SERVICE
Attached is a copy of the subject application for water service from the City of Aspen, The area
proposed to be served is located in Pitkin County adjacent to the Stillwater Ranch and the Preserve
Subdivision, The proposal is to extend City water service to an existing 19 unit apartment complex
consisting of three buildings located on lots 2 and 3 of the Sparovic Subdivision, The application
for water service is enclosed for your review,
The Shadowood Apartments consist of 19 rental units in three separate buildings, No modifications
are proposed to the existing structures as part of this project. City water service has been requested
for the existing apartments because of the unacceptable quality of water being delivered through the
existing wells serving the complex, Unacceptably high levels of iron and manganese are known to
be persistent problems in the Roaring Fork alluvium in this stream reach, Drilling a new well is not
likely to resolve the problem and treatment to remove mineral deposits involves excessive
maintenance, The two existing wells are proposed to be abandoned and the existing water rights will
be dedicated to the City, The proposed water extension of City water mains would connect to the
existing water system serving the three apartment buildings,
The applicant has made no representation about any future plans for the apartment buildings that
would differ from their current use as rentals, Rental rates are not currently subject to Aspen/Pitkin
County Housing Office guidelines, The apartments are primarily resident occupied, including an on-
site resident manager.
Please provide any comments to this office by September 21, 1998, This project is tentatively
scheduled to be heard by City Council on September 28, 1998, for first reading,

compliance with Aspen's Water Policy Resolution, its ordi-
nances, rules, regulations and construction specifications.
18. Included as part of Exhwft C are the cost estimates for the
proposed construction, and for connection of the extension to
the existing Aspen system. Cost estimates are also required
for associated facilities, such as hydrants, water storage
tanks, pumping stations, water main line pressure reducing
valves and vaults, meter vaults, and water treatment, trans-
mission and storage facilities required to insure proper oper-
ation of. the proposed water service extension,. and/or to
protect Aspen's existing main lines and core facilities.
Detailed breakdowns of the cost estimates are attached as part
of Exhibit C.
19. Included as part of ExhwftC are the proposed Commencement and
completion dates of construction, upgrading or connection of
the water mains, lines and facilities. Attached as part of
ExhibftC is a preliminary Project schedule (e.g., critical path
sequence chart) for the construction of the water mains, lines
and facilities.

the water main, lines and all associated facilities, inCluding
required loops and connection of the proposed extension to the
existing Aspen system.

21. Attached as part of Exhibit D are the estimated gross water
requirements (gpd) , and water flpw requirement for in-building
use at full deve~opment, estimated peak daily water demand,
and average daily demand, and estimated irrigation require-
ments (including number of square feet to be irrigated and
special amenities, such as ponds, pools and waterfalls).

Aspen's water, engineering, and planning staff, attorneys and
the City Manager at the Applicant's expense. If the Applica-
tion is not approv~d, or if additional information or changes
are required, A~plicant shall be promptly notified of the
grounds for disapproval, or the additional information or
changes re~ired before approval can be granted. Applicant
will also be given a written list of additional staff
requirements, if any.

28. City Council Review. This Application and its Addenda,
Exhibits and attachments, and any Aspen staff comments, shall
be submitted to the Aspen City Council. If the Application
(as modified by any agreements that may have been made between
Aspen's staff and Applic~nt) is approved by the City Council,
a Water Service Agreement shall be prepared by the City and
submitted to Applicant for execution.
If the Application is not approved, it shall be deemed
terminated as of the date it is rejected by the City Council. If
it is approved with conditions, Applicant shall have 180 days from
the date of such approval within which to comply with the
conditions. If Applicant fails to comply with the conditions
within said period, the Application shall be deemed terminated the
,day following the last day of the lBO-day period. Applicant may,
prior to the expiration of the l80-day period, notify Aspen in
writing that it is unwilling to proceed further despite approval
with conditions, and the Application will be deemed terminated as
of the date of such notification. Upon termination, the parties'
obligations, other than Applicant's obligation to pay in full the
Evaluation Costs associated with review of the Application, shall
cease and neither party shall have any further obligation to the
other.
APPLICANT UNDERSTANDS AND AGREES THAT ANY WATER SERVICE AGREEMENT
WITH THE CITY OF ASPEN WILL CONTAIN, AT THE CITY'S REQUEST, AT
LEAST THE FOLLOWING REQUIREMENTS:
A. All construction of new facilities or up~rading of exist-
ing facilities shall be done ~t Applicant's sole expense, to
Aspen's standards and specifications, and construction shall be
completed within a time frame agreed to by the parties.
B. All owners of the Subject Property shall agree to annex
the Subject Property (or any portion thereof, as requested by the

Aspen) to the Aspen at such time as Aspen determine such annexation
is desirable.
C. Prior to the 'start of construction, Aspen shall require

performance, payment and maintenance (or warranty) bonds acceptable
to it, and conveyance of water rights or cash in lieu thereof.
D. Construction must be inspected by the City's engineers or
other designated personnel prior to burial or final installation,
and must be certified by a registered professional engineer at
Applicant's cost.
E. Before Aspen will accept any mains, lines or facilities,
Applicant shall conveyor cause to be conveyed to Aspen, in form
satisfactory to Aspen's attorneys, all easements necessary to
enable Aspen to operate and maintain the water extension system and
related facilities when they are completed.
F. Upon completion of construction, all distribution and
transmission mains and all associated water lines and facilities
must be tested at Applicant's expense and approved by Aspen, and
thereupon conveyed (excluding individual servioe lines) to Aspen
free and clear of all liens and encumbrances, by deed in form
,acceptable to the City Attorney.
G. AS.':"built drawings of the water mains, lines and asso-
ciated faoilities, and all other utilities, shall be provided to
the City on reproducible sepias with a maximum size of 24" x 36",
and on an "auto cad disk data transfer file" tied into one (1) set
of state plane coordinates.
H. Unless Applicant has executed a pretapping agreement with
the City prior to construction, tap fees for the water service
provided by Aspen shall be assessed utilizing Aspen's prevailing
applicable tap fee at the time of applioation for a building permit
for the structure for which service is sought, or, if water service
is sought for an existing structure, the tap fee shall be paid
prior to delivery of water to that structure by Aspen. No water
service shall be provided to any structure absent payment of the
appropriate tap fee and any applicable hookup charges.

Policies/Regulations At: the following eir<:umstances exist, the County has no objections
to the Shadowood Apll1'tment's request for CIty water service:
. The parcel is located within the Metro Area;
. There is an existing water main in the Highway adjacent to Shadowood which already
provides service beyond Shadowood to the Preserve Subdivision; Consequently water
service lines are not being extended further east into the County beyond where service
currently exists;
. If placem.ent of the water service extension lines is within an existitli road, then no
1041 Environmental Hazard Review is required;
Permits Rewired An earthmoving permit must be obtained by the applicant fh)m the
County prior to commencement or any earthmoving associated with the service extension,

was approached by the AspenlPitkin Housing Office to consider sale andlor category deed
restriction of these units, gi.ven their use as (\e..flI.cto affordable houBing and their ClC:cellent

tUne.
In the event that the City pursues lIIll'leXation of this parcel pursuam to a water service
agreement, it may be prudent to re-initiate the discussion regarding deed-restriction of

Extension of Water Service
REQUEST: The applicant is requesting approval of the extension of water service to,the
existing Shadow Wood Apartment complex located southeast of the City of Aspen in
Pitkin County, The complex includes nineteen (19) rental units in three (3) separate
buildings on approximately five (5) acres which are approximately 25 years old, The
largest unit is approximately 2000 s,f, and the smallest is 600 s,f, and primarily serves
resident employees, The complex is currently being served by two wells,
CONFORMANCE WITH ANNEXATION PLAN: The subject property is included
within the city's armexation area boundaries, It is a Group C area identified in the
Annexation Plan (Meadowood, see attached Table 1); such area has been declared
"significant potential for growth", Though plarming staff believes that the area should be
armexed to the city if we are to provide water service, it is not clear that the subject
property is eligible for armexation as it doesn't appear to have 1/6 contiguity, It can be
anticipated, however, that this property will eventually fall with the city's jurisdiction,
CONCERNS AND ISSUES: Staff believes that the existing complex may have
additional development potential in the County, Staff supports the idea of limiting the
water service to only the existing apartment complex. To insure future redevelopment
that conforms with the city regulations, planning staff recommends that city council
require that any redevelopment occur in conformance with city zoning.
Because the complex currently serves resident employees, there may be merit in requiring
that the units either be deed restricted as a condition of approval, or that the property be
subject to Title 20 Replacement Housing requirements, The Housing Office may be able
to address this more fully,
lfthe complex is served by an individual sewage system, the Health Dept. may also have
a concern with this, Please refer to Lee Cassin in Environmental Health regarding this
issue,
RECOMMENDATION: The Community Development Dept. has no objections to
extending water service to this parcel provided:
1, The applicant agrees to not object to future armexation to the city;
