Gazdenswartz is an attorney licensed in the State of Colorado and practicing law in the City of Aspen, Colorado, is a qualified elector in the City of Aspen and has resided within the City of Aspen for more than one yeaz; and WHEREAS, the Charter of the City of Aspen, Section 7.2(b) authorizes the City Council to appoint one or more Deputy Municipal Court Judges in the event that the Municipal Court Judge is unavailable or must recuse himself due to a conflict. A Deputy Municipal Judge must be a licensed attorney; and WHEREAS, Chapter 26.222 of the Aspen Municipal Code authorizes the appointment of one or more Administrative Hearing Officers for the purpose ofhearing certain appeals within the Land Use Code. A hearing officer must be a qualified elector in the City of Aspen and a resident of the City for one year prior to appointment; and, WHEREAS, Ted D. Gazdenswartz has agreed to act as Deputy Municipal Judge and as an Administrative Hearing Officer; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: That said Ted D, Gardenswartz be and hereby is appointed a Deputy Judge of the Municipal Court of the City of Aspen, to preside over court cases as required of him; and That said Ted D, Gardenswartz be and hereby is appointed an Administrative Hearing Officer pursuant to Chapter 26.222 of the Aspen Municipal Code.
