To Whom It May Concern: _
Aspen Carriage and Sleigh is requesting a tmporazy use permit to run public sleigh rides
on the Bernese Boulevard trail out at the Aspen Golf Course. We aze requesting a Staff
Level Temporary Use Permit for 7 days starting December 17, and then a 7 day
extension. This will permit us to accommodate the holiday crowds before the City
Council can approve a season long permit.
Aspen Carriage and Sleigh intends to provide public sleigh rides up to 7 days a week
from noon until 7:00 or 8:00 pm (exact time to be determined). We agree to provide
closed horse diapers, and clean any mess that may occw from the horses or clients of the
sleigh rides. We agree to groom the trail after each ride as requested by the Pazks
Department.
We have spoken with Stephen Ellsperman, Austin Weiss, and Steve Aiken of the pazks
department and have their full support. We have also spoken with Ute Mountaineering
who has a Nordic Ski shop on location to make swe there aze no issues or objections.
We have leR several messages with Shlomo's on the Green restaurant on sight to make
swe we accommodate their needs, but have not heazd back.
We ask the same privileges extended to the previous business that ran sleigh rides on the
golf course, in that we ask permission to place a sign at the golf cowse entrance and
Highway 82 advertising sleigh rides with ow phone number. We would like to be able to
store a tarped sleigh on site, as the previous business did.
Aspen Carriage and Sleigh Carries a $2 million General Liability Policy, proof of which
was faxed with this request.

allow a commercial sleigh ride operation on the City of Aspen Golf course from
December 17 to December 30, 2005 while the sleigh ride operator seeks a Temporary Use
Permit from City Council, scheduled on January 9, 2006. The applicant is intending on
operating a commercial sleigh ride operation on the City of Aspen Golf Course. The
applicant is working with the Trails Coordinator to make sure the Nordic trails will not be
negatively impacted by the operation.
The Community Development Director may approve Temporary Use Permits not
exceeding seven (7) days. The Director may extend the temporary use for an additional
seven (7) days if requested by the applicant in writing. Staff recommends the Director
approve the Temporary Use of a commercial sleigh ride operation on the City of Aspen
Golf Course:
The applicant shall continue to seek all necessary approvals from City Council to
operate the temporary use through March 2006.
2. The temporary use is valid from December 17, 2005 through December 30, 2005.
The applicant shall seek and receive any necessary approvals for signs relating to
the operation from the City Zoning Officer.
4. The horses and sleigh shall be limited to the Bernese Boulevard dog Nordic trail
at the City of Aspen golf course. The horse shall wear a diaper to prevent waste
on the trail and the sleigh shall pull a drag to re-groom the course

26.96.030 Criteria Applicable to all Temporary Uses
When considering a development application for a temporary use, City Council shall
consider, among other pertinent factors, the following criteria as they, or any of them,
relate thereto.
A. The location, size, design, operating characteristics, and visual impacts
of the proposed use.
Staff Finding:
The sleigh ride operation will originate from the first tee on the Aspen Municipal Golf
Course, to the northwest of the pro shop. The sleigh rides will operate daily.
B. The compatibility of the proposed temporary use with the character,
density and use structures and uses in the immediate vicinity.
Staff Finding:
The sleigh ride operation is not expected to create any character or density problems for
the area.
C. The impacts of the proposed use on pedestrian and vehicular traffic and
traffic patterns, municipal services, noise levels, and neighborhood
character.
Staff Finding:
The sleigh ride operation will not impact traffic patterns as it is being run on the golf
course, there shall not be any increase in noise levels and the City of Aspen is
supporting this application and operation. Parking at the golf course is ample for the
sleigh ride operation and Nordic trails operation.
D. The duration of the proposed temporary use and whether a temporary
use has previously been approved for the structure, parcel, property or
location as proposed in the application.
Staff Finding:
The applicant is requesting a Staff level approval for aseven-day temporary use and a
seven-day extension prior to approval by the City Council for the duration of the winter.
The Temporary Use Permit must be done in the manner to satisfy noticing
requirements.
E. The purposes and intent of the zone district in which the temporary use is
proposed.
Staff Finding:
The Park (P) zone district allows for recreational uses.
F. The relation of the temporary use to conditions and character changes
which may have occurred in the area and zone district in which the use is
proposed.
Staff Finding:
There are no changes in the surrounding land uses that would prohibit this operation.

Publication of notice: By the publication in the legal notice section of an official
paper or a paper of general circulation in the City of Aspen at least fifteen (15)
days prior to the public hearing. A copy of the publication is atta~hed hereto.
Posting of notice: By posting of notice, which form was obtained ~om the
Community Development Department, which was made of suitable,
waterproof materials, which was not less than twenty-two (22) inches wide
and twenty-six (26) inches high, and which was composed of letters not
less than one inch in height. Said notice was posted at least fifteen (IS) days
prior to the public hearing and was continuously visible from the~^ day of

Mailing of notice. By the mailing of a notice obtained from the Community
Development Department, which contains the information described in Section

prepaid U.S. mail to any federal agency, state, county, municipal government,
school, service district or other governmental or quasi-governmental agency that

development application. The names and addresses of property owners shall be
those on the current tax records of Pitkin County as they appeared no more than
sixty (60) days prior to the date of the public hearing. A copy of the owners and
governmental agencies so noticed is attached hereto.

Rezoning or text amendment. Whenever the official zoning district map is in
any way to be changed or amended incidental to or as part of a general revision
of this Title, or whenever the text of this Title is to be amended, whether such
revision be made by repeal of this Title and enactment of a new land use
regulation, or otherwise, the requirement of an accurate survey map or other
sufficient legal description of, and the notice to and listing of names and
addresses of owners of real property in the area of the proposed change shall

SUMMARY: Sandra Dieterich and Aspen Carriage and Sleigh, applicants, are requesting a
Temporary Use Permit to allow a commercial sleigh ride operation on the City of Aspen
Golf course from January 10, 2006 to March 31, 2006. The applicant is working with the
Trails Coordinator to make sure the Nordic trails will not be negatively impacted by the
operation.
A Temporary Use Permit was approved for a different operator in both 2002 and 2005 for
sleigh rides on the golf course for the winter season. There were no complaints by
neighbors or other trail users with regards to that operation. Staff recommends approval
of the sleigh ride operation with conditions.

grant a temporary use of up to one hundred eighty (180) days. As provided for in that
subsection, all proposed extensions of a temporary use shall be evaluated under the same
criteria as set forth in Sections 26.450.030 and 26.450.040.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
GRANTING A TEMPORARY USE PERMIT TO ALLOW FOR THE OPERATION OF
COMMERCIAL SLEIGH RIDES ON THE CITY OF ASPEN GOLF COURSE, GOLF
COURSE SUBDIVISION, LOT I, ASPEN, COLORADO

WHEREAS, pursuant to Section 26.450 of the Aspen Municipal Code, the Applicants,
Sandra Dieterich and Aspen Can•iage and Sleigh has submitted an application for a Temporary
Use Permit to allow the operation of commercial sleigh rides on the City of Aspen golf course,
Golf Course Subdivision, Lot 1; and,
WHEREAS, the Applicant requests this use from January 10, 2006 to March 31, 2006;
and,
WHEREAS, Community Development reviewed the temporary use application and
recommends that the City Council approve the temporary use permit with conditions; and,
WHEREAS, City Council finds that the proposed temporary use is not inconsistent with
the character and existing land uses of the surrounding parcels and neighborhood and that
granting the temporary use permit will not adversely impact the neighborhood; and,
WHEREAS, City Council finds that granting the temporary use permit will further the
public interest and welfare by maintaining a valuable wintertime recreational activity in the
Aspen area which is also consistent with the uses permitted in the underlying zone district.

Section 1
In accordance with Section 26.450.020 of the Aspen Municipal Code, the City Council of the
City of Aspen, Colorado, does hereby grant Sandra Dieterich and Aspen Carriage and Sleigh, a
temporary use permit to operate a commercial sleigh ride operation on the City of Aspen Golf
Course with the following conditions:
The temporary use is valid from January 10, 2006 to March 31, 2006.
The applicant shall seek and receive any necessary approvals for signs relating to the
operation from the City Zoning Officer.

The horses and sleigh shall be limited to the Bernese Boulevard dog Nordic trail at the
City of Aspen golf course. The horse shall wear a diaper to prevent waste omthe trail and
the sleigh shall pull a drag to re-groom the course
4. All material representations made in the application and in the hearing by the applicant
and the applicant's representative shall be considered conditions of approval, unless
amended by other conditions.
APPROVED, January 9, 2006, at a public hearing before the City Council of the City of Aspen,
Colorado.
