Continued Meeting Planning and Zoning July 27, 1976
Meeting was called to order by Chairman Chic Collins at 5:09 PM, with
members Rogers Hunt, John Schuhmacher, Olaf Hedstrom present; Danny Ab-
bott and Allison Downing were excused. Also present were Hal Clark of
the Planning Office, City Attorney Sandra Stuller, and John Stanford of
Planning.
This was a continued meeting from July 20, 1976. The
public hearing on the Gustafson Child Care Facility was
also continued from the last meeting.
Gustafson Child Conditional use of the Gustafson Child Care Facility.
Care Facility-- Hal Clark filled in the background information. He pre-

cility. Clark said that there were three areas of con-
cern that Planning had pinpointed. The first being the
conditions of the house itself. The conditions are reg-
ulated by the State Department of Social Services. One
particular condition is that the Facility must be fenced
in to protect children from traffic. The second area
of concern is the affect on the neighborhood itself.
Clark stated that the Facility does not interfere with
the other uses in the neighborhood. The third area of
concern was the circulation of traffic in the area. The
Hobbit House could cause several traffic problems. The
Planning Office recommends approval of the conditional
use in view of these concerns.
Mary Gustafson was present to represent the Hobbit House.
She presented the minutes of the Council Meeting on con-
ditional use.
Collins asked City Attorney Stuller if conditional uses
can accrue. Stuller said they could not; every time the
use is changed, enlarged, or expanded the conditional use
must be reviewed. The approval is unique to the pre-
mises. Hedstrom asked if the approval would change if
there were an upsurge of the same type of businesses in
the immediate neighborhood. Stuller said that the Commis-
sion had the right to review in this instance.
Dick Kienast arrived at 5:23 PM.
Stuller said that Clark was suggesting that the use should
be reviewed if the neighborhood changes, or if the traffic
patterns have changed so much that a review seems necess-
ary. Clark read a letter from Marion Stewart, Director
of the County Department of Pulbic Welfare, which stated
her support of the Day Care Facility of k4ary Gustafson,
and her desire to see continuation of the facility in the
new location. Gustafson submitted a petition signed by
Petition renters and owners in the immediate area who had no ob-
jection to the relocation of the Hobbit House, even if
it meant having two child care facilities in the area.
The petition is on file in the City Clerk's Office, as is
the letter from A4arion Stewart.
Citizen Comments
Sandy Sherff, a parent of a child who attents Hobbit House
Sandy Sherff said she drives in from Snowmass, and has never exper-
ienced a traffic problem.
Fred Smith, another parent, said he would take his child
Fred Smith whereever the Hobbit House moved.

(cont.) Dick Kienast asked if Gustafson was required to sign a long
term lease when she moves. She replied the lease was a
five year one. She also added that until her present lease
is up, she will be paying two rents. Keinast asked if
Ms. Gustafson would be willing to accept a conditional use
approval if the condition were attached that there be a one
year review on the use.
Clark pointed out the problem of remodeling the new fac-
ility.
Collins closed the public portion of the hearing.
Hunt moved to approve conditional use of the Gustafson
Motion to approve Child Care Facility at 735 W. Bleeker noting the com-
ments of the Planning Office. This approval expires on
August 31, 1977, and anually thereafter for the purpose of
a re-hearing reviewing any changes in the impact on the
neighborhood. The hearing will be held in the month of
August anually. The purpose of the last condition is to
eliminate the possibility of proliferation of this type
of use in this neighborhood because of `K changes with-
out satisfactory review. Olaf Hedstrom seconded. Hal
Clark said he thought the Planning and Zoning Commission
Option to review could reserve the option to review without locking itself
into reviewing every year for the next thirty. Clark alas
corrected the address of the facility. It is 726 W. Blee-
ker. Chairman Collins said he would rather reserve the
option to review, rather than reviewing every year.
City Attorney Stuller pointed out that the conditional use
approval was tied to the property, not the applicant. She
further stated that perhaps the commission would like to
condition the right of review on two conditions: change
of conditions in the neighborhood, and application for
another child care facility.
Collins suggested an amendment be made to the motion.
Amendment to Hunt amended the motion as follows: Upon the first annual
motion meeting the commission shall determine at what periods the
expiration will occur in the future. Further, this condi-
tional use is a suitable use in the neighborhood, and com-
plies with Section 24.3b of the Zoning Code. Hedstrom sec-
onded. All in favor, motion approved.
Aspen Savings and Loan--Continued Public Hearing
Aspen Savings Clark introduced the item. This is a hearing to consider
and Loan--cont. the conditional use of the financial institution in the
Public Hearing N/C Zone located on lots DEFGHI of Block 78, Aspen,
Colorado, more generally ]mown as the Bennett property.
It is adjacent and south of the Trueman Grocery Store.
The approval is for a business office rather than a pro-
fessional office building. The Planning Office recommends
approval of the application as long as the exclusion of a
drive-up window is part of the application. Michael Con-
visor was present to represent Aspen Savings and Loan.
He stated that all he wanted Planning and Zoning to do was
to determine if they would allow Aspen Savings and Loan to
operate on the site, and if so, they would go ahead and
buy the property.
City Attorney Stuller objected to the approach being used.
She stated it seemed that the applicant was trying to get
a guarantee before telling what the configuration of the

Clark explained that the exemption entailed exempting the applicant
from full conceptual, preliminary, and final plat requirements. The
recommendation from Planning and approval by Council is all the
applicant has to go through if the exemption is granted.
Dick Keinast moved to grant subdivision exemption conditional on

Clark corrected the figure of 436 Sq.ft. to 871 Sq. ft.
Hedstrom seconded. All but Hunt were in favor. Motion carried.
Revision to Office Zone
Revision to John Stanford of the Planning Office said that if P&Z was in agree-

district designation, Planning could set a public hearing, and as-
sume approval. Stanford suggested August 17th as the date for a
public hearing.
Hunt moved to accept August 17, 1976 as the date for the joint pub-

Joint Public proposed Main St. Historic Designation. Keinast seconded. All in
Hearing favor, motion approved. Collins added that preliminary approval was
granted.
Stanford int¢r:oduced the office district item. One of the concerns is
how to evaluate accessory dwelling units when they are done by spe-
cial review, as part of an office development. One of the other con-

historic structures. They are antique stores, furniture, book,

they be non-tourist oriented uses, and non-traffic generating, or
parking generating uses.
Hunt asked about the combined commercial-residential use, using

memo also stated that under external floor area ratio, the floor
area is controlled. Stanford pointed out that under conditional uses
restaurants were not included, but if there was sufficient public
comment they could be considered. however, Planning suggests not
including them in the conditional use because they are traffic gen-
erators and do require a substantial amount of parY.ing.
Another point brought up by Stanford was that if there was a house
that is historically designated in the office district that is not lc
cated on Main St., Planning would like to allow a bonus for offices
