2. APPLICANT understands and agrees that Pitkin County Ordinance No. 32 -2002 establishes a
fee structure for land use applications and the payment of all processing fees is a condition precedent to a
determination of application completeness. The fee structure is based on the County's policy that development
shall pay, in full, the cost of development review in Pitkin County. Fees have been set to be consistent and fair
to the public and to reflect the expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it may not be possible at the time of application to ascertain the full extent of the costs involved in
processing the application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications
shall accumulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and /or Board of County
Commissioners to enable the Planning Commission and /or Board of County Commissioners to make legally
required findings for project approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY's waiver of its right to
collect full fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the
amount of $ Q% which is based on2Chours of staff time, and if actual time spent by staff to process the
application exceeds the average number of hours by more than 20 %, then the COUNTY will bill the
APPLICANT quarterly for the additional time spent. Such periodic payments shall be made within 30 days of
the billing date. APPLICANT further agrees that failure to pay such accrued costs shall be grounds for
suspension of processing.

1. Label the adjusted lot line as 'old lot line' and 'new lot line'.
2. Add note on the plat explaining the purpose and reason for the lot line
adjustment.
3. Add note: 'The approval of this lot line adjustment shall not effect the
development rights, allowable F.A.R., or permitted density of either lot
involved in said lot line adjustment.'
4. Add signature block for Community Development Engineer's Approval.
(This lot line adjustment has been reviewed and approved by the
Community Development Engineer this _ day of 2003.)
5. Add signature block for Title Company. (I can provide an electronic
template of the title company's signature block.)
6. Add administrative decision number to Com -Dev Director's signature
block. The reception number will be added by City Clerk at the time of
recordation.
7. For recordation: (i) Supply two mylar copies of the plat with the
signatures of owners, title company and surveyor. (ii) The cost of the
recordation is $11 for the mylar plat. The cost to record the
development order is $6 for the first page and $5 for each page
thereafter. (Thus, if recording the plat and a two -page development
order, the cost is $22.) The check should be made out to the Pitkin
County Clerk and Recorder.

RE: LOTS 3 AND 10 SNOWBUNNY SUBDIVISION - LOT LINE ADJUSTMENT

SUMMARY:
The applicant, Heidi Bertholf, owner of Lot 3, Snowbunny Subdivision, has applied for a
lot line adjustment to move a common lot line between the residences located on Lots 3
& 10 of the Snowbunny Subdivision. The applicant proposes to move the lot line
between Lot 3 and Lot 10 approximately 5 -7 feet to the east in order to correct a boundary
dispute between the two owners.
LOT LINE ADJUSTMENT:
A Subdivision Exemption for a Lot Line Adjustment may be approved, approved with
conditions, or denied by the Community Development Director pursuant to Land Use
Code Section 26.480.040(A), Lot Line Adjustment.
Staff feels that the proposal meets all of the applicable review standards as set forth in
Land Use Code Section 26.480.030(A)(1), Lot Line Adjustment (see criteria listed on
page 2 and 3 of this report). In accordance with the criteria, staff believes that the
proposal is an insubstantial boundary change because of the modest change in the
location of the lot line. The applicant and the owner of Lot 10 have consented to placing
a note on the lot line adjustment plat that states that no additional development rights,
allowable density, or allowable floor area ratio (FAR) will be authorized on either of the
properties by virtue of executing the proposed lot line adjustment. Both property owners
have consent to apply for the lot line adjustment, as is required by the review criteria by
virtue of both owners signing the plat. Therefore, staff finds that the proposed lot line
adjustment meets the applicable review standards and recommends that the Community
Development Director approve the proposal with the following conditions:
1. The Applicant shall prepare and record a lot line adjustment plat with the Pitkin
County Clerk and Recorder that meets the City of Aspen's land use code plat
requirements within 180 days of this approval.

REVIEW PROCEDURE:
A lot line adjustment may be approved, approved with conditions, or denied by the
Community Development Director pursuant to Land Use Code Section 26.480.040(A).
REVIEW CRITERIA:
Lot line adjustment. An adjustment of a lot line between contiguous lots if all the
following conditions are met:
a. It is demonstrated that the request is to correct an engineering or surveying error in a
recorded plat or is to permit an insubstantial boundary change between adjacent
parcels; and
b. All landowners whose lot lines are being adjusted shall provide written consent to the
application; and
c. The corrected plat will meet the standards of this Chapter, and conform to the
requirements of this Title, including the dimensional requirements of the zone district
in which the lots are located, except in cases of an existing nonconforming lot, in
which the adjustment shall not increase the nonconformity of the lot. The plat shall be
submitted and recorded in the office of the Pitkin County Clerk and Recorder. Failure
to record the plat within a period of one hundred eighty (180) days following approval
shall render the plat invalid and reconsideration of the plat by the Community
Development Director will be required before its acceptance and recording; and
d. It is demonstrated that the lot line adjustment will not affect the development rights,
including any increase in FAR, or permitted density of the affected lots by providing
the opportunity to create a new lot for resale or development. A plat note will be
added to the corrected plat indicating the purpose of the lot line adjustment and the
recognition that no additional FAR will be allowed with the adjustment.
STAFF ANALYSIS OF REVIEW CRITERIA:
Staff finds the application to be in compliance with all of the above review criteria.

RECOMMENDATION:
Staff recommends the Community Development Director approve this lot line adjustment
with the conditions as proposed below.
