Chic Collins, Roger Hunt, Danny Abbott, Dick Kienast and Tom Isaac were present. Also present was Hal Clark of the Planning department and City Attorney Dorothy Nuttall. Montgomery Clark reviewed the appropriateness of Montgomery Ward applying Ward license for a zoning exemption. 1) Alpine Wholesale already has been at that site and it was essentially the same type of business. 2) They already have a business license from the city for that use. 3) We recommend that since they already have a valid use at that site that they just withdraw their application. As an additional comment we recognize the access problems of using that site and we will work with Mr. Andrews and the engineering department to try to resolve those problems. Collins entertained a motion to the effect that we recognize the memo from the Planning department that Montgomery Ward's has a non-conforming status and that they be permitted to withdraw their application and that they continue to work with the city engineer's office to correct the blocking and traffic access at the site. Hunt made a motion. Isaac seconded. Motion approved. Lacy Duplex Condo Clark discussed the Lacy request. This is a duplex located on the corner of Hopkins and Park Ave. This is a request for a stream margin review and for an exemption to PUD requirements on property owned by Joe Lacy who is represented by Ted Mularz the architect for the project. A duplex is required to be processed through the PUD requirements. It has been determined from the plans that he is exempt from PUD requirements. The building would be located above the 100 year flood line. No vegetation would be disturbed. We recommend the conditions outlined in the letter. Lacy Duplex. Stream margin review and PUD inspection. A discussion of the ditch pursued. The architect clarified that he would build over the ditch and not obstruct it. Hunt motioned that we approve the stream margin review and recommend exemption from PUD for the Lacy duplex as presented on the preliminary drawing dated March 18, 1977. Any changes to the single access to the property, the vegetation plan or the structure location would nullify this motion and would subject the project to further review, Further conditions 1) information be provided satisfactory to the city engineer establishing the right to build over a ditch as shown in the sight plan; 2) adequate measure being taken during construction to protect the stream bank from errosion and the stream from additional sedimentation; and 3) a fifteen foot public trail easement to be dedicated through the property along the stream side precise location to be determined cooperatively with Mr. Lacy and the city. Isaac seconded. Motion passed. Condominiumization. Goodheim talked about the condo study. Study focuses on condo of apartment dwellings as opposed to duplexes. The reasons for this were that there is some question as to the impact of duplexes of condo and data is much more easily obtainable for the larger structures. Condo of apartments has significant impact because it is done is large chunks. Special Meeting continued Planning and Zoning Comm, March 22, 1977 32 percent of the housing in Aspen in condo. Over the past ten years 80 percent of the construction has been in condo form. Now most preferred type of ownership. Provides highest and best use for a piece of property. We have to decide what sort of community we want to be. We do need to maintain a significant number of apartments in this community for the employees. Need a new set of guidelines. It is becoming a social question. We need to control the effects My project is studying the Redwoods, 700 West Hopkins, the Tailings and Aspen View and who the condominiumizing entity is - tenants, third party, real estate, etc. I am also studying the displacement effects. We want to discourage the lack of housing opportunity because of appreciation and the gradual drying up of the rental market, but not home ownership in particular.
