WHEREAS, Ice Gardeh Manager George Pucak submitted an application to the Planning Office for rezoning the City owned Ice Garden property from R-15 to PUBLIC (PUB); and WHEREAS, the Planning Office reviewed the .request and found the request consistent with the existing and future use of the parcel, and recommended approval to the Planning and Zoning Commission; and WHEREAS, the Planning and Zoning Commission heard the rezoning request at their regular meeting on August 21, 1990 and recommended approval to City Council by a vote of 8-0; and W1:EREAS, the City Council, having considered the recommendations of the Planning Office and the Planning and Zoning Commission dces wis?r to grant rezoning of the Ice Garden parcel to PUBLIC (PUB). RE: Ice Garden Rezoning from R-15 to PUBLIC (PUB) - Second Reading of Ordinance 68 Series 1990. SUMMARY: The Planning Office and Planning Commission recommend approval of the rezoning request. First Reading was held on Oct.s and approved by a 4-1 vote. COUNCIL GOALS: This rezoning will place the Ice Garden facility in a position of conformity with its zone district. This in turn allows this recreational resource to upgrade and maintain its place in the community, Goal #7. BACKGROUND: The Ice Garden has been in its location for 26 years. The current zoning designation is R-15. This non- conformity will jeopardize future renovation projects. PROBLEM DISCUSSION: As the facility will not change it's operations as a result of this rezoning, new impacts are not anticipated. Prior to the Planning and Zoning public hearing, the Planning Office received three inquiries from neighbors. All callers had no problem with the request. ADVISORY COMMITTEE VOTE: The Planning and Zoning Commission approved this request by a vote of 8-0 at their regular meeting on August 21, 1990. This community recreation facility as it exists is not a permitted use in the R-15 zone, but is listed as a permitted use in the PUB zone. Given a rezoning of this parcel, the use of the property will not change. It will remain the City owned and operated skating facility. The plans for the Ice Garden include facilities improvements. As a non-conforming use in the R-15 zone, future improvements might not be permitted. The following are standards from Section 7-1002 which must be addressed when considering a Map Amendment (rezoning): 1. Whether the proposed amendment is in conflict with any applicable portions of this chapter. response: This proposal will legitimize a land use which has been in existence since 1964. Response: The Aspen Ice Garden is presently zoned Moderate-Density Residential {R-15). The permitted uses are as follows: 1. Detached residential dwelling; 2. Duplex; 3. Farm buildings and uses, provided that all such buildings and storage areas are located at least one hundred {100') feet from pre-existing dwellings on other lots; 4. Home occupations; and 5. Accessory buildings and uses. Question ~2 -The area of the property proposed to be amended, stated in square feet or acres, or a major fraction thereof; Response: The subject property comprises nine lots, each measuring 30' x 100' for a total of 27,000 square feet. Attachment 4 Responses to ReBiew Standards Question A -Whether the proposed amendment is in conflict with any applicable portions of this chapter. Response: No, the proposed amendment would not be in conflict with any applicable portion of the Public Zone District. Question B -Whether the proposed amendment is consistent with atl elements of the Aspen Area Comprehensive Ptan. Response: Yes, the proposed amendment is consistent with all elements of the Aspen Area Comprehensive Plan. Question C -Whether the proposed amendment 1s compatible with surrounding Zone Districts and land uses, considering existing land use and neighborhood characteristics. Response: The Aspen Ice Garden was constructed 1n 196d and has operated continuously in the same location for 26 years. Most of the zoning, land uses and neighborhood development have come into place since its constructlon. The buiiding is a public recreation facility and has always enjoyed a good operating relationship with the surrounding nelghborP~ood. Question D -The effect of the proposed amendment on traffic generation and road safety. Response: Since the Ice Garden is already in existence, there will be no chsr~ge in traffic generation or road safety. Attachment 4 Page 2 Question E -Whether and the extent to which the proposed amendment would result in demands on public facilities, and whether and the extent to which the proposed amendment would exceed the capacity of such public facilities, including but not limited to transportation facilities, sewage facilities, water supply, parks, drainage, schools and emergency medical facilities. Response: Again, the Ice Garden is already in existence and operating. No change is anticipated in transportation requirements, sewage requiremehts, water supplies and drainage re- quirements. It will not change with respect to its relation- ship to parks, schools or emergency medical facilities. Question F -Whether and the extent to which the proposed amendment would result in slgnlticantly adverse impacts on the natural environment. Response: The proposed amendment will have no adverse impacts on the natural environment. Question G -Whether the proposed amendment is consistent and compatible with the community character in the City of Aspen. Response: Ves, the Aspen Ice Garden has been a part of the Aspen Community since 1964. It serves the recreational skating needs of adults and children for Goth visitors and the local population. .-. ,.-; Amendment 4 Psge 3 Question H -Whether there have been changed conditions affecting the subject parcel or the surrounding neighborhood which support the proposed amendment. Response: The Ice Garden is currently a non-conforming use in a non conforming zoning. In order for the City to improve, remodel or upgrade the facility, it must be first placed into the correct zoning category. Question I -Whether the proposed amendment would be in conflict with the public interest, and is in harmony with the purpose and intent of this chapter. Response: No, this rezoning would not be in conflict with the public interest.
