Regular Meeting Aspen Planning and Zoning November 2, 1976
Chairman Chic Collins called the meeting to order with members Hedstrom,
Hunt, Kienast, Schuhmacher, and Isaac present. Aleo present were City
Attorney Stuller, Hal Clark, Bill Kane, and Sohn Stanford of the Planning
Office. The rEieeting convened at 5:10 Pi~I.
Hunt moved to table approval of minutes, seconded
by Kienast. All in favor, motion carried.
The Home Plate--Conditional Use Bearing
Vice Chairman Bunt entertained a motion to set a
public hearing for November 16, 1976 to discuss
the conditional use in the Mountain Chalet of
a restaurant to be operated by Jim ~;urst. Kienast
moved, Isaac seconded. All in favor, motion carried,
Sunrise Apartments
Aspen Wild Apartments
Subdivision Exemptions
Kienast moved to set public hearings for the
Sunrise Apartments and the Aspen Flild Subdivision
to consider Subdivision Exemptions. Schulunacher
seconded. All in favor, motion carried.
SPA--Trueman Application
Hal Clark mentioned that this was a public hearing
to discuss the SPA approval for the 'Trueman appli-
cation. Clark told P&Z that the Planning Office
recommends approval in accord with the preliminary
approval granted June 15, 1976. Clarl: recommended
that the SPA be approved .with the exception that the
subdivision regulations are still applicable and
will be dealt with more thoroughly at the final
plat stage. Clark additionally commented that the
applicant also wished the P&Z to act on the subdivi-
sion exemption of a small triangle of land in front
of the Aspen Savings and Loan property. The Planning
Office was in agreement vaith this request.
Barry Edwards, representing the Trueman applicants
stated that the right-of-way encompassed 75 feet.
The triangle would be conveyed to Aspen Savings
and Loan as a boundary adjustment.
Collins aslced if this conveyance could affect tiie
parking configuration. Clark stated that the pro-
posal would not tamper with the parking. Clarlr
emphasized that the application was still sub-
ject to the subdivision regulations and conditions
put on the approval of the prelirinary plat (6-i5-76),
Collins opened the public hearing. There were no
citizen comments. Collins then closed the public
hearing.
Bill Kane stated that the City should reserve the
option to revieva the conveyance of the specific
lots. He mentioned that under an SPA, the allovaable
uses are those prESCribed for the tJC and S.C.I. zones,
vaith the exception of Lots 3 and ~I. City Attorney
Stuller stated any uevelopment on Lots 7 and 3 will

Kane noted that at this time, the date should be set
for a hearing. Stanford had had a work sessoin with
the Jerome applicant, John Gilmore, and had some
observations on the project.
Stanford referred to the memo in the PL~Z packet
which reconunended that the P&z consider rezoning as
the Jerome could then become expanded as the applicant
proposed caithout as much economic hardship. Stanford
showed the site plan of the Jerorle property. `i'he pri-
mary concerns of height and bulk, which the planning
office feel is much too large, and the consideration
of the open space are the points of contention.
At the last study session, the applicants had rede-
signed the model to set the :ith story back, raaking
it much smaller than the 4th story. The applicants
also had Bane to the F;PC to address the problem of
height.
i:ienast asked what the zoning was in the area behind
the Jerome. Directly to the north, the zoning is O-
Office.
Tom dells gave a summary of the most recent figures
on FAR numbers. :•dells stated that the idea was to
try to keep the setbac}: from C4i11 St. to expose the
tiE corner of the Jerome. In terms of the open
space, Hells stated that to accommodate the requir-
ments and desires of the Flanning Office, the num-
ber of rooms would have to be decreased The project
is only feasible if the 100 rooms can be built as pro-
posed.
Kane agreed with the concept of a first calss hotel,
but was reluctant to recommend lpproval because of
the size. The development proposal e::ploits every
square inch of possible space in the CC zone. The
Planning Office still encouraged Gilmore to proceec:
along the same lines, but to approach the project
with realistic requests in terms of massing.
Kane emphasized that the P&~ was not concerned with
evaluating the project from a standpoint of economic
hardship.
Stanford while supporting the general concept, said
that if the P6Z chose to recomrLiend a zoning change
it should carry with it a condition that the zoning
not ao into effect until the PUD is approved.
John Gilmore stated that each plan l:e has made has
been shown to the Planning Office. At this tis,e lie
has rooms on the lobby level; ar. impractical place
for tourist rooms. If those were eliminated, the
number of rooms would be cut, making the project less
feasible. Gilmore furthere stated that the bur-
den of renovating the building was the thrust of
the program, and that without 100 rooms, the restora-
tion could not be done. Tom SVells stated that the
original building would be virtually reconstructed;
adding baths to the rooms which currently do not have
them.

Collins closed the public hearing.
Hunt said the area should logically be RbSF. R-i5
is an appropriate zoning, and while it is unfor-
tunate problem for the Park Circle residents, the
PUD should not be required as this constitutes spot
zoning.
Collins opined that the speciality of the area and
the site warranted a PUD. ?:ienast stated that the
unknown in the situatio:. was how high and cahere the
builidngs would be placed. Oates said that Coates
would be willing to conurit to the site plan as sub-
mitted. Hunt told the P«7. that the stream rrargin
review would further restrict the site and place--
rnent of buildings.
Isaac sai-' that the mass of the two proposed units
vaas larger than fire surrounding units, and that
a mandatory PUD was in order.
F.al Clark noted that if the annexation falls through
because of the zoning, there would be no guarantees
that the proposed amenities (landscaping)czould
occur, and no guarantee that the land would be de-
veloped to the liY.ing of the Park Circle residents.
i{ienast said that the ow::er of the Alpine Acres
should also have the right to set the buildings
for the best possible vie:vs for its tenants.

the Alpine Aores Subdivisuon R-15. ::ienast secon-
