Clark told P&Z that the Planning Office recommends approval in accord with the preliminary approval granted June 15, 1976. Clarl: recommended that the SPA be approved .with the exception that the subdivision regulations are still applicable and will be dealt with more thoroughly at the final plat stage. Clark additionally commented that the applicant also wished the P&Z to act on the subdivi- sion exemption of a small triangle of land in front of the Aspen Savings and Loan property. The Planning Office was in agreement vaith this request. Barry Edwards, representing the Trueman applicants stated that the right-of-way encompassed 75 feet. The triangle would be conveyed to Aspen Savings and Loan as a boundary adjustment. Collins aslced if this conveyance could affect tiie parking configuration. Clark stated that the pro- posal would not tamper with the parking. Clarlr emphasized that the application was still sub- ject to the subdivision regulations and conditions put on the approval of the prelirinary plat (6-i5-76), Collins opened the public hearing. There were no citizen comments. Collins then closed the public hearing. Bill Kane stated that the City should reserve the option to revieva the conveyance of the specific lots. He mentioned that under an SPA, the allovaable uses are those prESCribed for the tJC and S.C.I. zones, vaith the exception of Lots 3 and ~I. City Attorney Stuller stated any uevelopment on Lots 7 and 3 will come under PUD araendr::ent. i:ane stated that a reviev~ _~_. ~. -z- •a.zop TPtozauuiop oq aoz~~p -p !soz3 snuPgs anlozar aqq q~TgM uo Agzadozd aqq auozaz oq gsanbaz P si silty gsan a~ butuozad--uotsu2dxg atuozar Tagol; •pai.z.zPO uoigoiu '.zonP3 u-c TTy •papuooas oPPSy '9L6T '6 zaqulanoN Ttqun tue.zbozd aouPgsissP butsnoq aqq 3o uotssnoszp aqq aTgPq oq panotu zaggzn~ Uso.zgspa;; • pat.z.xPo uotgotu '.xonPY ui TTy •papuooas qunr; •gL6T '6 zaq -ulanon; Tiqun utagi aqq aTgPq oq panots tuo.zgspag 'uoiq -PZiulniuttuopuop xaTdnQ agzany aqq zo3 gsanbaz uoigdula -xa uotstnipgns aqq .zap-rsuoo oq alum. 3o xoPT oq ana •paiz.zPO uoigoul 'sonP3 ui TTEI •ulozgspa;; ~iq papuooas uotgo;7 •aouapisag ssog pTo.zPg aggy3o uoig2ubisap ~T.IOgSTq aqq zoo uoignTosaz P g3P.zp o1 panom oPPSi • bui.zPaq otgTnd aqq pasoTo suiTTop •orTgnd ai;q uloz3 squal;n;IOo ou azaM azai;y •bui.zPaq oiTgnd aq} pauado suiTTop sqg .za~aaTg puP t;q, qP asnoq aqq ;o uoig2ubzsap aqq jo zaggPUl aqq agipadxa Z5d aqq gPgq paxsP uaozg ~i.zPZ •dnozb goPa tuoz~ quasazd sPM ulnaonb ~ •?yd puP pd;; aqq uaaMgaq buz.zPaq oiT -qnd quioC E SPM sigq gPgq pauoiquau pzo3uPgg ugor uotg2u rsaQ oi.zogsig--aouapisau ssou •panozddP uotgoul 'zonP3 ut TTy •uotgolu aqq papuooas gs2uatg •gPTd uoisrn -ipgns aqq sanozddP qz Ttqun uoigdtua;a aqq uo qoP qou PTnogs Tiounop I.gtp gPgq pappP zaTTngg Aau.zoggy ~~tp ~Igza -do.zd ssaggPT aqq so quacldoTanap q.zoddns oq abPquo.z~ ggrM ueoZ puP sbuinPg uadsy apino.zd puP agndsip dzPpunoq P aTggas o} paub-rsap si aouP~ianuoo silty •qS TTTyQ buzuioCpP puPT 3o aTbuPi.zq P uP0'j puP SbLITAPs uadsy aqq oq buidanuoo puP buiTaozad .zo3 uoteintpgns 3o uotgiut3ap aqq tuo.z~ paquP.zb aq uoigdlua -xa gPgq Tiounop Agip ai;q oq spuatutuooa.z Z5d 'S uoigotu sigq ui panozddP uPTd aqq o} squatu -puautP agngzqsuoo TTPi;s ga-cgM'qoea zo; uPTd Kd6 ot~ioads P 3o TPnozdcIP oq zotzd aoPTd axPq TTPgs "v PuP'£'Z sgo7 ;o qua>sdoTanap ocI '£ uPTd aqq uo pagou sP 9-g LIT sasn paggir,IZad quasazd aqq oq pagttuiT si ~ qoZ •Z ITddP Trigs .zaauzbug ~qtp puP TPnozd -dP gPTd AzauztuiTazd aqq ~o suoigipuoo aqq •T :bur -MOTToz aqq uodn pauoigtpuoo '9L6T 'TT zagogop pagap uozgoid TPnozddy uPTd KdS aqq 3o TPnozddP puaunuooa.z oq panoni qunx; ydg uPUlanzy •quatudoTanap zoo aTgPgtns qou sz qoT aqq aouis 'ssaoozd aqq sagPOiTduzoo dTuo qt asnPOaq Maina.z .zapun at;IOO qou pTnogs ' azo~a.zagq ' qo7 •goizgsip Toogos aqq oq 'p qo7 Aanuoo oq puP g-g sP qt daax oq buixaas si zadoTanap at;q puP '9-d pauoz 'apzsTTiq daags P uo si {, qo7 gPgq paiuPTdxa spzPMpg •paqueab aq pTnoo TPnozddP gPTd TPUZ~ aso3aq aoPTd a:~P~. pTnoM gLST 'Z zaqu~anop, iIOTSSTI:P.*SO7 buruo~ puP butuuPTd RECORD OF PROCEEDINGS 100 Leaves EOgM 50 C. Stanford had had a work sessoin with the Jerome applicant, John Gilmore, and had some observations on the project. Stanford referred to the memo in the PL~Z packet which reconunended that the P&z consider rezoning as the Jerome could then become expanded as the applicant proposed caithout as much economic hardship. Stanford showed the site plan of the Jerorle property. `i'he pri- mary concerns of height and bulk, which the planning office feel is much too large, and the consideration of the open space are the points of contention. At the last study session, the applicants had rede- signed the model to set the :ith story back, raaking it much smaller than the 4th story. The applicants also had Bane to the F;PC to address the problem of height. i:ienast asked what the zoning was in the area behind the Jerome. Directly to the north, the zoning is O- Office. Tom dells gave a summary of the most recent figures on FAR numbers. :•dells stated that the idea was to try to keep the setbac}: from C4i11 St. to expose the tiE corner of the Jerome. In terms of the open space, Hells stated that to accommodate the requir- ments and desires of the Flanning Office, the num- ber of rooms would have to be decreased The project is only feasible if the 100 rooms can be built as pro- posed. Kane agreed with the concept of a first calss hotel, but was reluctant to recommend lpproval because of the size. The development proposal e::ploits every square inch of possible space in the CC zone. The Planning Office still encouraged Gilmore to proceec: along the same lines, but to approach the project with realistic requests in terms of massing. Kane emphasized that the P&~ was not concerned with evaluating the project from a standpoint of economic hardship. Stanford while supporting the general concept, said that if the P6Z chose to recomrLiend a zoning change it should carry with it a condition that the zoning not ao into effect until the PUD is approved. John Gilmore stated that each plan l:e has made has been shown to the Planning Office. At this tis,e lie has rooms on the lobby level; ar. impractical place for tourist rooms. If those were eliminated, the number of rooms would be cut, making the project less feasible. Gilmore furthere stated that the bur- den of renovating the building was the thrust of the program, and that without 100 rooms, the restora- tion could not be done. Tom SVells stated that the original building would be virtually reconstructed; adding baths to the rooms which currently do not have them. -3- -~- •ans E sE suozgotzgsaz atuES auq gsowiE aq iiTM azauq Z'3 e' auq 3o Mainaz auq ugtM gEuq pauoiquaci suiiioR •uozgEindod asuap 3o asnEOaq qou 'uozgEZapisuoo agis puE 'ssaooE 'adois 'suTbzEUiureazgs 3o asnEOaq aniona s~rnd gEuq qno paquzod zaiings ~Iauzogq~ Aqi~ •padoianap aq zanau iiTM puEi auq gEuq aaaquezenb E qou st azauq qnq auEid Ma-cn auq sazzubooaz buiuoz Si-~ auq gEuq papuodsaz sagep •asEO siuq ui pasn aq pinous qi 'szopizzoo Main auq goagozd oq sgsixa tustuEuoass auq aouzs gEuq pagEqs uiEbE suiununR '~q?~ auq oq sgi3aisaq iezanas osiE azaM azauy •agEZ puE qE pasn aq pinot+, saornzas dgiR •squbiz sagEM 30 butquEZb auq sEM suoigEZapisuoo auq ~o aup •sgoi auq butxauuE 3o gJEd1ST iEJST~ auq uo paquaum,[oo auEy •agngEqs ~Iq pazTnbaz si uEuq zadoianap E uo azou~ asodtsi oq agEizdozddE qou sEM qi gEuq sanbzE sagep •squapisaz auq ~o sgsazaqui aqq goagozd oq papaau seM uoistnzadns azo~u sdEuzad 'dEigno pasodozd auq uanZb gEuq pagsabbns suiuuinR •auEid Main auq zo3 agesuadi;too oq auop aq pinoM buTdEJSpi[E'j 'aliITq stag qE iEOTgoEZd qou sEM sbuTpiTnq atiq buiSuEZZeaz gEuq cans sEM uEid gold auq gEuq pagEqs sageoR xoir; •goadsaz gEuq ui auo iensnun uE qou si asEO stag puE 'zEinoipu2dzad qou aze sgaazgs auq 'sgituii Agin auq uts}uaudoianap huEU[ uT gEuq piES sagep Ruuaq •squapzsaz auq zo3 uoigoagozd agenbapE azaM s~oEggas paztnbaz auq gEitq pagEqs nuE 'buZUOZ ci_g auq ~o squaciaztnbaz auq pauiEid -xa puE 'squiod piien azaM asauq gEuq Paqou xzEi~ •aioziR ~zEd punoze sMain auq anEu oq azauq panots szauMO quasazd auq 10 ~uEW •auEid Main ,szauMo ~gzadozd buzpunozzns auq goagozd pinoM quaiuazinb -az QRd ieuotq?PPE auq gEuq Paqou suzumm~ pzEuoig •buizaau oiignd auq pauado suiiioJ •pua gEuq ustiduLOOOE pinoM QRd auq gEuq PazarasuE xzEiJ •aigeaazbE aq uoigE -ngis auq pinoM 'Aiquaza~~ip pagengzs azaM sgoi auq puE pafiuEuo azaM tCEM- ZO-gL;bTZ auq 3T paXsE gang •Agzadozd auq uo QRd ~zogepuEtu E asodiuT pinoo Zgd auq 3i paxse sagEp 'sazoEr auidiy ~o buiuoz Si-~ auq 3o Main uy •asEO szuq ui Zgd auq ~o aioz auq pauoigsanb au gEuq pagEqs sagep •buigaatu auq oq snoin -azd pagonpuoo sEM uoTgoadsui agis ~ •sageoR xoiN 'gnEJTiddE auq quasazdaz oq quasazd seM sagep ~iuuaZ gsan ag buiuozau sazoy aui iF7 •paizzEO uozgoui 'zonE3 ui iiK •papuooas gang '9L6i 'L zagL~saoaQ uo ZJ oq p uioz3 buiuoz auq burbuEuo zapisuoo oq buizeaq oriand E gas oq pano~i mozgspag •satgzed agog ~o sasodznd auq usiidu~oooE piT~M CRd ugzM buiuoz ZR sdEuzad gEuq Paqou suiiioR •buipiinq pasodozd auq 3o sgi3auaq auq ubiaM -qno pinoM coeds iEiozauruoo puE s~uooz pappE auq 30 goedutz auq qnq '~izoatq ui gzedE zE~ qou azE a.zou[ii~ puE Zed auq qno ,paquTJd ag •RR uEuq zaugo aq oq buiuoz auq axti pinoM au gEuq paxzEi+iaz suiiioJ 9L6i'Z sagtuanoN buiuoZ puE buiuuETd RECORD OF PROCEEDINGS 700 Leaves FOgM 50 L. i. R-i5 is an appropriate zoning, and while it is unfor- tunate problem for the Park Circle residents, the PUD should not be required as this constitutes spot zoning. Collins opined that the speciality of the area and the site warranted a PUD. ?:ienast stated that the unknown in the situatio:. was how high and cahere the builidngs would be placed. Oates said that Coates would be willing to conurit to the site plan as sub- mitted. Hunt told the P«7. that the stream rrargin review would further restrict the site and place-- rnent of buildings. Isaac sai-' that the mass of the two proposed units vaas larger than fire surrounding units, and that a mandatory PUD was in order. F.al Clark noted that if the annexation falls through because of the zoning, there would be no guarantees that the proposed amenities (landscaping)czould occur, and no guarantee that the land would be de- veloped to the liY.ing of the Park Circle residents. i{ienast said that the ow::er of the Alpine Acres should also have the right to set the buildings for the best possible vie:vs for its tenants.
