Meeting was called to order by Chairman Chic Collins at 5:15p.m. with members
Dick Kienast, Olaf Hedstrom, John Schuhmacher, Roger Hunt, Allison Downing and
Danny Abbott present. Also present were City/County Planner Bill Kane, City
Attorney Sandra Stuller and Hall Clark of the Planning Department.
Approval of Minutes Hunt moved to table the minutes of June 22, 1976. Schuh-
macher seconded. All in favor, motion passed.
Election of Officers Collins suggested to put the election off until Abbott
and Downing arrive at 6:OOp.m.
Old Business Clark asked City Attorney Stuller to comment on the City
Public Hearing Condi- Council's decision on the Ordinance which would permit
tional Use Historical the Conditional use of Museums in the R-6 zone. City
Museum in R-6 Attorney Stuller commented there was a second reading
and the ordinance was drafted as an emergency measure,
which means it becomes effective immediately on the
second reading, so this Board does have jurisdiction to
consider the Conditional Use hearing. Collins opened
the public hearing. There were no comments from the
public. Clark referred to a letter from the packet, from
George Vicenzi, the sole adjacent property owner on that
block. Collins asked why the proposed Carriage House
could not be located 5 feet west and 6 feet south as
Vicenzi had requested. Clark had discussed this with
Vicenzi and Ramona Markalunas, this is a predesigned
location and this particular site works well with the
Museum access off Hallam street, integrates well with
their siding and their patio. The Museum desires not to
move the Carriage House the extra distance which Vincenzi
requests. The Planning Office has looked at it and can
see no real reason to move the location and recommends
that it be approved as it is shown on the submitted
plans. Clark explained if it were much closer to
Vicenzi's house, Planning would recommend that it be
moved, since it is about 30 feet, it is a reasonable
location. Clark read from the Code Section 24-3.3 (b)
points 1,2,63. Collins closed the public hearing.
Motion Hunt moved to approve the Conditional Use of Aspen His-
torical Museum, specifically the addition as described
in the plans dated April 3, 1976 as the plan is complete-
ly compatable with the surrounding area. Schuhmacher
seconded. All in favor. Motion passed.
New Business
Set Conditional Use
Hearings. Bunt moved to set Public Hearings for Conditional Use
for Aspen Savings and Loan Profession Office and the
Floradora resturant in an Historic building. The First
Aspen Savings and Loan Public Hearing is set for July 20,
1976; the Floradora Resturant is on August 3, 1976. Ms
Stuller explained the City Council hadto adopt for
designating the Floradora historical before they are
eligible for conditional use hearing. The second hear-
ing before Council is July 12, 1976

Housing - N.J. if you go with the last, comparable housing, that is a
Legislation Cont. very strong measure. Kane suggested an option to deny
condominiumization if they could not come up with compara-
ble housing. Stuller said perhaps certain units be retain-
. ed as rental for a certain period of time. Kane agreed
that is a possible solution to the N.J. law as it is fair-
ly rigid. Goodheim stated it is not the condominiumiza-
tion itself that is the problem, rather the displacement.
Stuller suggested three year leases. Collins asked that
someone check to find out how well the law has worked in
New Jersey. Stuller will check the Attorney General's
offfice and Kane will check with the Planners in that area.
Allison Downing arrived at 6:OOp.m.
Goodheim stated he is in favor of the New Jersey law and
thinks it could be cut down to one or two gages. Kane
agreed it just needs to be drafted into a form that would
be taylored to the City's needs. Collins saw no real pro-
blem with it. Clark asked Stuller is there something we
could do now for people in the middle class range want-
ing to buy half a building? Collins asked how much of this
is the responsibility of the Planning and Zonning Commiss-
ion? Stuller said every time you adopt a zoning code you
try to accommodate every type life style within the com-
munity. The problems are not really land use ones but
economic ones. Kane advised condominiumization imposes
a cash flow problem people can't meet. Stuller said for
the first time the Planning and Zoning is going to have to
look at financial capacity. Now you are being asked to
discriminate between one use or another based on financial
capacity.
Danny Abbott arrived at 6:15 p.m.
Collins advised they were not taking official action at
this time. Kane advised it is something that this board
would be responsible for administering. Collins said the
Board wold look at it and forward a resolution. Stuller
said Council would like to know the Boards comments.
651 Monarch (cont.) Collins abstained. Hunt took over as acting chairman and
opened the discussion on preliminary platt for 651 Monarch
Subdivision. He advised they had conducted an on site in-
spection last week, property owned by Hans Cantrup, four
one-bedroom units, project located on 6000 sq feet, zoned
L-2, which requires one space per bedroom parking. The
project has been designed to integrate with the Caribou
project next door. Comments from the City Engineer are
attached to your packet and his basic recommendation is to
approve the preliminary platt subject to these conditions.
Continuing problem, as when Council approved the plan,
subject to a limitation that the building only be used for
a short term occupancy, in order to conform to a L-2 des-
ignation. The City Attorney advised that we could not re-
quire a long term lease on a project therefore could not
require a short term lease. Architect Welton Anderson said
last week, they were still agreeable to limit the project
for short term uses. We have not resolved how that can be
done legally and incorporated into the Subdivision approval.
Originally one major problem was to design the building
around the cottonwood trees. Anderson has gone to consid-
erable expense to have the project re-designed to canta-
lever around the cottonwood, to protect the root system,

fits in. The major changes are in the minimum lot area

What this is, is a resolution to try to clarify our origi-
nal planning and zonning resolution. The action we are
seeking tonite is just to set a public hearing on this.
We recommend you set a hearing for July 20, 1976 and we
can discuss it then.
Motion Hunt moved to set a Public Hearing on July 20, 1976 con-
cerning the Resolution of the Aspen Planning and Zoning
Commission in regards to O-Office district area and bulk
requirements. Downing seconded. All in favor. Motion
approved.
Election of Collins opened the Election of Officers. Hunt moved to
Officers nominate Chic Collins for chairman. Downing seconded.
Downing moved to close nominations. Hunt seconded. All
Motion in favor. Motion carried.
Collins opened the nominations for Vice Chairman. Downing
moved to nominate Roger Hunt for Vice-chairman. Seconded
Motion by Danny Abbott. Hunt moved to nominate John Schuhmacher
for Vice-chairman. Dick Kienast seconded. Downing moved
to close nominations. Hunt seconded. Votes were tallyed
by the secretary. Roger Hunt four votes, John Schuhmacher
three votes. Roger Hunt is Vice Chairman.
Resolution on Collins requested a Resolution commending Libby Klym and
Commendation of adding his thanks to Libby for her fine work and patience
Libby Klym all these months and hours, also for the last packet which
contained the Zoning Code and Subdivision Regulation.
Downing moved to adjourn. Hunt seconded. All in favor.
Motion carried. Meeting adjourned at 7:00 p.m.
