This is a joint application filed by the Emporium Fabric Shop and Pyramid
Travel. Pyramid Travel is requesting an expansion of their conditional
use permit and the Emporium is requesting a use determination to allow
them to be a conditional use in the NC zone (and therefore the granting of
a condi t i ona 1 use permit).
The City Attorney had no problems with the application and considered it
to be straightforward.
The space to the west of Clark's Market in the Trueman Center (formerly
occupied by Michael Scott, Inc.) is approximately 1700 square feet. The
Emporium Fabric Shop is interested in occupying 1300 square feet of the
unit and Pyramid Travel wishes to expand their adjacent office by the
remaining 400 square feet.
Pyrami d recei ved a condi ti ona 1 use permi t 1 ast year. They presently occupy
296 square feet. The constraints of this space are such that the agency
is unable to increase its travel agent staff and has reached it's service
capacity. An additional need expressed by the applicant is for a larger
waiting area. As was discussed in the initial conditional use hearings,
much of a travel agent's business is handled over the phone and the amount
of parking offered at the Trueman Center is adequate to handle the amount
of personal visits experienced by the agency. The criteria of conditional
use review have been addressed in the earlier review and Pyramid Travel
was found to be compatible with all zoning requirements and the zoning
district, as well as surrounding land uses. This increment of increase
does not in our opinion, alter Pyramid's compliance with these conditional
use cri te ri a .
The Emporium Fabric Shop is currently loc~ted in the Concept 600 Building,
in the C-1 zone. It is a commercial liSe not primarily oriented towards serving
the tourist population, which is the intent of the C-1 zone. It is clearly
a C-1 us e .
Permitted uses in the NC zone are "small convenience establishments designed
and intended to serve the daily or frequent trade or service needs of an
immediately surrounding neighborhood." The basic questions to address are
whether a fabric shop is the sort of establishment which serves daily or
frequent trade or service needs, and the degree to which service is limited
to the immediately surrounding neighborhood.
The two nodes of NC zoning are the locations of City Market and Clark's
Market. Separate neighborhoods are served by these locations. A C-l
use like this fabric shop serves a community~wide need i'l.nd while customers
may have multCpurpose trips to the Trueman Center, they also may go to the
Emporium specifically. Single-purpose trips will only add to the congestion
of the Trueman shopping center.

The owners of the shop have submitted information and a petition signed by
125 customers (in two business days, August 13 and August 15), to support
the "frequency" aspect of this use, Each of the petitioners was asked how
manY visits to the store they averaged each month. The answers ranged
from one visit per month to 20 visits per month, with an overall average
of 5.23 visits per month.
Included in their information is the statement that this is the "only
fabric shop in town and the next closest fabric shop is in Carbondale,"
They say that many of their sales are under $3,00 (thread, needles, pins,
etc,) and that they have between 50-70 daily sales. The local business has
grown to a point where the Emporium wants to expand into drapery, curtain
and upholstery fabrics, A drapery shop is a listed conditional use in the
zone.
In the recent past, several other C-1 uses have requested an NC location,
In the Trueman. Center for example, there is a florist, a hardware store, and the
,space now being reviewed was previously occupied by a furniture store. All of
these.are C-1 uses. .The Planning Office hil.s., suggested; through, the review of the
Use Tables, tl,at the NC and C-1 zones be combined, if no distinction is to
be made between them, Your resolution to Council, in its present form,
does not include this provision, We suggest that you consider this
combination again.

RECOMMENDATION:
The Planning Office recommends granting an expansion of the conditional
use permit for Pyramid Travel. The fabric shop is a C-1 use, however,
because of the existence of other C-1 uses in the NC zone and the deteriora-
tion of that zone as being purely reserved for permitted and conditional
NC uses, you can either reverse the trend by denying this request or allow
it as a conditional use in the NC zone. In concert with the granting of
a conditional use permit, we ask that you recognize that the C-1 and NC
zones are highly intermingled and consider combining the two zones.

Dear Sunny:
The Emporium Fabric Shop is a l7-year-old local business serving
the needs of Aspen.
The Emporium Fabric Shop is located at 600 E. Main Street (Concept 600
Building) selling fabric, notions and related items to the Aspen
Community, We select the shop merchandise with the Aspen resident
in mind and accommodate unusual requests with special orders.
The Concept 600 Building is zoned Cl and we would like to move
into the space previously occupied by Michael Scott Interiors in the
North Mill Street Plaza which is zoned N.C.
We feel that our business meets the intention of the N.C. zoning
designation~because of the following reasons:
1. We know that a move to the North Mill Street Plaza would help
to reduce traffic. A large maj ori ty of our customers drive to the
Concept 600 Building before or after a visit to the grocery store,
post office, bank and/or drugstore. With our move to the North
Mill Street Plaza our customers would be making one less stop and
would enjoy the convenience of the North Mill Street Plaza.
2. Our present space is too small to provide all the services we
wish to offer to our customers. With a larger space it is our
intention to offer classes in the following areas: warm window
coverings (energy-saving treatment), drapery and curtain making,
outdoor wear, i.e., backpacks, parkas, wind shirts, running suits,
beginning and advanced tailoring, beginning sewing, teenage sewing,
quilting, Christmas gifts and decoration.
3. We would like to expand our drapery, curtain and upholstery
fabric business,Currently because of space limitations, we are not
able to offer the range of selections we feel the community needs
in order to escape the high cost of decorator fabrics. (Many of our
sales are related to home decorating as people move in and out of
rental units and usually desire to personalize their new surroundings.)
4. The Emporium Fabric shop is open from 9:30 to 5:30 Monday through
Saturday, closing only for Sundays and major holidays. We feel that
these hours accommodate the local working people and we are frequently

in the store after hours to help the late shopper.
5. We recently sent a postcard mailing to our regular customers
to invite them to our annual summer sale. We were delighted to
find out that we have over 700 customers with a local zip code.
Our mailing list is very accurate and up to date. We keep track
of customer purchases on a file card marking day of purchase and
quantity. When each card reaches 50 yards our customer is entitled
to a discount on her next purchase. This file has proven to us that
our customers are local residents with many frequent purchases in
our shop.
6. 39% of our gross sales occur from October 1 to December 31st.
By this figure you can see that the high volume tourist months are
not the highest grossing months for the Emporium Fabric Shop.
7. We are the only fabric shop in town and the next closest fabric
shop is in Carbondale. Many of our sales are under $3.00 (thread,
needles, pins, etc.) The convenience of having these items available
in an area other than one of high density tourist traffic will do
much to reduce traffic and aid our customer in added convenience.
We have between 50-70 daily sales!
8, The EmpODiuID Fabric Shop is not now located in a high volume
tourist area and our local business has grown to a level that we
feel we can better serve the needs of the community by getting
even closer to the heart of the Ideal shopping area,

USE DETERMINATION JUSTIFICATION
Pyramid Travel, Inc. hereby requests to the planning and zoning commlSlon of
Aspen, to allow Pyramid to expand their existing office. Pyramid Travel's
existing office is 296 square feet. Our expansion plans would enlarge it
400 square feet to a total 696 square feet. All expansion would take place
into space 205 of the Trueman Aspen Building. Space 205 was formerly
Michael Scott, Inc. but is now unoccupied.
Pyramid Travel desires to expand so that we may service the public better,
With only a 296 square foot office we find two problems. The first being
the inability to increase the size of our travel agent staff, The second
being the need for a larger waiting/servicing area. At this time Pyramid
Travel has reached it's service capacity. Due to a high demand for our
travel planning, and the inability to offer the client additional sales
force, the client (publiC) suffers, An additional 400 square feet would not
only allow us to service our clients better, but they also would be more
comfortable in a larger waiting area. This larger area would also decrease
the possibility of physical harm due to the current crowded space limitation
(eg. fire),
