The applicant is requesting that a non- conforming use (an attached apartment) be allowed to be restored following a fire that destroyed the building pursuant to Land Use Code Section 26.312.020.G.2, Non -willful destruction. SUMMARY: The subject property is located in the Moderate -Density Residential (R-15B) zone district. It was constructed in Pitkin •County in the 1960s and was subsequently annexed into the City of Aspen in 1987 as part of the Aspen Grove- Eastwood-Knollwood Annexation. The parcel contains a duplex dwelling that incurred non -willful destruction as the result of an extensive house fire on August 5, 2017. The owner wishes to restore both dwelling units. The R-15B zone district only permits a detached residential dwelling per lot. The duplex therefore represents a non -conforming use within the zone district. Section 26.312.020.G.2, Non -willful destruction, establishes the approval process for the ability to restore non -conforming uses. To re-establish this non -conforming use, the applicant must document legal establishment of the duplex. There is an absence of Pitkin County/and or city records associated with this unit but some evidence exists supporting that the duplex was legally established. Building permits issued by the Aspen Pitkin Regional Building Department and the City of Aspen acknowledge the presence of a duplex on the property. Additionally, the representative has provided an affidavit from the property owner, proof of utility records showing two connections, and letters from past residents. STAFF EVALUATION: Staff finds that the request meets the requirement of the ability to restore the non -conforming use per section 26.312.020.G.2, Non -willful destruction. Although some conflicting information exists in the permit record, some prior building permits from the Aspen Pitkin Regional Building Department and the City of Aspen recognize the presence of a duplex (Exhibit B). Additionally, as requested from staff, the applicant provided sufficient documentation supporting the use of the duplex as legally established (Exhibit Q. The property owner provided an affidavit stating that the parcel contained a duplex consisting of two dwelling units, one of which was used as a rental unit. The affidavit specifies that the rental unit was 700 square feet, had private access, a full kitchen, 3/4 bath and a washer and dryer. Additionally, the affidavit mentions that the property owner received a permit from the City of Aspen in 1979 to rewire the house with two electrical meters serving separate residences on the property. This statement was supplemented with several months of utility records showing two distinct utility connections within the duplex. This application is submitted by BendonAdams on behalf of property owner, Margaret "Peggy" Mason. Existing Conditions The subject parcel is located in • the R-15B Zone District, in East Aspen, on a lot approximately 14,611 sf in area. The property was developed in the County in the 1960s and was later annexed into the City of Aspen. The parcel contains a duplex residence that is currently demolished as the result of an extensive house fire that has subsequently made the property inhabitable. The fire occurred on August 5tn of 2017, and the property was only recently released from being an investigation scene by the Fire Marshall in April of this year. The property is currently undergoing mitigation to prevent risk of any contamination from building materials that may have contained asbestos. The pictures below were taken in late April of this year and clearly illustrate a two-story home with balcony and porch features. In 1979, the Applicant applied to have the downstairs rewired as a separate duplex unit and after applying for a building permit received a Certificate of Occupancy July 19, 1979 (Exhibit 9). The duplex home has been since been occupied by the Applicant and owner Margaret "Peggy" Mason — and a tenant in the lower unit since 1979. Attached to this application are exhibits providing evidence of the property's use as a duplex: letters from previous 300 SO SPRING ST 1 202 1 ASPEN, CO 81611 970.925.2855 1 BENDONADAMS.COM 0 • • tenants and separate utility bills for each unit, in addition to information regarding the legally established enclosed gazebo. Duplex Use In March of 1979, the Applicant applied and received Building Permit #1796 for the wiring of the duplex unit (Exhibit 10). As mentioned above, this unit has been consistently rented — the unit consists of approximately 700 square feet with private access, a full kitchen, % bath, and a washer and dryer. In discussions with City Staff it was requested that the Applicant provide evidence of previous tenants and the letters have been attached in Exhibit 11. In addition to the letters from previous tenants, the Applicant has contacted their electric service provider, Holy Cross Energy, and has provided the last three bills from each unit prior to the fire in August 2017 (May, June and July). The main unit occupied by the Applicant is referenced as Account #493002402 and the lower rental unit is referenced as Account #493018201 as illustrated in Exhibit 12. The photo below shows two electric meters still in tact at the home. Heigh Steven May of RedRoom Design conducted a site visit April 25, 2018 to obtain height measurements of the remaining building structure. Utilizing the known roof line, RedRoom Design was able to calculate the height of the building, features, and porches. The height was measured at 22 feet 6 inches, due to the extreme slopes on site we have provided a height measurement schematic below in Figure 3. The conclusion was that the home was built well within the underlying zoning requirements and would be considered conforming, see Exhibit 13. The gazebo eventually became what is now known as the kitchen. This portion of the property encroaches into the rear setback which abuts a private access easement that serves Lot 3 of the Eastwood Subdivision. While the Applicant applied and received a variance from the Pitkin County Board of Adjustment, and went through due process, there has been some contention over this particular approval as the neighboring property, Lot 3 of Eastwood Subdivision, has a disparate claim to the location of the lot line for 24 Mc Skimming. However, the City of Aspen did issue a Certificate of Occupancy for the enclosed gazebo, in response to the approval by the Board of Adjustment Case #84-39. This Certificate of Occupancy was granted December 21, 1985 and is attached as Exhibit 14. Request The Applicant is eager to rebuild her home and move forward through what has been a difficult process. The fire destroyed what records the Applicant had regarding her home, and the application has pieced together evidence from what is available online and what is included in the building permit file. This Administrative Determination will allow for the Applicant to begin the design process and meet her deadline for her building permit as outlined in Code Section 26.312. The home is well within zoning allowances for the R-15B Zone District, with one non -conforming structural element consisting of the rear setback infringement mentioned above. The height of the building has been calculated at 22 feet 6 inches, and the floor area, per a previous review by City Staff has been calculated at 2,112.5 square feet, Exhibit 15.
