Regular Meeting As en Planning and Zoning Commission December 9, 1975 Meeting was called to order by Chairman Jack Jenkins at 5:20 p.m. with members Roger Hunt, Patrick Dobie, Brian Goodheim, Chic Collins, Mike Otte and Danny Abbott present. Also present was City Attorney Stuller and Hal Clark from the Planning Department. Old Business Clark mentioned that they have one addtional item under Old Business which is a Resolution of the Designation of Four Historic Structures; all it needs is the Planning and Zoning's signature. (The Resolution is attached to this set of minutes and can be found in the Record Proceedings book in the back of these minutes) Clark asked that one additional ordinance be added which is the Open Space Ordinance. City Attorney Stuller explained that she initiated a change and the change would go to the Planning and Zoning. It will be Item )k6 under old business. Ordinance $85, Series of 1975. Jenkins felt that as a result of the last few meetings, everyone is going in many diverse directions without guidance; therefore, he went nd spoke with Mayor Standley with the following ~~i~iis-in mind. He would like to have a joint meeting with the Planning Department, City Council and Planning and Zoning to ask for policy direction for the Planning Office and for the Planning and Zoning in connection with the following items: a) policy direction with what to do with Spring Street; if it is open for consideration or it is outside the realm of consideration. b) We cannot plan unless we recognize that a growth rate is going to occur and if so what do we think it is going to be and if we recognize this fact then we must plan accordingly. c) The buildout in the City is one of our smaller problems; we have to think about Snowmass and the presently subdivided lots in the County will be the things that continue to pressure us with what was discussed under item (b) above. d) Jenkins feels that if we downzone it should last for a reasonable period, and that would be from 3 to 10 years; or it will be just temporary zoning and if we do temporary zoning we pacipitate movements and buildings that are .uacompletely unreleated to the needs of the community because people are fearful of continued and further downzoning so we need to say; what do we really want to do and I am not interested in something that will last a year. e) Do we our do we not, for the City Council level, want a small perimeter markets in which we make an effort to make them almost "inconvenient" as opposed to a supermarket or location in town where we put the services we need for the local resident. I want the Council to tell us what their policy is about one-stop shopping, perimeter markets. I have no guidance and if I can have the answer to that then I can give them answers to other detailed problems. f) when we get into the area of discussing the uses that are stated in the neighborhood commercial and the S/C/I zone, I want to have someone tell me that, yes the permitted and conditional uses that we have listed are things that we see or feel that the City and/or the County pressure that we are going to receive needs in this area. Either the uses that are both permitted and conditional in those two zones and are desirable within the City or they are desirable outside the City and I want the Council to tell us if they want those uses in the City or outside of the City. . -Z- :saoTnzas Azequa~uajddns guEgxoduci xaugo og sauioo qi uauM 'xanaMOg •azis sTug3o uMOg E ui spoouzoggbiau guapuadapuz anxas ueo nod aoinzas poo3 3o janaj auq ui •spoouxoqubiau jExanas uz buTOinxas poouzoqubTau ajggrj 3o gdaouoo aug ugTM aaxbE q,uEO au gEug pauoTguauc ME j, •ajgE-rn puE pijen qr sr puE 'si gi gEuM :jerozaunuoo poogzoqubiau 3o gdaouoo auq gEi;M 3o uoiszoapur aqg axE asouq puE 3o gubnouq anEu Aagg gEqq suoigou 3o ajdnoo E do gubnozq MEN •xeaA zaugouE zo3 33o qnd aq jjiM gt gEug uozgEZapisuoo xo3 jiouno~ Agz~ og buTOb azo3aq jengdaouo~ xabuoj AuE 330 qnd si goaCozd aug 3r gEuq pauorguaui MEN Agxadoxd uEUranxy •uoTSStunuo~ buruoZ puE buiuuEjd aqg puE jiouno~ Agz~ ugiM buigaam a ajnpagos jjTM xxEj~ •gsij auq og pappE aq pjnous apues~ oTg aug 3o sbuTjaa3 s,buiuoZ puE buiuuEjd puE anssT buTxxad aug puE sjjEiu aug gEqq pagsabbns xzEj~ •auop sgab buiugou os buraaxbesip SAEMjE azE aazgg jjE puE sAxosrnpE jje EaxE buTUOZ puE buiuuEjd puE jiouno~ 'quaur~xEdaa buzuuEjd auq gEC[g gja3 osjE aggp •jTOUno~ anxas uEO buTSIOZ puE buTUUEjd os buruoZ puE butuuejd og Aoijod azoiu agEOiununuoo og spaau jiouno~ •sgubnouq s,buTUOZ puE buiuuEjd aug buizapisuoo gnougrM uxnq opgj op jjTM jiouno~ 'spuaunuooax buruoZ puE buruuEjd Lj~TuM u[agr uE uagM asnEOaq si Audosojiud s,jiouno~ aug gEuM axns you azE Aaug gEug sjaa3 puE j-couno~ aug anxas o} asoddns si buiuoZ puE buiuuEjd gEgg sjaa3 aggp •burxurug azaM sxaquiaiu buiuoZ puE buiuuEjd auq gELIM oq pzebax AuE anEq g,upip Ajjeax jiouno~ aqq gEqq u-rseg txg aruu~ ajggiZ uo jiouno~ ggiM pEu Aagg uoissas Apngs aug gEug gja3 aggp •uragt acres aqq LjgTM .auop aq pjnous sjaa3 jTOUno~ gEqM puE iuagi uE gnoqE uoisioap E buzxE~u gnoqE sjaa3 buiuoZ puE buiuuEjd gELjM uaaMgaq deb E anEq jiouno~ puE buruoZ puE buiuuEjd aqq gEqq sjaa3 ag •poob Azan qou sEM buiuoZ puE buiuuEjd puE jzouno~ Aqi~ uaaMgaq digsuoigejax aqq gEqq gja3 aggp •jiouno~ aug ugzM uozssas Apngs E ajnpauos og paaxbE xzej~ •jT~unO~ Agin ugTM AxESSaoau aq pjnoM uoissas Apngs E gEuq paaxbE szaquray~ •soidog asagg xanoo og jiouno~ aug ugTM uoTSSas Apngs E anEq buiuoZ puE buiuuEjd aqq anEu og anoiu oq buijjiM aq pjnoM puE gsrj aug oq paaxbE qung •EazE slug uz aouepinb Aorjod gnoggTM uo-rsinipgns jengdaouoo Agzadoxd ueuranxy aqg uo uois-roap ~uabTjjagui uE axE~u g,ueo puE sbuigaa~u Mai gsEj auq ~uoz3 u~iu paxaggoq anEq gEuq sbuiuq axE asaug gE'gg pauozquaui suixuar •qubzxjE aq q,uEO gEug 'umop siuq auoz aM 3i geug AjgET3 AES noA uauM •buiuozdn paau ggbitu gEug EasE uE gE buixooj 3o Agijigissod auq. ageuru[ija aM a3ij 3o AeM a sE butuozuMOp uo dnbunu gab aM uauM gEug sjaa3 suTxuar (u •quEM Ajjeaz g,uop aM sbuzug 3o puTx axe Aaug asnEOaq jeuoirgpuoo aug xapisuoo oq guEM g,uop aM zo jeuoigipuoo puE paggi~uzad gnd noA sasn uMOp qnd noA uauM gegq sn jjag og Apogau~os quEM I •agozM noA geug aj~TgxE aug 3o gno gob I gEuM s,gEuq puE pagueM aM gEuq buzugatuos g,uaxaM szaugo aug gEt[g paijd~ui au puE sasn paggi~uxad auq azaM paMOus au jjE uotgEguasaxd asn sTu ugxo3 gubnoxq pxo3uEgg uauM qnq sEM gi ggbnoug au gEug gja3 suixuar •aoueutpxo ac{au-r uaggixM Ajxeajo Aggazd seM gEuq gEuq gja3 xxEj~ •ajgExisap aq you pjnoM auoz aug ui qi 3o Agiotjdigjnut aug xo gi 3o az-rs aug gi 3o adEus aug zaugauM Moux oq quEM aM :gubizjE si asn auy •asn jEUOTgTpuO~ E sT qi gEuq pies anEu aM asnEOaq asn aug you 'uoigexnbi3uoo sqr qE xooj axoiu auo axEg oq SguEM aoi33O buiuuEjd aug xo/puE jzouno~ Ag-r~ aug xo/puE buzuoZ puE buiuuEjd auq gEgg buiaq aouaza33ip Ajuo aug :asn paggiu~xad e sE qubix E gon~u sE gsnC s-r asn gEgg sz asn jEtIOTgTpuO~ E 3o buzpuEgsxapun Aiu si gi you zo zaugauM puE qubix Aq si asn paggiuixad E gEug (p,guo~) aiu sjjag gEug buipuegssapun ue anEu oq axij pjnoM i (b ssauisng pjp SL6j '6 xaquraoaQ uoissiunuo~ buiuoZ puE buiuuEjd uads~ RECORD OF PROCEEDINGS 100 Leaves FgiM f0 L. F. XOELI(EL B. B. 8 L. CO. Regular Meeting Aspen Planning and Zoning Commission December 9, 1975 Trueman Property laundary, shoes, drug store, those type of shops, the (COnt'd) whole town could hardly support one. He can't support the fact that neighborhood shopping centers can support a whole nucleus of needs. Yaw then looked at what it takes to support a minimum neighborhood shopping facility that is, the basic needs that are outlined in the zoning. It takes 7,000 to 12,000 people to support one of those things and at low level it is presumed that there. is a regional shopping facility that they support; it is in another echelon and that would be Glenwood Springs. So the thinking should be maybe the Trueman Property ought to be something else other than just a small neighborhood nucleous. Not only is the neighborhood much more dense in terms of number of people around it; but it is the only space presently available in a situation of need that can handle supplementary facilities. Therefore, Yaw felt that that there should be a consolidation and for it to be consolidated in a place where a shopping destination would occur and not a shopping spree. A shopping destination means that you drive your car and will be around awhile and a housewife really doesn't like to take 10 bags of groceries on a bus. It will generate some traffice but as a shopping destination that the traffic will be controlled because they will not have to go all over the area to pick up a variety of items. Yaw asked that the Planning and Zoning Commission make a recommendation to Council so that the process isn't held up any longer. Dobie asked what Yaw felt of a massive shopping center in that location as an element of an auto disincentive program. Would it be a positive element or a negative element. Yaw felt that it is positive because a) there is a need; the malls are going to be created, it will cause a relocation of businesses so that the housewife can go to a consolidated shopping destination. That is auto disincentive because you can go there, get your shopping done and won't have to wander downtown and accomplishing a series of shopping needs. b) as to the size, we are not sure what Aspen can ultimately support; we don't want to close off the ends, nor do we feel that your recommendations should close off the ends. Trueman will probably do this in a stage construction process which is essentially responsive to need. c) the buildings would have a series of interconnected space. The only thing that constrains massing of that site is the size of the site and specifically parking. In the plan we have parking that can accommodate super optimum to bare minimum. If shrink the parking area, the building can take a more generous disposition on the land itself. Yaw still feels that it is architecturally important that it follows the contour of the hill. Yaw mentioned that they really haven't goteen to the point where we could understand the full implications of massing versus parking because it is being taken through this process. We are just presenting you with a level of information and next time the information will be more detailed. -3- .~-~ -~- •uMOq aqq punozE suorgengTS ~izagd-rzad uT zo azaq 'qi apinozd oq quEM no~I op azagM ;o uoigsanb e aq i'[ZM azagq puE aidoad ;o zaqumu buiseazoui ue zo; aoznzas aptnosd o} aneq oq buiob azE aM asnEOaq buzpiinq aqq ;o adoos uEgq zagqEz paau aqq ~iq pagEOZpuT sr azzs aqy •sgaxzEUi Azagdizad uEgq saggez azzs gegq gaxzEUC E aas zagges pinoM aq snooo oq buiob seM ggMOZb ;i gEqq qia; suixuar •iiEnazd iiTM panssT sEM giuczad aqq aurrq aqq qE uoisinozd apoo aqq sz suaddEq gELjM 'qi uo az-rs E zo asn,oT;Toads butpnioui oq ob q,usaop iEngdaouoo auq geuq pauTEidxa zaiingg dauzogq~ AqT~ •gaxzEUi au} oq pagEiaz aq buzuozuMOp pasodozd aqq pinoM Moq 'paquezb sEM iengdaouoo aqq ;i gEt[q pauo-rgsanb aggp •azis buipiinq puE peon azE suoigEZapTSUOo dy1 •sgszznoq aqq oq pazapuazzns aq i'[TM uMOquMOp aqq puE buiddogs urooquMOp aqq abuego iiTM qi •abzei qE[~q buzpiinq E anEq uegq ob buisnoq aqq aas zagqEz pinoM puE anissEUC ooq st buipitnq aqq gEqq qia; uiTaupoo~ •AEM gEqq pauoz SEM puei aqq asnEOaq ieiozaunuoo poogzogqbiau aq pinogs qT gEqq siaa; suiiio~ •eaze aqq uo q~EdUIT snopuaurazq E ageazo "[iTM pasodozd se EazE auq gEqq siaa; suiiio~ •gaxzEUCZadns E puE iETOZauioo poogzogqbzau zo; paau agiut;ap E si azagq gEqq qia; gogq~ •gnopiinq iEgoq qaa; asenbs 000'Ot~ oq qaa; azenbs 000'0£ ;o poogzogqbiau aqq uz aq pinoM qT gEqq pauorquaui MEN •uoigoas gaxzEUizadns aqq zo; azis ageu[txozdde ztagq aq pinoM gEgM 'panozdde sEM •q;•bs 000'SL aqq ;i paxsE qunH •uiaigozd gEqq buzdiaq oq zaMSUE uE aq ueo spaau ;o gas aozo; digbiq ~Czan E zapun pue Mou ggbzz aigeiTEAE sT gegq Agiungzoddo uE poob se apinozd oq buzob sT gEqq uoigen -qzs E st hgzadozd ueuranzy aqq gegq pies ME]{ •piinq oq coeds aigeiiEnE puE 'codes buixzed 'Suzuoz ageTZdozddE aqq saXeq lanai gEqq ;o buzggauios gegq pauoiquaui MEN •osie zaquao buzddogs gEqq oq ob oq ~iqunoo aqq uioz; aidoad buiggab aq pinoM dagq gEqq pauoiquaui aigoQ •EazE duungMOUg aqq ui .zaquao buiddogs E gzoddns oq EazE uads~ aqq ui aidoad gbnoua aq qou ~iEUi azagq gEqq pTES aq uagM quiod poob E pEq MEN gEqq qia; uauraiquab aucES aqy •gaazgg uTEyy ;o ;;o uoigsab -uoo aqq gab ueo aM os uMOq oquT qx buibuzzq ;o peagsui ob pinogs ogne aqq azagM sz gEqq aq~IEUC gEqq duungMOUg dq qno sEM zaquao buiddogs e ;t gEqq pagsabbns aigoa •dizq buiddogs ;o puTx auras aqq gST"[dIIIOJ~E oq saoEid quaza;;ip iEZanas oq uMOq punoze ob oq buineq uEgq zagqEz gods auo ui sbuigq asogq ;o goie ;o azEO axEq oq aigE aq i"[TM Aagq asnEOaq :uads~ u-r an-ri oqM aidoad auq zo; anTquaouTSip ognE iEOOi e aq pinoo gEuq ~iigeniaouoo :dgzadozd uEUranzy aqq axii gods auo uT pazagsnio aq pinoo saoinzas asogq ;o zaqumu E 'zanaMOg •uMOq aqq ;o sEasE snozzen uz saoeds buTxzEd zo; paau E azinbaz iiTM go-ruM suotgEOOi quaza;;ip iEZanas oq anrzp oq zEO ziagq asn oq anEq iiiM ~Cagq spuEZZa iEZanas op oq anEq aidoad iEOOi ;I •azagq uMOp 5[jEM oq gSIPM oqM aidoad asogq oq zagEo TiTM ~Igzadozd ueucanzy aKy •umoq oquT zEO aqq qai qou puE zEO aqq ;o qno sgszznoq gab oq si gsnzuq Azeuiutiiazd auy •dquno~ ar~q zo; uiEZbozd aniquaoursip ognE uE uo (p,quo~) buixzoM azE hauq gEqq pauo-cquaui pMOZO aqq uioz; uauraiquab ~ dgzadozd ueuranzy SL6i '6 zaqucaoaa uOZSSTllIUIO~ buTUO'j, puE butuuEia uadsy RECORD OF PROCEEDINGS 100 Leaves FORM W F F. Regular Meeting Aspen Planning and Zoning Commission December 9, 1975 Trueman Property Hunt moved that the Planning and Zoning recommend Motion approval of the conceptual approval of the Trueman Property proposal as shown noting to the developers taking cognizance of the points brought up by the City Engineer, and also that the right-of-way be reserved through the panhandle and that any improvements to that section are at the risk of the owner or developer; in other words no value for condemnation or dedication purposes for a period of 5 years and that all conditional uses will be on application. That they agree to partici- pate in dedication should the road alignment go through there; but they recognize the principle that they should be involved to some degree to be determined at a later date on the dedication of land should the land go through that; seconded by Otte. All in favor were Jenkins, Otte, Hunt and Abbott. Opposed were Goodheim, Collins, and Dobie. Motion carried. Ordinance #66, Stuller explained that as the code stands now there is Series of 1975 no authority to keep animals anywhere in the City. The Building Inspector is left in a position where he can't deny anyone the right to have domestic animals. We would like to acknowledge existance in residential districts of keeping of animals not detrimental if certain existance exists. The Ordinance says that keeping of animals exits if it is not a commercial activity, there are no health hazards, not a public nusiance and area is kept clean. 47e are asking for a recommendation to take it to Council. Motion Hunt moved to recommend adoption of potential Ordinance #66; seconded by Otte. All in favor, motion carried. Ordinance #67, Hunt moved to recommend dropping of Ordinance #67, Series of 1975 Series of 1975 as it is extremely poorly written. Jenkins felt that they are trying to accomplish the right thing with the wrong approach. City Attorney Stuller agreed and further explained that the people coming in with proposals, where even though it was open space it was so far below that the public didn't take advantage of it. The concern is direct public access, that should be the criteria not where it is located. Jenkins mentione that the public space has to be accessible, but that should be determined at the final plat as whether that is public by definition because of the way it was set. Examples of buildings are the Patio building, and the Professional Building. City Attorney Stuller sursnarized what Planning and Zoning would like the Ordinance to include and that is to further define public open space to make sure that there is public access and it does constitute an invitation for public use. Also that there be no code change but that the Planning and Zoning on their interpretation of what is public will determine the accessibility is there. Motion Hunt incorporated in his motion that City Attorney Stuller conveys Planning and Zonings feelings about the Ordinance; seconded by Abbott. All in favor, motion carried. Ordinance #71, City Attorney Stuller felt that from the discussion Series of 1975 the Planning and Zoning is concerned that the architec- PUD Ordinance tural review is too highly a sophisticated technical review with itemized criteria for the Planning and Zoning Commission. Also concerned with that type of review without the qualification of how it is done. -5- _ _ _~~ . ~, -9- uorganTEna puET gtun buiTTaMp aug paurEgaz uoisszunuo~ buiuoZ puE buzuuETd au} zE3 os gEug pauogiuatu zaTTngg dauzoggFl dgz~ •aouEnssi quauEiuzad 3o auiig gE piEd aq o3 anEu g,usaop g? City Attorney Stuller mentioned that Goodheim is asking that a new theory is incorporated whereby housing entities are enhanced as development projects to reduce the dedication requirements when you send up the dedication you endorse his approach. Kane mentioned that Goodheim is coming forth with a proposed public housing district which takes the existing zoning and asks for special benefits; it asks for increased density per given land value to depress the unit land cost per dwelling unit. It depends on how you use the subsidy, it depneds on if you review the subsidy as increased density in order to reduce unit land cost. Otte mentioned that he would not like to mix the two issues together. Goodheim mentioned that he would take and present this to Council.
