Regular Meeting Planning and Zoning Commission Nov. 16, 1976 Chairman Chic Collins called the meeting to order at 5:15 PM with members Danny Abbott, Dick Kienast, John Schuhmacher, Olaf Hedstrom and Tom Isaac Also present were City Attorney Stuller, Housing Authority Brian Goodheim, and planners Hal Clark and Bill Kane. Roger Hunt moved to table approval of minutes, seconded by Abbott. All in favor, motion carried. Old Business Hal Clark introduced the resolution to adopt a low and Low and moderate moderate income housing plan for new rental units. City income housing Attorney Stuller explained that the resolution reflected plan what she had extracted from P&Z comments, the previous memo from Goodheim, and her notes on the subject. The resolution draft was open to comments from the Commission. Hunt mentioned paragraph 3, regarding 'reasonable rate of return on investments'. Using Park Circle Condos as an example, Hunt pointed out that it was not ,corking there, because the closing costs were not initailly inclu- ded. Abbott brought up the point that tenants should not be Parking charged for parking.. Goodheim said that the cost woax].d contribute to the auto disincentive program. Hunt commenter that if the parking was sub-grade, the situation is dif- ferent, and the cost should be passed on to the tenant. Hunt further stated that the better way to state the parking agreement is to charge the renter if the space provided is used, or to plug the cost of the parking into the rent cost if the renter uses it or not. Goodheim responded that the idea is to provide low cost housing, and that he would rather see less parking spaces required as a bonus, and allow those people who do want parkings space to purchase it, Kane suggested that the question of charge- ing for parking should be left to the individual owners of buildings since there was very little legislation to govern the issue. Dick Meeker, developer of Park Circle, said he was under the impression that P&Z had suggested at the last meeting that utilities not be included in the rent cost. Stuller Utilities said she was of the opposite view, but the resolution could be changed either way, Tom Isaac asked if the right of first refusal would lie with the tenant or the Housing Authority. Goodheim stated that the Housing Authority had the right of first refusal Right of first re- in order that the Housing Authority could set the price if fusel the units were condominiumized. Meeker stated that the paragraph on condominiumization might cause him some problems. There may be spanething in condominiumization a construction loan that requires a certain amount to be paid off, making the selling of one or two units a possible solution. Meeker felt the condominiumization clause would preclude the selling of units. Stuller pointed out that the idea at hand was to provide rental units, not condos. Meeker replied that if he were providing long term hous- ing, there is little difference between leasing or owning the unit. F. XOECM EI B. B. fi L G0. Planning and Zoning November 16, 1976 zone. Kane said that was the intention. Norma Dolle Norma Dolle, Snow 4ueen Lodge owner, asked that a few .,things be clarified. She asked if ,for now and in the future the restrictions would apply to her property. Kane said the proposal would apply to new construction. Luetta Lurby asked if she could rent her unit for the Luetta Durby Christmas season, in view of the period being only 2-3 weeks. Kane stated there was no provision for this. Clark added that an amendment might be considered for this purpose. Goodheim noted that it might be wise to leave the issue on the basis of complaint by neighbors. Often a two-week rental is a hardship on the neighbors, Brent Waldren pointed out that the ability to rent one's Brent Waldren unit out during peak times often allows one to buy the unit. He also told the commission that by restricting the owner to certain leasing provisions, it did not insure that the unit would be put on the rental market, Nick Coates mentioned that owners were wondering if Nick Coates they could still rent short term. He said that the new regulations would put people in the position of breaking the law. He disagreed with the idea of letting people enforce the law because it would lead to too many quarrels as it is difficult to get tenants to agree on goals. Rick Ferrell asked City Attorney Stuller if it is legal to have zoning laws apply only to new structures. Stuller Rick Ferrell answered that most zoning laws are for prospective building only. Goodheim pointed out that looking at the whole situation, including the intent of the zones, much thought went into the locating of the zones within the City. The RMF zone was designed to promote permanent housing, not tourist uses. Rick Ferrell said that he had tried the 6 month leasing process on a philosophical basis, and was offended that the City was operating without an ordinance concerning this process. Goodheim pointed out that several other units were operating within the same process, Clark named Aspen Main, Sunrise Apartments, and Aspen Wild as the others in the RMF zones that are doing the same thing without legislation. Marge Babcock suggested that employers be required to pro- Marge Babcock vide housing for their employees, thus eliminating some of the problem, Collins entertained a motion to continue the public hearing until November 23rd and table action until then, Abbott moved, Kienast seconded. All in favor, motion carried. Tom Isaac said that much of the problem was the wording of the proposal. Perhaps the Planning Office could clarify the language. Group Home for the Aged Group Homes for the Aged Hal Clark introduced the item and said the the Planning Offcie recommends approval of the Zone Code change to allow the use.
