Regular Meeting Planning and Zoning Commission September 21, 1976 Chairman Chic Collins called the meeting to order at 5:10 PM with members Roger Hunt, Dick Kienast, Olaf Hedstrom, and John Schuhmacher present. Also present were City Attorney Stuller, H&-i Clark, and John Stanford. Hunt moved to table the minutes of the August 31, 1976 meeting. Kienast seconded. All in favor, motion car- ried. Old Business Wedum-Hyman--Subdivision Preliminary Plat approval Clark mentioned that this was a continued public hear- ing. Wedum was resubmitting his final plat after securing a clear title for the entire piece of property. Clark stated that City Attorney Stuller had submitted a memo to the board. Stuller said she did not quite know how the agreement between Wedum and Catherine Lucas would be formalized. Wedum still had not acquired title to the tracts he is including in his application. Stuller said that the risk of an illegal conveyance of property lies with Lucas, and the building department has been alerted to watch for any development application on Lot 7. Hunt asked if Lucas was aware of this. Stuller said her attorney had been contacted to this effect. Hunt opened the public hearing. Remo Lavagnino asked Stuller if Lucas were to deny owner- ship to Parcel 3, what would happen. Stuller replied that a factual exantinationwould have to be done at the time that thaCbecame an issue. If the issue were not resolvable, it could go to court for review. Hunt closed the public hearing. Kienast moved to recommend the Wedum Hyman preliminary plat reapproval conditioned upon the finalization of the title Stuller clarified that the P&Z was reapproving the final plat of the subdivision. One of the conditions of the approval should be that the title action should be fin- alized to Wedum's advantage before it is recorded. Kienast added this to his motion:' Hedstrom seconded. All in favor, motion approved. Annan/Snell Subdivision Exemption Nancy Snell was present. Hal Clark told the commission that this was a request to condominiumize a duplex. The City Engineer recommended approval. Hunt moved to approve the subdivision exemption of the Annan/Snell Duplex conditioned upon nonexemption of the park dedication fee. The purposes of the regulations have already been fulfilledx Kienast seconded.. All in favor, motion carried. Horowitz Development Proposa l-Progress Report Chuck Brandt told the P&Z that since his last appearance before the commission, he had checked with the North of Nell Association, the Ski Corp, and had checked up on the pump house in regard to City easements. F. NOf CK EL B. B.6 L, G0. Planning and Zoning September 21, 1976 City Attorney Stuller commented that the Code states that no conditional use expansion can take place without the procedural hearing. Shellman said this was only a mini- mal adjustment, and that perhaps he needed a defini- tion of accessory use. A use determination , if neces- sary,could be made by the P&Z for uses not recognized. Collins requested a plan of exactly what is proposed. He suggested that perhaps the use could be determined by the staff if this is the proper authority. Shellman assumed the responsibility to go to the people appointed, but preferred to have the P&Z resolve it. He asked the commission whether they viewed the use as conditional or permitted. Shellman maintained that the plans submitted included a food preparation area. Nick Coates stated that the expansion was necessary to accommodate the health requirement for 4 sinks. The space for serving food would remain the same, and no cooking facilities would be added. Collins told the P&Z that if the determination of use as submitted on the most recent plans is not an acces- sory use, the recourse lies with the Board of Adjustment. Shellman said there was a secondary consideration of whether the commissionfelt that it should take jurisdic- tion over the matter from the standpoint of modifying a use. Shellman showed the plans submitted when the building permit was issued. The. board studied the plans. Collins pointed out that the question was really a matter of the appropriateness of the use as a conditional acces- sory use. Collins suggested that the board take the time to look at the plans and table action until a pub- lic hearing could be set. Hunt moved to set a public hearing date of October 5, 1976 for a conditional use determination, Schuhmacher seconded. All in favor, motion carried. Cleveland Subdivision -- Conceptual Presentation Tukey Cleveland asked that a site inspection take palce as soon as possible. Clark mentioned that a new survey has been done and the proposed development was close to the property line. There were also aesthetic considerations due to the possible impact on adjacent property owners. A site inspection was scheduled for September 23, 1976. Hunt moved to continue the action until October 5, Hedstrom seconded, The board reserved the option to take action at the site inspection. Hunt withdrew his motion. Hunt moved to set a hearing at the site inspection. Kienast seconded. All in favor, motion carried. Kienast said he had no objection to the height; it may even enhance the corner. An entrance on Bleeker for service vehicles may be a problem in the winter due to the shadow a building 4 stories high would cast. Hal Clark was concerned with the pool becoming private rather than public. Clark noted that the PUD was voluntary, not required, because the Jerome is a hotel, not a subdivision. Rezoning Alpine Acres--Annexed portion Hunt moved of set a public hearing for October 19, 1976 for the rezoning of the annexed portion of Alpine Acres. Kienast seconded. All in favor, motion carried. Conditional Use-- Arthur's Restaurant Expansion Hedstrom moved to set a public hearing date of October 19, 1976 for the conditional use hearing for the expansion of Arthur's Resturant. Schuhmacher seconded. All in favor. Motirn carried. Rezoning Aspen Institute Properties Kienast moved to set a public hearing date of October 19, 1976 for the rezoning of the AIRS properties. Hedstrom seconded, All in favor, motion carried. Kienast moved to adjourn. Schuhmacher seconded..
