Regular Meeting Planning and Zoning Commission August 17, 1976 Chairman Chic Collins called the meeting to order at 5:13 PM with members Dick Kienast, Roger Bunt, Olaf Hedstrom present. Danny Abbott was excused. John Schuhmacher was absent. Also present were Bill Kane, John Stanford, and Hal Clark of the Planning Office, and City Attorney Sandra Stuller. The minutes from the July 27th meeting were approved with Approval of Pflinutes the following corrections: Page 2,para.4, line 2,typo; Page 3, Para 4, line 9, change "these" to "lease"; Page 4 para.4, line 12, strike "getting some sort" and add "that a savings and loan would be an appropriate ", Page 5, para. 2, line 3, add "any square footage excess of dedication feeshould be compensated by the City, or any square foot- age remainder to be paid by the applicant, Pge 5, para.8 line 3, typo, Page 6, pare 2, line 8, typo. Hunt moved to approve the minutes with these corrections. Kienast seconded. All in favor, motion carried. Chairman Collins suggested that a resolution be drafted Old Business in recognition of the fine service rendered by Allison Dowr ing to P&Z. Kienast so moved, seconded by Hunt. All in favor, motion carried. Bill Kane said he would like to set up a weekly work ses- 6dork Session Sion to study the projects at hand. It was decided that the session would be held at noon on Tuesday preceding the 5:00 meeting. Public Hearing-- Public Hearing---O-Office District 0-Office District John Stanford explained the proposed amendment to the O- Office Zone. It is to clear up the recent zoning changes in the historic district.The major changes are divided into three areas: first, the change in permitted and con- ditional uses; second, the area and bulk requirements; third the off-street parking requirements. Business apgd professional offices were changed from conditional use to permitted uses. Restaurants, fraternal lodges, boarding houses and shop craft industries were added to the list of conditional uses. The parking requirements are such that 3/1000 sq. ft. are required, and fewer spaces can be permitted by special re- view by the Planning and Zoning Commission but no less than 1.5 spaces per 1000 sq. ft. Elizabeth Paepcke agreed with the planning office in its Public Comments recommendation, but proposed that it would be a better idea if it were made economically feasible for the owners to maintain their houses, either through a tax adjustment or some kind of break frerri the City. $rom Therese David questioned the criteria used in determining which uses were appropriate and which were not. Regular Meeting Planning and Zonin Commission Aug. 17, 1976 Public Hearing for Diain Street Historic District Public Hearing-- Main St. Historic John Stanford stated that all buildings in the historic District district would come under review of the HPC for any ex- terior remodeling or reconstruction of an existing struc- ture, and the demolition or moving of an historic struc- ture. The procedure an owner would go through to accomp- lish any of the above is (1) submit preliminary plans to the building inspector, (2) Present the plans to HPC for review in regard to compatability with the surround- ing structures, (3) HPC either gives approval or disap- proval, (4)applicant has recourse to appeal to City Council within 60 days from the decision of the HPC. The justification of the historic district is that it is Justification one way of preserving the historic structures of Aspen, makes Main St. more attractive to tourists, protects the views of Independence Pass and Aspen Mountain, and is com- patible with the general plan. Stanford submitted several documents to the record, including maps, proofs of publi- cation, letters from property owners, and notices of pub- lic hearings. The public hearing was opened• Barry Shaw said that the plan was an excellent one, but that he wants a written guarantee that the uses allowed will be the same for approximately the next 10 years. Hans Gramiger stated that the guidelines of the HPC are HPC review built-in safeguards for the owners as well as for the Committee. He further stated that since architectural review is illegal in Colorado, the HPC is the closest that we can come to it. Larry Groen pointed out that the HPC, in considering a new structure, prefers to see a contemporary one rather than a fake Victorian. He said the quality and compati- bility is more important than the attempt to make a stab at creating 'Victoriana'. Shaw said that he wanted to go on record as being against Historic designation, and wanted his letter to Groen en- tered into the public record. Olaf Hedstrom moved to approve the joint resolution of the HPC and P & 'L to establish a Main Street historic district. Motion to approve Kienast seconded. F. XOECY. EL R. B. R L. G0. Regular Meeting Planning and Zoning Commission August 17 1476 Kane said he would review the proposal for rezoning for the Commission. Kane proposed to give the Institute's planners an idea of what to expect in terms of what the Planning and Zoning Commission will require of them. Collins said he would rather continue the meeting to next week. However, he allowed that Kane should go ahead with the description of the proposal. Description of Kane said that he thought it was appropriate to proceed proposal without a master plan, but it would not be reasonable to assume that the zoning could be accomplished without additional plans. The application could be summarized in the following way: (1) a proposal for increased ac- {~commodations in the area. The proposal calls for a total nT €e-356 rooms, broken down as follows: conversion of 8 trustee houses into 16 lodging rooms; 282 lodging rooms in a new structure; construction of 20 new executive suites; conversion of the Kresge Bldg. into 56 units to be used for employee housing and subsidized accommodations; (2) a propsal to change the zoning of the riding ring to R15 or have adequate compensation,(3) the area across Castle Creek to be reserved for future lots. In addition to these physical improvements, the application carries with it a request to give speedy treatment to a convey- ance of 30 acres to Denver University (DU), and consider- ation to the conveyance of 20 to 30 acres for construction fo the conference facility. The existing health club would be upgraded and integrated with the proposed new buildings. The concern of the Plan- ning Office is that hotel rooms will create less in the Impact of hotel way of auto impact if the planning is such that the area rooms be car-free, and totally shuttle supported. Planning recommends that whatever plan is settled on, that it be a plan which takes into consideration th~transfer of den- sity from the surrounding areas. Planning feels that fur- ther subdivision in the area would be an impact on the residential area, and that there was no guarantee that the housing would not be used as a hotel, however Planning has voiced support of the preliminary plans. In general, Kane said that more information will be re- quirec~pecifically on how the units are to be used. On a conceptual level, given that density would be trans- fered from the riding ring to Castle Creek, there is no problem with the number of units. Kane suggested that perhaps some of the needs of the community could be served. As an example, some of the MAA housing needs, Ballet YVest, Housing needs and various performing arts groups could be dealt with in this setting. The application is practically devoid of any mention of winter use, and the actual role of DU. Fritz Benedict is the architect on the project, and pa3-r~a• to use natural materials. flans Donald McKinley, a trustee of the Institute, stated the position of the AIHS. He expressed appreciation to the Planning Offiee for the work they have done. His point was that the Institute is interested in using the confer- ence center for its conferences in the summer, and DU wouYl carry on in the winter.
