RE: Insubstantial change to a PUD: Unit B-21, Midland Park

Attached is a copy of a request by Doug Graybeal to add
approximately 200 square feet to an existing one bedroom unit
(unit B-21) in the Midland Park Employee Development. The 200
square feet will be within the existing structure. The only
proposed exterior change is a new window.
This application is made pursuant to Section 7-907. The
application does not reduce open space for the project, does not
affect the character of the project, and increases the square
footage of the project by only .6%. The applicant has done a
great deal of research to provide us with information about the
Midland Park project, (see attached application) which indicates
that the proposal will not have significant impacts on the
development as a whole. The information provided also indicates
that there are, to date, no concerns regarding the cumulative
impact of past proposals.
I recommend that the attached application is consistent with
Section 7-907 of the Land Use Code and should be granted pursuant
to the attached plans.

Dear Planning Officials:
As you are aware an increasing proportion of our community is growing up and
further establishing itself as a permanent part of our community. I am part of
that base and request the means to increase my living conditions to
accommodate the growth. Since my options are limited due to community
economic constraints, I am requesting to add a loft to my employee housing unit
in Midland Park. Such a request could not be reasonably anticipated during the
project's approval process almost ten years ago. For this reason and per my
preapplication conference, I am requesting my application be reviewed as an
Insubstantial Amendment.
My application does not violate any of the conditions stated in Attachment 4 of
the Application Package. My request is only for an increase of approximately
200 sq. ft. of F.A.R., less than .6% of the development, and does not affect use,
character, trip rate, parking, right-of-ways, structure coverage of land, demand
for public facilities, or reduce open space.
Midland Park site is 114,562 sq. ft. with a lot coverage of 60,861 sq. ft. by road
and buildings, leaving a remainder of 53,701 sq. ft. of open space, or 47% of the
site. The site permits a maximum floor area ratio of 1:1 for 114,562 sq. ft. The
existing floor area not counting minor changes approved by the Building
Department (see attached list) is 32,462 sq. ft., or 28% of permitted.
Land requirements per unit calculations are as follows:
8 one bedroom units @ 1,250 s.f. of land = 10,000 s.f.
14 two bedroom units @ 2,100 s.f. of land = 29,400 s.f.
15 two bedroom units @ 3,630 s.f, of land = 54,450 s.f.
Total Land Required for Units 93,850 s.f.
Land requirements per bedroom are as follows:
81 bedrooms @ 1,000 s.f. of land = 81,000 s.f.

So, as you can see, Midland Park has substantially under used its maximum
allowable F.A.R.
Upon consulting with the City Clerk and other City personnel (current and past)
involved during Midland Park's approval process, no recollection of an attached
limit to or conditions to project's F.A.R. were recalled or found. Enclosed is a
list of documents reviewed on the above mentioned persons' recommendations.
The list is from the Board of County Commissioners Index. Upon review by a
planning consultant familiar with Midland Park, no mention of restrictions or
limitations on F.A.R. were found. In addition, no record subdivision documents
have been found. Most of the information is meeting notes and contract
information. One reference is made of an exterior change discussion but
appears to be for the original design.
Record documents uncovered in the Building Department files for approved
changes are listed on an enclosure. Also enclosed is a site survey and site
layout drawings used during the original construction.
The last enclosure is a copy of a letter with attachment from the Board of
Directors of Midland Park giving the Homeowners' approval of my loft addition.

We have reviewed your plans to enclose a storage area next to the
front door of Midland Park Unit G-13 and underneath the existing
roof, to match the existing finish of the building. We find that
this minor change to an approved Planned Unit Development (PUD)
plan meets the critieria of Section 24-8.26(a) of the Municipal
Code. No change in character of the development or increase in

Dear Alan:
As I discussed with you briefly I am pursuing with the Midland Park
Homeowners approval to expand and enclose the garage area adjacent to
my unit in order to resolve a number of issues, but most importantly
to enclose the area around the plumbing chase (noted on the drawings),
to resolve a long-standing problem with frozen pipes (other remedies
have been unsuccessful) .
I presented the attached proposal at the annual meeting last night
and a majority of those present endorsed the proposal in concept,
pending further consideration of details.
I explained that it would be necessary to proceed with a City approval
process because of current zoning. Some owners wanted clarification
regarding what was involved, so I told them that I would request a
clarification from you.
As I mentioned to you, the Midland Park project was annexed into the
City after the project was completed. Therefore, the PUD plan was
adopted by the County, not the City. Section 24-8.26 (Amendment of
PUD Plans), then, probably doesn't apply technically since the City
has no adopted plan to amend. You explained that it seemed accept-
able to treat the County's adopted plan as the "final plan" for
purposes of dealing with this problem.
However, it is probably not possible to use Section 24-8.26, because
the proposal fails the second test. It is "an increase in the
overall coverage of structures" (even though the 5' x 22' roof
addition is over our existing driveway). I am enclosing some calcula-
tions that I prepared some time ago to illustrate that the proposal
complies with the other tests.
I assume that it will be necessary to apply for an exemption from PUD
under Section 24-8.13 (Mandatory PUD), which permits the Planning and
Zoning Commission to determine that the proposed development meets the
objectives of PUD and, therefore, compliance is not necessary.

My letter is to request a verification of this procedure, for the
benefit of the homeowners and to determine whether it is possible to
proceed with such a request prior to receipt of final approval by the
homeowners association. I expect it will take some time to resolve
all of the relevant issues with the association and I am concerned if
I don't double up on processing that I won't be able to complete the
job this fall.
