MINUTES OF SEPTEMBER 2, 2009
Chairperson Terry Butler called the meeting to order at 8:30 a.m.
Commissioner in attendance: Bill Dinsmoor, Andrew Kole, Don Sheeley,
John Starr, Mark Goodman, Roger Haneman and Fred Ayarza.
Staff: Kathy Strickland, Chief Deputy City Clerk
The Mustang -owned Greg Jurgensen.
Greg said customers and local businesses are in favor of the outside dining
in the center of the mall. The breaking down of the tables and chairs etc.
became an issue. The Clerk's office got complaints about the chairs being
left out and no one could get through the mall.
Fred said he asked Greg to leave the chairs out.
Terry asked Greg if being outside in the mall was profitable for him.
Greg said it was slow going but they have hooked up a wireless system for
payment. Once that is in place everything will run smoother. We are
working on getting the menu set. We had good and bad things on the menu.
We are excited and would like to change out a few things like the big Red
Bull bar and umbrellas.
Greg said Friday night is great. The adjacent restaurants Dish and Zocalito
like it. The band plays until 9:OOish.
Terry informed the board that the Ritz pulled out of their rental space next to
the Paragon bldg. Terry said when there is quality of music everyone is
gathering around. The music is a family thing.
Andrew said people at night walk right or left; no one has a problem getting
through the mall.
Fred said he has no problem with leaving the tables out. You could pull
them in a little on the sides. It looks a lot better than stacked.
Andrew asked Greg if he thought he had too much space. Greg said he feels
the space is adequate.
Bill said the space seems to work better when musicians play.

Andrew said we didn't have evening music on the corner when we had the
mall music by the clock tower. We received a great response for the family
stage and that should be enhanced next year. There were a lot of people
willing to play. Andrew pointed out that Kathy scheduled all the musicians
and discussed amplification etc.
Bill said we need to figure out how to enhance alfresco dining in the mall.
Terry said on every corner you hear music and there is something on every
comer going on.
Andrew said we just need to tweak the music on the mall and possibly get
funding for the Hyman mall.
Bill said perhaps we can collect a portion of the mall rent for entertainment.
Andrew said he can find some funding to partner for the band at Greg's
restaurant possibly for September.
Don said he is against having stuff in the middle of the mall. You did
squeeze things in. It would be great if you could work with Morris Fyrwald
for outside seating in front of your entrance.
Fred said he likes the middle of the mall. He would also like Dish and
Zocalito to go out in the center.
Andrew pointed out that the retailers like Mustang in the center of the mall.
John said he doesn't like the middle being used for the restaurant. There is
no real definition of it being a restaurant. If there was a clearer definition
that it was a restaurant that might work. It just doesn't feel right for me and
I can't tell the difference between the different restaurants.
Don said the sandwich boards are all over the place. It looks like you don't
lrnow what the restaurant is.
Terry said you can buy little white fences for each erid and it would look like
it was contained.
Fred said he agreed with Don and John about the small fences at each end.
Two menus could be placed on each end.

John said the perimeter needs defined.
Andrew said something at both ends could work. The reason it is unsettled
is the use of the sandwich boards.
Outside merchandise and Food vending:
Drew Alexander, Planner and Kathryn Koch, City Clerk presented a video of
areas throughout the city. There were four topics: Sandwich boards, outdoor
dining, outdoor merchandising and temporary food vending. The video will
be presented to council at a work session 9/21. Council will determine what
regulations need amended if any.
Staff reminded Greg about payment of his mall lease.
Commissioner Comments:
Bill said the Fish and Game Commission put an electrified shock mat at his
business as an experiment to keep the bears from breaking in. Bill said you
plug it in the evening and unplug it in the morning. It seems to work. That
same technology could be used on the dumpsters. Bill asked staff to pass on
the information to the appropriate departments.
Mark said the Rotary did a great job on the Ducky Derby but he agrees with
John that the duck is too large.
Fred reminded the board that we need to start working on the12 days of
XMAS or some XMAS event soon. Staff will contact Nancy Lesley,
Special Events Coordinator for the City and Debbie Braun, president of the
ACRA to brain storm at our next meeting.
