Pursuant to my phone calls with Todd of the Zoning Dept, attached is the Temporary Use
Permit application for our event being held on Sunday, December 21, 2008 — below is the
criteria applicable to this event as asked for in Sec 26.450.30. As our event is a little
different in criteria from a true land use permit, I have tried to give the details of our event
as clearly as possible.
The auction is a fine arts/furnishing auction and will be held at the Mountain Chalet —
Aspen, 333 E. Durant Ave. Aspen, Co. (copy of rental agreement for banquet room
attached to application)
(A)The size of the rented space is approx, 1800-2000sf. There will be tables around
perimeter of room for our merchandise and chairs theater stylen the middle of the room
for attendees.
(B) The event is being held in an already established building
(C)There is no impact on pedestrian or vehicular traffic or noise levels as the event is being
held inside the Mountain Chalet Hotel .
(D) Event will take place from 6:30pm to approx. 9:30pm on December 21, 2008
(E) On this point, I do not know the zoning, but aware that it is zoned for hotels
and commercial businesses
(F) As event being held in an already established building, there would be no relative
conditions or character changes
(G) We do not believe this event will diminish the general public health, safety or welfare -
it is an event, open to the public and being held in a hotel.
I have completed Attachment 3 to the best of my ability, along with Attachments 4 and
marking them N/A as they did not appear to be relevant to my event.

WESTERN CLASSIC AUCTIONS ("Group") and the Mountain Chalet ("Hotel")
agree as follows:
By signing and returning the enclosed copy of this contract by November 20, 2008,
these arrangements will be agreed to on a definite basis.
Between now and November 20, 2008, unless both parties have agreed upon and fully
executed this agreement, should another organization request the dates and be in a
position to confirm immediately, we will advise you and you will have three (3) business
days to confirm on a definite basis.
If we do not receive a mutually agreed executed original of this agreement from you by
November 20, 2008, this letter will be void and any room block will be automatically
released.

Bottled water (0.50 liter) for $1.50 each estimating 50 bottles.
The above prices do not include linens, flatware, glassware, or bussing, & serving
personnel.
All prices are subject to 8.6% tax & food & beverages have a 15% gratuity.
PAYMENT SCHEDULE
A $1000 payment is due with the signed contract. Final payment 7 days after final
invoice.
FORCE MAJEURE
The performance of the Agreement by either party is subject to acts of God, government
authority, disaster, strikes, civil disorders, terrorism, or other emergencies, any of which
make it illegal or impossible to provide the facilities and/or services for your meeting. It
is provided that this Agreement may be terminated for any one or more of such reasons
by written notice from one party to the other without liability.
INDEMNIFICATION
Each party hereby agrees to indemnify, defend and hold the other harmless from any
loss, liability, costs or damages arising from actual or threatened claims or causes of
action resulting from the gross negligence or intentional misconduct of such party or its'
respective officers, employees, members and participants (as applicable), provided that
with respect to officers, and employees such individuals are acting within the scope of
their employment.
SIGNATURE
This contract constitutes the entire Agreement between the parties and may not be
amended unless done so in writing and signed by both the Group and the Hotel. The
signed contract must be received by the Hotel, with the initial deposit, by November 20,
2008, If the Agreement is not received by this date, the function space will be released
for general sale.
The undersigned parties represent that they are authorized to sign and enter into this
Agreement.
If either party uses a fax transmittal, then the fax copy shall serve as an original until an
actual original is signed and received by both parties.

certify that I have complied with the public notice requirements of Section 26.304.060
(E) of the Aspen Land Use Code in the following manner:
Publication of notice: By the publication in the legal notice section of an official
paper or a paper of general circulation in the City of Aspen at least fifteen (15)
days prior to the public hearing. A copy of the publication is attached hereto.
Posting of notice: By posting of notice, which form was obtained from the
Community Development Department, which was made of suitable,
waterproof materials, which was not less than twenty-two (22) inches wide
and twenty-six (26) inches high, and which was composed of letters not
less than one inch in height. Said notice was posted at least fifteen (15) days
prior to the public hearing and was continuously visible from the _ day of
, 200 , to and including the date and time of the public
hearing. A photograph of the posted notice (sign) is attached hereto.
Mailing of notice. By the mailing of a notice obtained from the Community
Development Department, which contains the information described in Section
26.304.060(E)(2) of the Aspen Land Use Code. At least fifteen (15) days prior to
the public hearing, notice was hand delivered or mailed by first class postage
prepaid U.S. mail to all owners of property within three hundred (300) feet of the
property subject to the development application. The names and addresses of
property owners shall be those on the current tax records of Pitkin County as they
appeared no more than sixty (60) days prior to the date of the public hearing. A
copy of the owners and governmental agencies so noticed is attached hereto.

1. APPLICANT has submi d to CITY an application for

2. APPLICANT understands and agrees that the Cite of Aspen has an adopted fee structure for Land
Use applications and the M went of all processing fees is a condition precedent to a dete►7nirnation of application
completeness.
3. APPLICANT and CITY agree that because of the size, nature or scope of the proposed project, it
is not,possible at this time to ascertain the full extent of the costs involved in processing the application.
APPLICANT and CITY further agree that it is in the interest of the parties that APPLICANT make payment of an
initial deposit and to thereafter permit additional costs to be billed to APPLICANT on a monthly basis.
APPLICANT agrees additional costs may accrue following their hearings and/or approvals. APPLICANT agrees he
will be benefited by retaining greater cash liquidity and will make additional payments upon notification by the
CITY when they are necessary as costs are incurred. CITY agrees it will be benefited through the grater certainty
of recovering its full costs to process APPLICANT'S application.
4. CITY and APPLICANT further agree that it is impracticable for CITY staff to complete
processing or present sufficient information to the Historic Preservation Commission, Planning and Zoning
Commission and/or City- Council to enable the Historic Preservation Commission. Planning and Zoning
Commission and/or Cite Council to make legally- required findings for project consideration, unless current billings
are paid in full prior to decision.
5. Therefore. APPLICANT agrees that in consideration of the CITY's waiver of its right to collect
full fees prior to a determination of application completeness. APPLICANT shall pay an initial deposit in the
amount of $ 50 °O which is for hours of Community Development staff time, and if actual
recorded costs exceed the initial deposit, APPLICANT shall pad- additional monthly billings to CITY to reimburse
the CITY for the processing of the application mentioned above, including post approval review at a rate of $235.00
per planner hour over the initial deposit. Such periodic payments shall be made within 30 days of the billing date.
APPLICANT further agrees that failure to pa) such accrued costs shall be grounds for suspension of processing, and
in no case will building permits be issued until all costs associated with case processing have been paid.

SUBJECT & SITE OF AMENDMENT: Mountain Chalet PUD, commonly known as
Mountain Chalet, at 333 E. Durant Ave, involving the approval of Temporary Use on the
event date of December 21, 2008.
SUMMARY:
The Applicant has requested Temporary Use approval for the purpose of a Fine
Arts/Furnishing auction to be held in the Mountain Chalet Alpine Room (approximately
1800 - 2000 sq. ft.) on December 21, 2008. The Applicant has reserved the room from
1 lam -12am (event from 6:30 pm to approx. 9:30 pm) on the day of the 21s`. The only
food and beverage at the event will be bottled water.
STAFF EVALUATION:
Pursuant to Chapter 26.450 of the City of Aspen Land Use Code (hereinafter Code),
Temporary Use is one that may or may not be permitted in a given zone district, but
which may be allowed on a non -permanent and temporary or seasonal basis upon
individual review of their proposed nature, location, duration, impact, and compatibility
with surrounding permitted uses and structures, excepting outdoor merchandising or
commercial displays which shall not be permitted as temporary uses. Temporary Use,
specifically Insubstantial Temporary Use, may not exceed a period of seven (7) days and
the Community Development Director has the power to extend this use no longer than
seven (7) additional days.
All Temporary Use Applications are subject to the review criteria under Section
26.450.030 of the Code. This list of criteria has a wide range of items including but not
limited to; location of use, duration of the proposed temporary use, and statements
reflecting upon how the proposed temporary use will enhance or diminish the general
public health, safety, or welfare. All applications must include a description of how the
proposed use indemnifies these items.
The proposed Temporary Use for the single -day auction is Retail. The Mountain Chalet
is located in a Lodge (L), Lodge Preservation (LP) PUD. The Lodge use allows for retail

use. Therefore, even though Temporary Use can allow for certain uses and structures
where they usually cannot exist, the retail use of the Western Classic Auction does match
the existing permitted use. Due to the circumstances stated above, it is deemed
appropriate that the Applicant shall meet the Insubstantial Temporary Use standards and
that the Application be reviewed by the Community Development Director.
DECISION:
Staff finds that the Insubstantial Temporary Use Application provided by the
Applicant, Western Classics Auction (represented by Maureen Connelly) should be
granted the required permit. The room is accessible (via elevator) and has no
building or access concerns. Fire Codes will not be affected as long as aisle -ways
remain open and fire extinguishers remain visible. The Application presented
reputable information regarding the standards in 26.450.030, and the use will not
extend past the maximum of seven (7) days.

Sec. 26.450.030. Criteria applicable to all temporary uses.
When considering a development application for a temporary use or an insubstantial temporary
use, the Community Development Director or City Council shall consider, among other pertinent
factors, the following criteria as they or any of them, relate thereto:
A. The location, size, design, operating characteristics and visual impacts of the
proposed use.
The size of the rented space is approx, 1800-2000 sf. There will be be tables
around perimeter of room for our merchandise and chairs theater style in the
middle of the room for attendees.
B. The compatibility of the proposed temporary use with the character, density and
use of structures and uses in the immediate vicinity.
The event is being held in an already established building.
C. The impacts of the proposed temporary use on pedestrian and vehicular traffic
and traffic patterns, municipal services, noise levels and neighborhood character.
There is no impact on pedestrian or vehicular traffic or noise levels as the event
is being held inside the Mountain Chalet Alpine Room.
D. The duration of the proposed temporary use and whether a temporary use has
previously been approved for the structure, parcel, property or location as
proposed in the application.
Event will take place from 6:30pm to approximately 9:30pm on December 21,
2008.
E. The purposes and intent of the zone district in which the temporary use is
proposed. ..
The Mountain Chalet is in a Lodge, Lodge Preservation PUD Overlay zone.
The intent of the Lodge (L) Zone is to encourage construction, renovation, and
operation of lodges, tourist -oriented multi family buildings, high occupancy
timeshare, and ancillary uses compatible with lodging to support and enhance
Aspen's resort economy.
F. The relation of the temporary use to conditions and character changes which may
have occurred in the area and zone district in which the use is proposed.
As event being held in an already established building, there would be no
relative conditions or character changes.
G. How the proposed temporary use will enhance or diminish the general public
health, safety or welfare.
The event should not diminish the general public health, safety or welfare — it
is an event, open to the public and being held inside a hotel.
