeting on Tuesday, September 7, 1976. Since I will be driving to Aspen especially for this purpose, I would greatly appreciate it if you could place my case on the docket at an early hour in order to be sure that it is heard on that date. Attached is a rough diagram of Hhat we beHeve the store will look like, and what He will carry. This is of course, a rough idea based on the architect's nlans of the building since only the foundation has been completed thus far. Thank you for your attention to this matter.
