Regular Meeting As en Planning and Zoning Commission December 9, 1975
Meeting was called to order by Chairman Jack Jenkins at 5:20 p.m. with members
Roger Hunt, Patrick Dobie, Brian Goodheim, Chic Collins, Mike Otte and Danny
Abbott present. Also present was City Attorney Stuller and Hal Clark from
the Planning Department.
Old Business Clark mentioned that they have one addtional item
under Old Business which is a Resolution of the Designation
of Four Historic Structures; all it needs is the
Planning and Zoning's signature. (The Resolution is
attached to this set of minutes and can be found in
the Record Proceedings book in the back of these minutes)
Clark asked that one additional ordinance be added which
is the Open Space Ordinance. City Attorney Stuller
explained that she initiated a change and the change
would go to the Planning and Zoning. It will be Item
)k6 under old business. Ordinance $85, Series of 1975.
Jenkins felt that as a result of the last few meetings,
everyone is going in many diverse directions without
guidance; therefore, he went nd spoke with Mayor
Standley with the following ~~i~iis-in mind. He
would like to have a joint meeting with the Planning
Department, City Council and Planning and Zoning to ask
for policy direction for the Planning Office and for the
Planning and Zoning in connection with the following
items: a) policy direction with what to do with Spring
Street; if it is open for consideration or it is outside
the realm of consideration. b) We cannot plan unless we
recognize that a growth rate is going to occur and if
so what do we think it is going to be and if we recognize
this fact then we must plan accordingly. c) The buildout
in the City is one of our smaller problems; we have
to think about Snowmass and the presently subdivided
lots in the County will be the things that continue to
pressure us with what was discussed under item (b) above.
d) Jenkins feels that if we downzone it should last
for a reasonable period, and that would be from 3 to
10 years; or it will be just temporary zoning and if
we do temporary zoning we pacipitate movements and
buildings that are .uacompletely unreleated to the
needs of the community because people are fearful of
continued and further downzoning so we need to say;
what do we really want to do and I am not interested
in something that will last a year. e) Do we our do
we not, for the City Council level, want a small
perimeter markets in which we make an effort to make them
almost "inconvenient" as opposed to a supermarket or
location in town where we put the services we need for
the local resident. I want the Council to tell us
what their policy is about one-stop shopping, perimeter
markets. I have no guidance and if I can have the answer
to that then I can give them answers to other detailed
problems. f) when we get into the area of discussing
the uses that are stated in the neighborhood commercial
and the S/C/I zone, I want to have someone tell me
that, yes the permitted and conditional uses that we
have listed are things that we see or feel that the
City and/or the County pressure that we are going to
receive needs in this area. Either the uses that are
both permitted and conditional in those two zones and
are desirable within the City or they are desirable
outside the City and I want the Council to tell us if
they want those uses in the City or outside of the City.

Trueman Property laundary, shoes, drug store, those type of shops, the
(COnt'd) whole town could hardly support one. He can't support
the fact that neighborhood shopping centers can support
a whole nucleus of needs. Yaw then looked at what it
takes to support a minimum neighborhood shopping facility
that is, the basic needs that are outlined in the
zoning. It takes 7,000 to 12,000 people to support one
of those things and at low level it is presumed that there.
is a regional shopping facility that they support; it
is in another echelon and that would be Glenwood Springs.
So the thinking should be maybe the Trueman Property
ought to be something else other than just a small
neighborhood nucleous. Not only is the neighborhood
much more dense in terms of number of people around
it; but it is the only space presently available in a
situation of need that can handle supplementary
facilities. Therefore, Yaw felt that that there should
be a consolidation and for it to be consolidated in a
place where a shopping destination would occur and not
a shopping spree. A shopping destination means that you
drive your car and will be around awhile and a housewife
really doesn't like to take 10 bags of groceries on a
bus. It will generate some traffice but as a shopping
destination that the traffic will be controlled because
they will not have to go all over the area to pick up
a variety of items. Yaw asked that the Planning and
Zoning Commission make a recommendation to Council so
that the process isn't held up any longer.
Dobie asked what Yaw felt of a massive shopping center in
that location as an element of an auto disincentive
program. Would it be a positive element or a negative
element.
Yaw felt that it is positive because a) there is a need;
the malls are going to be created, it will cause a
relocation of businesses so that the housewife can go
to a consolidated shopping destination. That is auto
disincentive because you can go there, get your shopping
done and won't have to wander downtown and accomplishing
a series of shopping needs. b) as to the size, we
are not sure what Aspen can ultimately support; we
don't want to close off the ends, nor do we feel that
your recommendations should close off the ends. Trueman
will probably do this in a stage construction process
which is essentially responsive to need. c) the buildings
would have a series of interconnected space. The only
thing that constrains massing of that site is the size
of the site and specifically parking. In the plan we
have parking that can accommodate super optimum to bare
minimum. If shrink the parking area, the building can
take a more generous disposition on the land itself.
Yaw still feels that it is architecturally important
that it follows the contour of the hill. Yaw mentioned
that they really haven't goteen to the point where we
could understand the full implications of massing
versus parking because it is being taken through this
process. We are just presenting you with a level of
information and next time the information will be more
detailed.

Trueman Property Hunt moved that the Planning and Zoning recommend
Motion approval of the conceptual approval of the Trueman
Property proposal as shown noting to the developers
taking cognizance of the points brought up by the City
Engineer, and also that the right-of-way be reserved
through the panhandle and that any improvements to
that section are at the risk of the owner or developer;
in other words no value for condemnation or dedication
purposes for a period of 5 years and that all conditional
uses will be on application. That they agree to partici-
pate in dedication should the road alignment go through
there; but they recognize the principle that they should
be involved to some degree to be determined at a later
date on the dedication of land should the land go
through that; seconded by Otte. All in favor were
Jenkins, Otte, Hunt and Abbott. Opposed were Goodheim,
Collins, and Dobie. Motion carried.
Ordinance #66, Stuller explained that as the code stands now there is
Series of 1975 no authority to keep animals anywhere in the City. The
Building Inspector is left in a position where he can't
deny anyone the right to have domestic animals. We
would like to acknowledge existance in residential
districts of keeping of animals not detrimental if certain
existance exists. The Ordinance says that keeping of
animals exits if it is not a commercial activity, there
are no health hazards, not a public nusiance and area
is kept clean. 47e are asking for a recommendation to
take it to Council.
Motion Hunt moved to recommend adoption of potential Ordinance
#66; seconded by Otte. All in favor, motion carried.
Ordinance #67, Hunt moved to recommend dropping of Ordinance #67,
Series of 1975 Series of 1975 as it is extremely poorly written.
Jenkins felt that they are trying to accomplish the right
thing with the wrong approach. City Attorney Stuller
agreed and further explained that the people coming in
with proposals, where even though it was open space
it was so far below that the public didn't take advantage
of it. The concern is direct public access, that should
be the criteria not where it is located. Jenkins mentione
that the public space has to be accessible, but that
should be determined at the final plat as whether that is
public by definition because of the way it was set.
Examples of buildings are the Patio building, and the
Professional Building. City Attorney Stuller sursnarized
what Planning and Zoning would like the Ordinance to
include and that is to further define public open space
to make sure that there is public access and it does
constitute an invitation for public use. Also that there
be no code change but that the Planning and Zoning on
their interpretation of what is public will determine
the accessibility is there.
Motion Hunt incorporated in his motion that City Attorney
Stuller conveys Planning and Zonings feelings about
the Ordinance; seconded by Abbott. All in favor, motion
carried.
Ordinance #71, City Attorney Stuller felt that from the discussion
Series of 1975 the Planning and Zoning is concerned that the architec-
PUD Ordinance tural review is too highly a sophisticated technical
review with itemized criteria for the Planning and
Zoning Commission. Also concerned with that type of
review without the qualification of how it is done.

City Attorney explained that you take the amount of
dwelling units you are going to construct and from that
you determine how much acerage you have to dedicate
and the value of that acerage is premised on the market
value of the land.
Jenkins mentioned that they are evaluating the impact
on the City Park system in effect; not collecting
money for any other reason.
City Attorney Stuller mentioned that Goodheim is asking
that a new theory is incorporated whereby housing
entities are enhanced as development projects to reduce
the dedication requirements when you send up the
dedication you endorse his approach. Kane mentioned
that Goodheim is coming forth with a proposed public
housing district which takes the existing zoning and
asks for special benefits; it asks for increased density
per given land value to depress the unit land cost per
dwelling unit. It depends on how you use the subsidy,
it depneds on if you review the subsidy as increased
density in order to reduce unit land cost.
Otte mentioned that he would not like to mix the two
issues together. Goodheim mentioned that he would take
and present this to Council.
Hunt stated the reasons he would vote agains'~it; 1) it
is terriby inequitable in that it does not address
improvements to existing structures that have not been

Jenkins explained what the ordinance is saying is that
the money is going to come from all new residential
uses and spread equally on the basis of a formula that
pretty much applies to the bedroom number of people
types applied back to the cost of the land. The
principle of applying across the board equally.
Motion Goodheim made a motion to recommend the approval of
amendments as stated by City Attorney Stuller in here
memo; seconded by Abbott. All in favor; Goodheim,
Otte, Abbott, Jenkins and Dobie. Opposed, Hunt.
Motion carried.
Stan Johnson rezoning The following two requests were referrals from the
request County Planning and Zoning. Jenkins felt that it is
Rubey Estates increasing a use in an area that at this time is not
Subdivision applicable. The Planning and .Zoning Commission agrees
with the County Planning and Zoning that the Stan
Johnson referral is inappropriate at the time and the
transit should be resolved and the tourist zoning is
premature for that.
Rubey Estates, the City Planning and Zoning concurs
with the County R-30 area.
