RE: Conditional Use ~ Durant Mall Apartments Remodel
DATE: June 11, 1976
This is a request by the owners of the Durant Mall to convert the
upper level of the East Building from Office to Apartment use. The
proposed conversion would include two (2) one~bedroom units at 875
square feet and 900 square feet respectively and a two-bedroom unit
compri sing of 1,250 square feet. The conversi on wi 11 only/affect
the internal design and use of the building. No external changes
in height, configuration or surface character will occur.
The Planning Office recommends approval of the request subject to a
limitation on leasing of the units for a minium of six (6) month
periods.

RE: Use Determination ~ Wunderkind
DATE: June 11, 1976
This is a request for a use determination for the Wunderkind store
to be located in the Durant Mall building. The proposed use
would be a children's ski shop and outdoor recreational equipment
retail facility.
The Planning Office feels that this is an appropriate use for the
CC or C1 zones of the Aspen Core Area but not for the Neighborhood
Commercial zone. It is simply not designed and intended to serve
the daily or frequent trade or service needs of the immediate
surrounding neighborhood. We see the application as more generally
a retail sporting goods store. Therefore, our recommendation is that
the use is not allowed in the Neighborhood Commercial zone.

Re: Durant Mall Apartment Remodel.
Dear P & Z members:
The owners of the Durant Mall request an affirmative use deter~
mination to convert the upper level of the East Building from
general office space to three apartment units.
The proposed conversion would include two (2) one~bedroom units
at 875 sq. ft. and 900 sq. ft. respectively and a two-bedroom unit

The third level is presently served by two internal stairways
linked by a corridor and an elevator. The present building con-
figuration satisfies all Building Code, fire and egress requirements.
The proposed conversion will be entirely internalized, resulting
in no external changes in height, configuration or surface character.

Resulting from our experience of the period since the initial oc ~
cupancy of the project (9 months) we feel the proposed apartment
conversion would better balance the overall use of the project and
better serve the apparant needs of the area.

Following up our telephone conversation of this date,
formal application is herewith made for the approval of the
above use for the Durant Mall building situate in the neighbor-
hood commercial district in the South 1/2, Block 106, City and
Townsite of Aspen.
The entire workup on the proposed use was delivered by
me to Mr. Chick Collins, chairman of the Planning and Zoning
Commission, at the study session held on Thursday, May 27,
1976. A recap description of the proposed use would be that
it would be a children's ski shop and outdoor recreational
equipment retail facility. It is the position of the applicant,
Mr. Peter Plantec, owner and developer of the Wunderkind concept,
that the use is appropriate in the Aspen community to serve the
daily or frequent trade or service needs of the immediately
surrounding neighborhood. Under the concept the facility is
proposed to provide sale and rental of children's sports equip-
ment together with repair thereof and instruction with regard
to the use thereof. While it would seem that this might not
fit within a neighborhood commercial classification in an area
without heavy emphasis upon skiing and outdoor activity, the
applicant maintains that the proposed use squarely fits within
the purpose and intention definition of the neighborhood commercial
district as applied tocthe Aspen community or any smaller neighbor-
hood definition within the community. It was the impression of

this writer as counsel for Mr. Plantec that in defining the
area that a discussion of the overall community, both tourist
and residential, was intended to be served by the neighborhood
commercial district.
It is further maintained that a neighborhood commercial
district definition might very well vary between neighborhood
districts because of their location within the community.
Therefore, what may be appropriate for a neighborhood commercial
district in close proximity to the urban core should not be
appropriate for an outlying neighborhood commercial district.
We would also urge that from an economic standpoint
tlat the propOsed location will allow the prOviding of goods
and services at rates and prices lower than those which would
be necessitated by location of the proposed facility in one of
the higher rent districts. It is urged that no consideration be
given by the Planning and Zoning Commission to the fact that such
an activity might have competitive consequences with similar
facitilites situate in other zoned categories. This business,
as any other business, must stand on its own and artificial
restrictions of competition by virtue of consideration of rent
differences would be artificial and would tend further to cause
the urban core area to degenerate into yet more small high-
volume junk jewelry stores and the like.
We would request that this matter be set for formal
hearing before the Planning and Zoning Commission at its regular
meeting on June 15, 1976.

I have tried to inspect Ommi Music Shop as you requested,
but have been unable to make the inspection since they
are closed.
I have examined the records concerning this conditional
use approval for a record shop, and it is very unclear
to me of what the applicant was expected to put in his
shop. The applicant stated certain percentages of floor
area would be devoted to books, miscellaneous accessories,
tapes, records, instruments and accessories for instruments,
and floor spaCe for general sales and useable space for
music lessons; however, the motion did not put any conditions
on the applicant just the record shop be a conditional use.

Jenkins asked Kane to include in the Planning Office
recommendations the following: 1) the employee parking
and all equipment and supplies incidental to the
operation would park inside the bermed area; 2} they have
a detailed landscaping plan; 3) a bike path alternative;
4) an isometric sketch plan.
Hunt moved to table the Parks Maintenance Building until
the next Planning and Zoning Meeting; seconded by Dobie.
All in favor, motion carried. .
Kane mentioned the planning and zoning commission moved
to include the record shop asa conditional use in the
Durant Mall. The Planning Office is recommending approva
Hunt was concerned about the heavy impact of parking in
the area due to the parking from City Market and parking
already coming into the Durant Mall. Collins didn't
feel it was an appropriate neighborhood commercial use;
It is on the periphery of the CC and C-I and would have
a bad effect on the commercial area.
Dobie moved to approve the record shop as a conditional
use in the Neighborhood Commerical zone. Jenkins said
that it already is a conditional use in the N/C zone.
Abbott made a second to the motion because he felt a
store like this is needed because music lessons will be
given.
City Attorney Stuller asked Dobie if he made that motion
because he feels that it is appropritatebecause it is
compatible with the surrounding land uses and- uses in
the area. Dobie replied that he did. City Attorney
Stuller said that Abbott's second is irrelevant because
a ,needed use in the community is irrelevant and cannot
qualify someone's motion-by adding an additional reason.
Abbott withdrew his second.
The motion died for a lack of a second.
Abbott made a mo~ion to approve the record shop because
there are not stores in town, particularly a neighborhood
use for music students or somebody ,who wants to ,play a
guitar or other instruments and we don't have'anyone in
town who sells a wide range of musical instruments and
this will only be half of ,his business and it would be a
neighporhood use because a tourist isn'~ going to come
in and take a week of music lessons and leave,' this is
for a conditional-use and a' good idea; seconded by Dobie.
Allin favor of the motion were Jenkins, Abbott/,and
Dobie. Opposed were Hunt and Collins. Motion Carried.
Kane presented floor plans which the applicant had
prepared a specific detailed breakdown of how the use of
the space will be. ,The .Planningoffice recommends
approval of the plan with the conditions there not be
a high tourist turn-over kind of retaili~g practice.
Hunt moved to approve the conditional use ofa retail
bread and pastry shop in the Victorian Square Building
conditioned upon: I) no snack bar, cafe-type food is
prepared; 2) no provisions be allowed fo~ customer
consumption of food on the premises. Reasons for those
conditions is we donlt want afoed service to go 'into
the space, it.is to be strictly retail,breadandpastry
shop as presented by the applicant's presentation. The
bread and pastry 'shop activity appears a desirable use
in the area; seconded by Abbott.
Hunt added an amendment which was the type
'toalso include drink; seconded by Abbott.

City Manager Mahoney reassured the'commisison there will
not be junk or equipment hanging around the outside area
of the shed.
Kane explained that this is a conditonal use hearing for
a proposed record and music accessory shop in the Durant,
Mall. There was a vote by the Planning Commission to
include record shops as a permitted conditional use in
the N/C zone. Kane felt the request should be approved
because it represents what the applicant spoke about
.atthe last meeting and meets the criteria of the
conditional use provision'. It will also be a conditional
use if there is an application to put a record shop
in th~ Trueman property building.

Will be no baking or any food preparation on the premises.
All the goods sold will be shipped in from outside qf ,

On Januaxy 6, 1976, this cammi.ssion voted to approve a llU.lSic shop as
a conditional use for the NC district pursuant to Omni Music's application.
The prescribed notices have been sent to adjacent property =ers within
300 feet of the proposed use apprising them of this n-eeting.
As previously discussed, the applicant's concept is for a full
service neighborhood llU.lSic center which will offer a .,ide variety of
ImSical products, records, publications, instrurrents, accessories, and
music lessons.
Attached is a proposed floor plan indicating the respective portions
of the llU.lSic shop dedicated to particular uses. Tne plan is for a

DATE: January 15, 1976
This is a public hearing to consider the conditional use of a
music shop in the Durant Mall Building, which is zoned NC, Neigh-
borhood Commercial. Notice of this hearing has been sent to
property owners within 300 feet. The Planning Commission acted
to not allow this use at their December 16, 1975, meeting. The
applicant renewed his request on January 6, 1976, and the Planning
and Zoning Commission ruled this to be a conditional use.
The Planning Office recommends that this request is not an approp~
riate use in the Neighborhood Commercial zone. It would be
appropriate in the CC or Cl zones. We feel that this use is not
designed and intended to serve the daily or frequent trade or
service needs of the immediately surrounding neighborhood. Further,
the use is indicative of the movement of commercial uses from the
CC and Cl to the peripheral areas precipitated probably by lower

The follaving is a request for a use determination to pe:r:ro:i.t
the applicant, OloNI MUSIC to operate a retail record and rm:LSic
shop in the DURAi.'lT MALL b,uilding. This matter was briefly discussed
at the last commission rreeting and as such was denied. The applicant
was not present at that rreeting and was not inforned that the
conmission would consider his proposed record shop .for use determination
at that ti.Ire. The applicant requests reconsideration of that
decision and an opportunit;y to present relevant factors which
indicate that a record shop is an appropriate use within the
purposes of t11.e Neighborhood-Cormercial zoning district.
The intent of the Neighborllood-Comrercial classification is
to provide convenient "one stop" shopping areas which cater to the
needs of local residents. Tourist oriented businesses are to
be discouraged and consideration is to be given to those enterprises
which fulfill routine shopping needs. The DURANT !-1ALL was approved
for inclusion in this zoning classification as part of the first
step tcwards a neighborllood shopping center. The ~lall, located
next to Cit;y Narket, provides off street parking for non-neighborhood
shoppers and a variet;y of shops offering diverse goods and services
i.m:lild;!,ng clothing, a tack shop, and a retail liquor store. Some
of these establishrrents serve both residents and tourists, while
others fulfill generally local needs. -'
The record shop proposed by the applicant would specifically
serve local residents and provide hitherto unavailablEf products
at substantial discounts. The applicanl:!> concept is for a full
service rm:LSic store. Records, tapes, rm:LSical instruments, pub-
lications and accessories, music lessons 1 stereo equiprrent and rm:LSical
production equiprrent would be available in one convenient location.
These services and products are uniquely oriented for the local
resident. The location of this shop in the cororrercial core area
would :i.npede locals from convenient access to these services. The
core area of the cit;y is already heavily congested and, the frequent
purdlases of rm:LSical i teus by local shapers ~Tould be rrost efficiently
accorrodated by the location of the proposed record shop in the
Neighborhood-cororrercial area. Residents of this neighborhood could
leave their cars at horre and shop for food, liquor 1 c1ot11ing, and

leave just the 6,00.0. sq.. ft. mimber at. the top per
minimum lot size. Kane mentioned that it ~s a
superfulous duplication because the permitted.uses are
laid out in other portions of the code. Clark explained
that on a 6,0.0.0 sq.f,t. lot; the way the code was .
originally written up a triplex, fiveplex, or sixplex
could be. built on it but not a duplex.
Kane explained that there is no tie between the size
of the duplex and there is no floor area ratio controlled
in a duplex. It would make sense to require a minimum
of 9,0.0.0. sq.f.t per duplex and once you do that then
you don;t restrict it to a certain number of bedrooms.
If the word duplex is crossed out .then 2 three bedroom
units can be built on a 6,o.o.Osq.ft. lot. Kane suggested
that the word duplex be scratched out of the code.
Hunt moved to recommend"to amend the zoning code; seconde
by DObie. All in favor, motion carried.
Herb Klien, representing the client for the application,
stated that the concept is for a full service neighbor-
hood music center. It would cater exclusively to local
residents. Music is part of everyones daily routine;
whether listening to music or playing an instrument.
If listen to music the individual will buy music related
-items just as he will buy cheese and liquor. Because
of the summer music festival,. andrecQrding artists
musci is intimately associated with Aspen's life style.
The applicant will sell records at a discount price,
. and tapes and provide music lessons and a clearinghouse
of musical information, also music publications and a
variety of accessories will be avialable. Klienfelt
that if locals are forced to purchase their musical
needs in the core area that it will only create more.

Klien read. for the Commission a petition which had
50.0 signatures explaining why a record shop would be

Kane felt that he didn't agree with Klien's arguement
for a record shop. By approving to have a record shop
in that zone, it would be chaning the N/C uses City
wide and would become a permitted use in the Trueman
property. A record store is beyond the intent of a
neighborhood commercial zone ~nd doesn't represent a
daily or frequent vitale shopping need. Kane argued
for the preservation of a Neighborhood commercial zone
because there are only two N/C zones in the City and
should be reserved for the' uses intended in the zone.

Dobie mentioned that he would be more inclined to buy

Collins felt. that.theneighborhood commercial areas are

Andy Hecht represented Stefan Kaelin. Hecht asked that
a proposed bread and pastry shop would be more oriented
towards serving the local resident and is a commercial
use. The applicant is requesting that it be located
in the Victorian Square Building. The focuses of the
business will be catering and retail of fresh breads
and pasteries. The zoning regulations, at present,
allows a catering operatiqnin the C-l zone. The
applicant will not have people eating on the premises
and the store will not be open past 6:00 p.m.

Meeting was called to order by Chairman Jack Jenkins at 5:10 p.m. with members
Roger Hunt, Patrick Dobie, Chic Collins, Danny Abbott and Brian Goodheim
present. Also present was City/County Planner Bill Kane~.. and Hal Clark from
the Planning Department and City Attorney Stuller.

City Attorney Stuller explained that RandyWedum had
previously been in.forconceptual subdivision. to the
Planp.ing and Zoning and was g.iven approval for the con-
ceptual subdivision for 8 units. Wedum would like to
be exonerated from the mandatory PUD and would, instead
of building the 8 units and do an entire PUD complex;
build 4 lots one by one and sell them. CityAttorney
Stu.ller continued 'explaining that there is an amendment
for doing that .and if the Planning and Zoning make a
determination that all of the objectives of thePUD
determination have been satisfied in his plan then the
.Planning and. Zoning may exonerate him from the mandatory
PUD requirements. Before exonerating him from mandatory
PUD.. the. concerns are that there is correct location of
building for slope stability, correct location of
entries, driveways, access roads etc., determination tha
there is sufficient water pressure and otherthings that
are itemized in the code. .

Clark had one hesitiation and that was regarding the
access situation to the subdivision. That is that it be
not in the lower Oaklahoma Flats Road, but it be from
GibbsonAvenue sied. Wedum was willing to go along with
. the stipulation.
Wedum presented his application and reduced the 8 units
to 4 lots because of the proposed downzoning which will
be presented to City Council. Because of the proposed
downzoning, City Attorney Stuller explained that the
City had legal precedent for making the project conform
to proposed zoning once that proposed zoning had been
considered by an official public ..body. The proposed
downzoning would change thearea from R-15 to R-30
residential. It was discussed whether the B units in th
modified application for preliminary approval would have
met minimum lot size requirements of the R~30 zoning on
the 2.15 acre property.
Jenkins mentioned that he did not object to the concep-
tual application for a four-lot subdivision since the
commission had previously approved a conceptual plan

Hunt moved that they exempt the Wedum-Hyman project frow
planned unit development and recommend conceputal 4 unit
subdivision and one of the amendments would be that no
parking be shown on the plat on. Spring Street. There is
a correction for 4 lots and not 4 units; seconded by
Abbott. All in favor, motion carried.
Clark mentioned that thePardee exemption had been
cancelled.

daily kind of shopping needs; Dobie mentioned that,what
is to be put in the' J;lurant Mall are strictly non-tourist
uses and feels that tourists are not going to come and
buy records. Kane felt that it is stretching the intent
and scope of that zoning designation to put a record
shop in it.'
Hunt moved to recommend disapproval of a record shop in
the Durant Mall as a neighborhoood commercial useage:
seconded by Abbott. All in favor: Collins, Jenkins,
Abbott, Hunt, Otte, Goodheim. Opposed was Dobie.

Clark mentioned that the Engineering Department didn't
have any problems with the'request.as. long as the
requirements of the City Engineer Were fullfilled, .and
as long as there is a non-waiver of the open space
dedication requirements.
Hunt made a motion to approve the subdivision exemption
of Pitkin Mesa Lot 3, Block 3, condi~ioned on the
requirements of the City Engineer and non-waiver of the
proposedopen.space dedication requirementS: seconded
by Goodheim~ All in favor, motion carried.
Stanford explained that the square footage in the
commercial core is 123,000 sq.ft. of commercial allowed,
if allot for the bonus in square footage you would have
an additional 16,400 sq.ft.of commercial giving a net
total commercial of 139,400 sq.ft. with 24,600 sq.ft,
Of residential. This gives a maximum total square .
footage of 164,000 sq.ft. which is equal to or a little
over 3 city blocks.
Commercial-I we have potential build out of 12,000 sq.ft
with maximum total square footage of 18,000 sq.ft. This
is equal to 6 town lots.
Office-l District lot area of 124,500 sq. ft. The'
Planning Department is. recommending .75: 1 being off ice
and .25:1 be in residential provided that itis tied
into a county housing program. Total in Office is
88,875 sq.ft. office space residential square footage
of 31,125 sq.ft. getting a maximum total squqre footage.
of 124,500 sq.ft. Office area gives a total buildout
of equal to 2.3 city blocks. That is if you build at
one level.
