The Aspen Planning and Zoning Commission held a regular meeting on February 7,
1978, at 5:00 PP'i in the City Council Chambers. Members present were Olaf
Hedstrom, Donald Ensign, John Schuhmacher and Joan I:lar. Also present were
I:aren Smith and Bill I:ane of the Planning Office. Hedstrom was acting Chair-
man.

the applicants would waive the right to protest the
formation of an improvement district, and the applicants
waive their right to encroach on the alley. They also
recommend that the payment of the Park Dedication Fee
be deferred to tl:e time of a building permit issuance
on Lot (HI).

Ensign asked how they keep track of park dedication fees
thac are deferred. Pane said they must pay when they
corae in with a building permit application.
Chuck Brandt presented an aerial photo of the land in
question. He noted that the units on lots A and B are
short term rentals and they would be sold. The tenant
of CD has expressed an interest in purchasing the land
he occupies. Shaw occupies the larger horr.e.
Hedstrom asked Brandt if he had any problems with the
conditions that would he imposed. Brandt said he felt
they were minimal.
Iilar asked if tenant displacement vaas an appropriate
consideration with subdivision ea:eniption. I:ane said
Ordinance ~~ applies this to only condominiumization.
Brandt noted that the only ter_ant displacement would
be on lot (CD) and the tenant has expressed a desire
to buy the land.
Ensign moved to grant exemption from the strict appli-
cation of the subdivision regulations inasmuch as the
intent of those regulations has keen met to divide
Lots A-I, Block 25, City of Aspen, into Lots (A), (B),
(CD), (EFG), and (HI), and justifying tl:e existence
of non-conr`orming lots (A) and (B), with the purpose
of preserving its historic character and inasmuch as
no adverse affect on housing is created, subject to
the conditions that 1) the applicant waive right of
protest for the formation of an improvement district
for construction of sidewalks and gutter along 5th
Street for lots (I;I), 2) applicant waive right of
protest for t';e formation of an improvement district
