(hereinafter, THE PROJECT).
2. APPLICANT understands and agees that City of Aspen Ordinance No. 57 (Series of
2000) establishes a fee structure for Land Use applications and the payment of all processing fees is a
condition precedent to a determination of application completeness.
3. APPLICANT and CITY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
application. APPLICANT and CITY further agree that it is in the interest of the parties that APPLICANT
make payment of an initial deposit and to thereafter permit additional costs to be billed to APPLICANT on
a monthly basis. APPLICANT agees additional costs may accrue following their hearings and/or
approvals. APPLICANT agrees he will be benefited by retaining Beater cash liquidity and will make
additional payments upon notification by the CITY when they are necessary as costs are incurred. CITY
agrees it will be benefited through the Beater certainty of recovering its full casts to process
APPLICANT'S application.
4. CITY and APPLICANT further agee [hat it is impracticable for CITY staff to complete
processing or present sufficient information to the Planning Commission and/or City Council to enable the
Planning Commission and/or City Council [o make legally required fmdings for project consideration,
unless current billings are paid in full prior to decision.
5. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to
collect full fees prior to a de a nation of applica 'on completeness, APPLICANT shall pay an initial
deposit in the amount of $ ~ which is for hours of Community Development staff
time, and if actual recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly
billings to CITY to reimburse the CITY for the processing of the application mentioned above, including
post approval review at a rate of $225.00 per planner hour over the initial deposit. Such periodic payments
shall be made within 30 days of the billing date. APPLICANT further agees that failure to pay such
accrued costs shall be Bounds for suspension of processing, and in no case will building permits be issued
until all costs associated with case processing have been paid.

has granted an approval for this minor plat amendment.

to the driveway and adjusting the Activity Envelope by taking a portion out of the Seath
southern part ofthe envelope and replacing it on the east side of the residence.

Process:
Apply. Planner checks the application for completeness. Staff then reviews the application against the PUD Amendment Standards.
If the Community Development Director feels that she can approve it administratively, Staff will return comments requesting any
necessary changes on the draft plat. After necessary changes are made to draft plat, the Applicant shall return two (2) mylar copies of
the final plat with all of the necessary signatures obtained with the exception of the Community Development Engineer, the
Community Development Director, and the Pitkin County Clerk and Recorder's acceptance.
If the Community Development Director feels that the proposal requires the Planning and Zoning Commission's review, a public
hearing will be scheduled and the proposal will be forwarded to the Planning and Zoning Commission.

Dear James:
Please find the enclosed Application for Minor Plat Amendment for the subject
property referenced above.
This request addresses the relocation of activity envelope from one portion of the
property to an area adjacent to the building envelope, allowing for requisite
grading and site treatment within the City of Aspen and Aspen Highlands
Design review guidelines and requirements. All areas net out to no increase.
This request is also for the swap and relocation of a small portion of building
envelope to accommodate the overhangs of the proposed structure only. Note:
The entire footprint is within the existing building envelope. Also, this
amendment amends an exiting but non-defined access easement on the Final
Plat. This purported easement, upon information and belief, was for the benefit
of the Aspen Fire Protection District. To accommodate the slight adjustment in
Building Envelope, a very slight reduction of the purported Access easement was
required. This re-defined easement has been memorialized in a Deed of
Easement, executed by both the Aspen Fire Protection District and by Harry
Sloan, the owner of Lot 5, the parcel subject to this Minor Plat Amendment.
Under Aspen City Land Use Code Section 26.445.100 (A) PUD Insubstantial
Amendments: An insubstantial amendment to an approved development order for a
final development plan may be authorized by the Community Development Director (as
long as minimum criteria are met). This minor amendment application is in
accord with the submittal standards for a minor amendment as it does not
change any of the following criteria:
1. A change in the use or character of the development.
There is no change in the use or character of the development.
2. An increase by greater than three (3) percent in the overall coverage of structures
on the land.
There is no increase at all in the overall coverage of the structure as
proposed. This application is to accommodate the overhangs only, that
they will fall within the Building Envelope as required by the City of
Aspen and Aspen Highlands PUD.
3. Any amendment that substantially increases trip generation rates to the proposed
development, or the demand for public facilities.
There will be no additional trips generated or demand for public
services as a result of this application.
4. A reduction by greater than three (3) percent of the approved open space.
There will be no reduction in the area of approved open space. The
activity and building envelopes in this application net out.
5. A reduction by greater than on (1) percent of the off-street parking and loading
space.
There will be no reduction of off-street pazlcing as a result of this
application

6. A reduction in the required pavement widths or rights-of--way for streets and
easements.
There is no reduction in the required pavement widths or rights-of-way
for streets and easements. Additionally, the fire depaztment has
reviewed and approved this insubstantial plat amendment for their
access requirements.
7. An increase of greater than two (2) percent in the approved gross leasable floor
area of commercial buildings.
N/A. This application pertains to residential property within the PUD.
8. An increase by greater than one (1) percent in the approved residential density of
the development.
The residential density will not be affected by this application.
9. Any change which is inconsistent with a condition or representation of the
project's original approval or which requires granting a variation from the
projects approved use or dimensional requirements.
The project's approved use or dimensional requirements are not
changed by this application. Additionally, the Aspen Highlands
Design Review Boazd (DRB) has reviewed and approved this
application.
Based upon the compliance with the standards for an Insubstantial Amendment
demonstrated in the above summary, we respectfully request that this
application be reviewed and approved administratively by staff and the
Community Development Director.

Plat -Community Development Department's Comments
Please make the following modifications to the proposed plat:
1. Amend the proposed building envelope so that there is not an increase
in the size of the building envelope over what currently exists. The
plat currently shows that there would be a slight increase in the size of
the building envelope over what currently exists. The City's
administrative building envelope adjustment policy does not allow for
an amendment to be approved at a staff level that increases the size of
a building envelope or an activity envelope on a parcel.
,/ 2. Include a legend of lines to help delineate between building envelope,
activity envelope, and easements.
'~ 3. Include a sheet index on page 1.
f 4. Label the easement on the west side of the property.
,/5. Include an elevation benchmark.
6. Add a plat note to page 2 that describes why the access easement does
not start unti120 feet above grade.
7. Obtain all signatures with the exception of the City Community

copies to the Community Development Department. A recording fee
of $21.00 (payable to the Pitkin County Clerk and Recorder) is due
