This Development Order, hereinafter "Order", is hereby issued pursuant to Section 26.304.070,
"Development Orders", and Section 26.308.010, "Vested Property Rights", of the City of Aspen
Municipal Code. This Order allows development of a site specific development plan pursuant to
the provisions of the land use approvals, described herein. The effective date of this Order shall
also be the initiation date of a three-year vested property right. The vested property right shall
expire on the day after the third anniversary of the effective date of this Order, unless a building
permit is approved pursuant to Section 26.304.075, or unless an exemption, extension,
reinstatement, or a revocation is issued by City Council pursuant to Section 26.308.010. After
Expiration of vested property rights, this Order shall remain in full force and effect, excluding
any growth management allotments granted pursuant to Section 26.470, but shall be subject to
any amendments to the Land Use Code adopted since the effective date of this Order.

SUMMARY:
The applicant has requested an Insubstantial PUD Amendment to allow temporary gravel
parking to be installed along Mining Stock Parkway and Forge Road within the right-of-way.
The total number of parking spaces to be installed is eighteen (18).
Ordinance No. 24 (Series of 2005) approved phase 1 of the affordable housing development. It
also permitted a maximum of 162 parking spaces. Additional phases (2 and 3) are proposed for
the development of more affordable housing units. When a final PUD application is submitted
for the next phase, the temporary spaces will need to be addressed in the application to be
allowed on a permanent basis, or otherwise altered.
STAFF EVALUATION:
The proposed change to allow eighteen temporary parking spaces meets the review criteria for an
Insubstantial PUD Amendment (Exhibit B). The changes proposed are deemed minimally
intrusive and can be formalized through the next final PUD application.
DECISION:
The Community Development Director finds the Administrative Application for An
Insubstantial PUD Amendment as noted above and on Exhibit `A' to be consistent with the
review criteria (Exhibit B) and thereby, APPROVES the request CONDITIONED upon
the Applicant addressing the status of the spaces (to be allowed on a permanent basis, or
otherwise altered) in the next final PUD application for Burlingame.

Pursuant to the -agreement between the home owners at Burlingame Ranch and The City
of Aspen regarding the addition of requested improvements to the Phase I project
including the addition of more parking spaces therefore the Capital Asset Department of
the City of Aspen is seeking authorization to construct temporary parking spaces within
the right-of-way of Mining Stock Parkway and Forge Road by means of an Insubstantial
PUD Amendment.

DESCRIPTION:
Resolution No. 120 (Series of 2004) approved the Conceptual Planned Unit Development (PUD) for the
Burlingame Ranch affordable housing project. The approved conceptual site plan outlines the general parameters
of the project including but not limited to density, dimensional standards, lot delineation, and parking. Since
approval of the conceptual PUD, the first phase of the project has been constructed and is occupied. Now that the
subdivision has residents, the city's Asset department has determined that there is a need for temporary parking
(that may become permanent). The Asset department is interested in developing approximately 17 'temporary'
gravel off-street parking stalls along existing streets within phase 1. This proposed parking is in addition to the 162
approved off-street parking stalls within phase 1, approved through Ordinance No. 24 (Series of 2005).
The entire Burlingame development is considered an active "Development Reasonably Necessary for the
Convenience and Welfare of the Public" (COWOP) project. As such, the Asset department has can request a PUD
Amendment to the Conceptual and Final PUD plan for Phase 1.

The area designated for temporary parking is the grass shoulder of both
Mining Stock Parkway adjacent to the edge of the paved surface. The
objective of this temporary pavement is to achieve the agreement goals
between the HOA's and the City of Aspen to locate and construct
permanent additional parking for the residence of the Phase I project up to
a 2: 1 ratio of parking spaces to unit count. This temporary parking is
designed to provide relief as soon as possible to a difficult parking
condition. The temporary parking will require the removal of the existing
irrigation system and the soil and grass for the installation of a road base
aggregate surface.
